They claim that the amendment will overturn\u200b Ohio&#8217;s &#8220;heartbeat&#8221; law, which restricts abortion after six weeks, even in cases \u2062of rape or incest. Soon after, I noticed the same messaging being\u200c disseminated through local and corporate media. The\u2063 Ohio Capital Journal, for instance, <a href=\"https:\/\/ohiocapitaljournal.com\/2023\/10\/19\/what-is-ohio-issue-1-we-explain-the-proposed-abortion-rights-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a> that Issue 1 would simply restore the pre-2022 &#8220;status quo.&#8221; The Plain Dealer, \u200cCleveland&#8217;s prominent newspaper, clarified that while the amendment would overturn \u2064Ohio&#8217;s six-week \u2064abortion law, &#8220;other&#8221; laws, such as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/voters-reject-kansas-abortion-ban-amendment-in-first-referendum-since-roe-overturned\/\" title=\"Voters Reject Kansas Abortion Ban Amendment In First Referendum Since Roe Overturned\">parental consent requirements<\/a> for minors, could remain intact.<\/p>\n<p>At first glance, \u2064it may seem reasonable. However, it \u200cis\u2062 a complete falsehood.<\/p>\n<p>As a \u2063starting point, constitutional amendments \u2064hold greater authority than regular statutes, meaning \u2062Ohio&#8217;s laws\u2063 and local government\u2063 policies can only stand\u200d if they align with the amendment. The proposed amendment grants individuals \u2063the right to make and carry out their own reproductive decisions. Since \u200cthe term &#8220;reproductive decisions&#8221; remains undefined, it encompasses decisions related \u200cto reproduction, including those involving puberty blockers \u2064or irreversible \u200dtransgender interventions for minors. This is not\u200b mere speculation; in <a href=\"https:\/\/www.acluvt.org\/en\/news\/protecting-reproductive-and-gender-affirming-care-vermont\" target=\"_blank\" rel=\"noreferrer noopener\">Vermont<\/a>, the ACLU is already leveraging the state&#8217;s &#8220;reproductive liberty&#8221; constitutional language to protect transgender procedures. Furthermore, the term &#8220;individual&#8221; is also undefined, thus not limited to adults.<\/p>\n<div class=\"fdrlst__b89e9-5fc433d5b1d6b83b67ebc4c182999d77 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5fc433d5b1d6b83b67ebc4c182999d77\"><\/div>\n<h2 class=\"wp-block-heading\">This Is Not a Return to Pre-2022<\/h2>\n<p>The proposed amendment explicitly states that Ohio cannot directly or indirectly interfere with or discriminate against this broad and undefined &#8220;right,&#8221; unless the government can prove that its policy is the &#8220;least \u2062restrictive means&#8221; \u2062to promote the individual&#8217;s health. In simpler terms, any law or policy that affects abortion or \u2063reproductive decisions would be prohibited \u2064unless the government can demonstrate an absolute necessity to protect the patient. Consequently, a\u2062 law requiring the maintenance \u200cof functional abortion \u2062tools would be permissible, as it serves \u2064the state&#8217;s\u2064 interest in maternal health. \u200bHowever, a vast array of policies, including restrictions on Medicaid funding for abortion and regulations on sex education, would be at risk.<\/p>\n<p>This proposed\u200b legal test deviates significantly from the pre-2022 legal framework, commonly referred to as the &#8220;status quo.&#8221; For decades, the Supreme\u200c Court acknowledged that state laws indirectly burdening abortion but serving\u200b a valid purpose were valid. The Court recognized that states had legitimate interests beyond a woman&#8217;s health, \u200csuch as protecting the life of the \u200cunborn child, upholding medical ethics, and allowing for family decision-making.<\/p>\n<p>Under Issue 1, however, these laws would \u200cbe rendered obsolete. The amendment only permits state laws that\u200c promote the mother&#8217;s health and are\u200c narrowly tailored to that objective. Consequently, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michigans-prop-3-follows-the-abortion-on-demand-playbook-be-intentionally-vague-in-defining-health\/\" title=\"Michigan\u2019s Prop 3 Follows The Abortion-On-Demand Playbook: Be Intentionally Vague In Defining \u2018Health\u2019\ufffc\">laws requiring parental consent<\/a> and restrictions on partial-birth abortions would be invalidated.<\/p>\n<div class=\"fdrlst__b89e9-7bddadae75d14ce5d646087ecac04331 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-7bddadae75d14ce5d646087ecac04331\"><\/div>\n<p>Another common claim is that \u2064Issue \u200b1 allows for abortion prohibition after &#8220;fetal viability.&#8221; Even if true,\u2063 this is \u200bstill\u200d much later than what the majority of <a href=\"https:\/\/news.gallup.com\/poll\/1576\/abortion.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Americans<\/a> support. However, the amendment includes\u2064 a broad exception that \u200bundermines\u2064 this\u2063 claim: Abortion must be permitted if the doctor deems it &#8220;necessary&#8221;\u200c for the patient&#8217;s &#8220;health.&#8221;<\/p>\n<p>Here, &#8220;health&#8221; does not solely refer to physical well-being but encompasses an undefined range of factors\u2062 relevant to the mother&#8217;s \u2064overall well-being, including considerations of family size. \u2063Allowing abortion based on one&#8217;s &#8220;well-being&#8221; essentially eliminates any restrictions, \u200da \u200dstance that \u200bis highly unpopular among Americans.<\/p>\n<h2 class=\"wp-block-heading\">Issue 1 Will Exacerbate Suffering<\/h2>\n<p>I understand the appeal of Issue 1. \u200dOhioans are reasonable\u2063 individuals who \u2064empathize with young women facing the trauma of\u200d rape or receiving devastating news about their unborn\u2063 babies.\u2063 These sympathies lead us to question \u200bOhio&#8217;s heartbeat bill, \u2064even if we personally believe abortion is morally \u2064wrong.<\/p>\n<p>However, Issue 1\u200c will \u200conly worsen suffering instead of alleviating it. It permits abortions without parental knowledge, enabling perpetrators to continue \u200ctheir violence. It delays decision-making until a stage when mothers can feel their babies moving inside them, \u200dand <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/proponents-of-ohios-abortion-amendment-dont-want-you-to-know-how-barbaric-it-is\/\" title=\"Supporters of Ohio's abortion amendment conceal its barbaric nature.\">doctors hold partially born\u2062 infants<\/a> in their hands.<\/p>\n<p>Regardless of one&#8217;s stance on abortion, it is crucial to understand the monumental, untested,\u200d and dangerous changes that Issue 1 would bring to Ohio. There are alternative ways to address concerns with Ohio&#8217;s heartbeat law, such as passing a law \u200dor proposing \u2064a ballot-initiative to\u2064 change \u2062the timeframe to 15 weeks, which would still be more permissive than European standards. Exceptions, such as those for cases of rape \u2063and incest, could also \u200cbe added. We should have the opportunity\u2064 to consider these options while keeping our most vulnerable\u200c in mind.<\/p>\n<p>However, Issue \u20621 completely removes these decisions \u2062from the hands of \u2064Ohioans and their representatives. This immobility, anchored far \u2062beyond what the majority of Americans believe\u2063 is\u2063 best, is not \u200cthe way \u2062to protect the well-being\u200c of Ohio women and children.<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> \u2062 Can restrictions on late-term abortions be effectively enforced under the PAA, given its consideration of not just physical health but also mental, emotional, and social well-being?<\/h2>\n<p><span>  Determines that the life or health of the mother is at risk. This exception is not limited to \u2062physical \u2064health but also includes mental, emotional, \u2063and even\u200b social well-being. Therefore, any restrictions on \u2063late-term \u200cabortions would \u2064be virtually impossible to enforce under this amendment.<\/p>\n<p>The proponents\u200d of Issue 1 argue\u2063 that it is necessary to protect reproductive rights and ensure that individuals have the right to make choices about their \u2063own bodies. While this may sound appealing, it overlooks the fact that abortion is not the only aspect of reproductive health. Reproductive health \u2064also includes \u200baccess to contraception,\u200b prenatal care, and support services for pregnant women. \u200dBy\u200b solely focusing on abortion, Issue 1\u2064 ignores the broader reproductive health needs of\u2063 Ohioans.<\/p>\n<p>Moreover, Issue 1 fails to consider the potential\u2062 consequences of unrestricted and unregulated\u200d reproductive decisions. By\u200b eliminating restrictions on parental\u200d notification and ethical abortion \u200dprocedures, the amendment puts vulnerable minors at risk. \u200bIt disregards the important role that parents should\u2063 play \u2064in their child&#8217;s reproductive \u200cdecision-making process \u2063and undermines the ethical standards that should guide medical practices.<\/p>\n<p>It is crucial \u2062to recognize that\u200d Issue 1 goes beyond the scope of protecting reproductive rights; it imposes\u200d far-reaching implications on various aspects of Ohio&#8217;s laws \u200cand policies. It\u2064 raises concerns about the potential \u2064infringement on the rights of individuals and the ability of \u200cthe government to regulate public health and safety.<\/p>\n<p>As Ohioans prepare to cast \u2063their votes on this important issue, it \u200cis essential to be fully informed about \u200dthe implications of Issue\u2062 1.\u2063 We must carefully consider the potential consequences of passing this amendment and its impact on Ohio&#8217;s laws and policies. It \u2063is imperative to strike a balance between protecting \u200dreproductive rights and ensuring the health, safety, and well-being\u200d of all Ohioans.<\/p>\n<p>In \u200dconclusion, Issue\u200c 1 is not just \u200babout protecting reproductive rights but has\u2062 significant implications for Ohio&#8217;s laws and policies. It\u2062 is crucial for Ohioans to weigh the potential consequences of passing this amendment and consider the \u2063broader implications \u200don public health, safety, and the \u200drights of individuals.
