Some Democrats argue \u200cthat he brought \u2062them upon himself, while Republicans express concern over the excessive focus \u200don the one person who poses the greatest threat to President Joe Biden. It is no coincidence that Biden shares \u2062the same \u2062ideology as the prosecutors and judges involved in these \u200bcases.<\/p>\n<p>Voices from the left claim that the judge&#8217;s gag order applies to the government as well, making\u200b it fair. However, there is a significant difference between prosecutors, who willingly \u200bgive up some of their free speech rights by becoming lawyers, and Trump, a private citizen dragged into court. A gag order should be used cautiously, even\u200c in cases\u2064 that do not\u2064 involve presidential candidates.<\/p>\n<h2 class=\"wp-block-heading\">The Battle for the First Amendment<\/h2>\n<p>At first glance, this\u2062 trial may seem \u200dto revolve around the former president. Similarly, Biden and his party&#8217;s minions are counting on judges\u2062 wearing black to carry out\u200d their agenda. John Adams,\u200c a thorn in the king&#8217;s side, once said, &#8220;The \u200bliberty of speaking \u200cand writing\u200c guards our other liberties.&#8221;<\/p>\n<p>In that \u200dspirit, the\u200b U.S. Supreme Court has ruled that the First \u200dAmendment prohibits the government \u2064from punishing citizens for engaging in political speech. If\u2063 this limitation applies to the legislative branch, it \u200ccertainly applies to\u2063 the executive\u200d and judicial branches as well. And \u200bTrump is undoubtedly engaged in political speech.<\/p>\n<h2 class=\"wp-block-heading\">Manipulating the\u2062 Law<\/h2>\n<p>Those who defend the gag order argue that potential\u200c jurors should not \u200bsee comments about the Trump trials. However, they\u200d conveniently forget that \u2063nearly\u200d everyone already has\u2062 an opinion about Trump. However, it is \u200ccrucial to use them with precision, as a\u200c scalpel rather than a \u200bchainsaw.<\/p>\n<p>Trump&#8217;s gag order relies on the landmark U.S.\u200d Supreme Court case of Sam Sheppard, a doctor accused of murdering his wife. However, the court&#8217;s concern in that\u2064 case was for the rights of the defendant himself, not the judge or the prosecutors who\u2062 were playing to \u2063the press and voters.<\/p>\n<p>Here, \u200cthe judge seeks to \u200bprotect the prosecutors,\u2062 claiming that she cannot imagine any other criminal case where a defendant is allowed to call the \u200dprosecutor deranged. As a \u2062prosecutor for two decades, I can attest that criticism \u200cof\u2064 our work is commonplace. We are public officials, and as long as \u2062it does not involve defamation or threats, people can call us any \u2064name they want. Most of us \u200bpay more attention to actual danger from criminals seeking revenge, \u2062so ordinary criticism usually sounds like nonsense and whining.<\/p>\n<p>Which brings\u200b us back to former President Trump. The media coverage and public discourse\u2063 surrounding this trial has \u200bbeen extensive, and it is\u200d highly unlikely that the jury pool remains unaffected by these opinions. Therefore, the selective application \u200cof \u2064the\u200c gag order on Trump is a clear violation of \u200bhis freedom of speech.<\/p>\n<p>Additionally, the argument\u200c that the\u200c gag order is necessary to uphold the integrity of the \u200dtrial is flawed. A fair trial should\u2064 rely on impartial jurors who are capable of\u200c weighing the \u200bevidence presented to\u2064 them, regardless of any outside opinions\u2063 or criticisms.
