\u2063Order<\/h2>\n<p>In a scathing new order, U.S. District Court Judge Aileen Cannon unequivocally \u200crejected a request by Jack Smith\u2019s prosecutors to deny access to defense attorneys in the classified documents case against former President Donald Trump\u2019s co-defendants.<\/p>\n<blockquote>\n<p>The Miami-based judge, who is a Trump appointee, described \u200dthe special counsel\u2019s efforts to restrict discovery to\u200d the legal defense team in the \u2064case to be based on a \u201cbroad and unconvincing theory\u201d and an \u201catextual\u201d and \u201calmost \u200cblithe\u201d interpretation of the statute in question: Ouch.<\/p>\n<\/blockquote>\n<p>This past summer, Smith\u2019s prosecutors <a href=\"https:\/\/www.justice.gov\/storage\/US-v-Trump-Nauta-De-Oliveira-23-80101.pdf\" target=\"_blank\" rel=\"noopener\">charged<\/a> \u2064Trump valet Walt Nauta and Mar-a-Lago property manager Carlos De \u200bOliveira with allegedly aiding Trump to unlawfully retain\u200b classified\u2064 documents at Mar-a-Lago.<\/p>\n<p>Cannon <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.202.0_1.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> Wednesday that the Office \u2062of Special Counsel\u2019s broad interpretation of the \u2062Classified Information Procedures Act did not align with \u2064the plain reading of the law.<\/p>\n<p>The\u2063 judge wrote that Smith\u2019s prosecutors \u200dwant to restrict Nauta and De Oliveira \u201calmost entirely from reviewing\u200b classified discovery to be \u2062produced in the case, \u200dand then placing the burden to justify otherwise on defense counsel.\u201d<\/p>\n<p>To \u2062justify their move,\u2062 Smith\u2019s team pointed to Section 3 of the CIPA law which states, \u201cUpon motion of the United States, the court shall issue an \u200border to \u200cprotect against the disclosure of any classified information disclosed by the United States to any defendant in any criminal case \u2064in a district court of the United States.\u201d<\/p>\n<p>However, Cannon held a simple reading of CIPA does not support the special counsel\u2019s position that the defendants\u2019 attorneys can be restricted across the board from reviewing the documents that would be pointed to at trial as proof that Nauta and De \u200dOliveira mishandled \u2063classified materials.<\/p>\n<p>The judge highlighted that the statute makes \u200da distinction between the defendants themselves and their lawyers.<\/p>\n<p>\u201cIn the OSC\u2019s view, even though Section 3 refers to \u2018defendant\u2019 \u2014 and \u200ceven though Congress elsewhere\u2064 in CIPA specifically referred to \u2018any attorney of the defendant\u2019 as distinct from \u2018the defendant,\u2019 see CIPA \u00a7 2 \u2014 the Court nevertheless must read the term \u2018the defendant\u2019 in Section 3 to mean \u2018attorney for the defendant\u2019 and then simultaneously interpret Section 3 to\u200c exclude \u2018the defendant\u2019 facing criminal indictment, at least in cases where the government proffers a basis to object to such disclosure pretrial,\u201d Cannon wrote.<\/p>\n<p>She labeled the special counsel\u2019s\u200b position, a \u201cbroad and atextual interpretation\u201d of the law.<\/p>\n<p>Cannon instructed the prosecutors if they wanted to restrict\u2063 the defense attorneys\u2019 access to classified\u2064 materials, \u2064they could do so on a document by document \u200bbasis, pointing to section 4 of CIPA.<\/p>\n<p>Section 4 reads, in \u200cpart, \u201cThe court, \u2018upon a sufficient \u200cshowing,\u2019 [may] authorize the United States to delete specified items of classified information from documents \u2064to be made available to the defendant through discovery.\u201d<\/p>\n<p>In other words <a href=\"https:\/\/www.westernjournal.com\/federal-judge-hits-trump-partial-gag-order-jack-smiths-request\/\" target=\"_blank\" rel=\"noopener\">Smith\u2019s lawyers<\/a> will have to go to Cannon and make the case each time why Nauta\u2019s and De Oliveira\u2019s lawyers should not have access to review the documents in question.<\/p>\n<p>Cannon reiterated, \u201cSo again, we are left with the OSC\u2019s broad and unconvincing\u2063 theory, which is \u200dthat the Court must change the meaning of the word \u2018defendant\u2019 to mean, essentially, \u2018defense attorney to the exclusion of defendant.\u2019 The Court declines \u2062to do so.\u201d<\/p>\n<p>The judge concluded, \u201cIn the end, whatever\u200d the contours of the\u2064 OSC\u2019s broad theory prohibiting a defendant\u2019s access to discoverable information, the answer is not to\u2063 change the\u2064 natural meaning of a statutory word in Section 3\u2064 but rather to use the mechanism provided in CIPA to handle matters related to restricting \u200ddiscovery, which in the case of CIPA is Section 4.\u201d<\/p>\n<p>On a related note, Cannon hinted\u200d Wednesday she is considering delaying Trump\u2019s May 20 trial in the documents case, <a href=\"https:\/\/www.politico.com\/news\/2023\/11\/01\/trump-judge-classified-documents-trial-delay-00124887\" target=\"_blank\" rel=\"noopener\">Politico<\/a> reported.<\/p>\n<p>\u201cI\u2019m just having a hard time \u2063seeing how realistically this work can be accomplished in this compressed period of time, given the realities that we\u2019re facing,\u201d she said during the hearing.<\/p>\n<p>Trump\u2019s legal \u2062team wants the trial \u2063 <a href=\"https:\/\/www.westernjournal.com\/judge-trump-documents-case-rejects-special-counsels-plea\/\" target=\"_blank\" rel=\"noopener\">delayed<\/a> until after next year\u2019s election.<\/p>\n<p>\u201cProceeding to trial during the pendency of a Presidential election cycle wherein opposing candidates are effectively (if not literally) \u2064directly adverse\u2064 to one another in this action will <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-rundown-zelensky-demands-nato-entry-oregon-countys-drug-kit-plan-halted-and-more\/\" title=\"Zelensky Some Change,\u2019 Something \u2018We Got To Do\u2019\">jury selection process<\/a> and limit the Defendants\u2019 ability to secure a fair and impartial adjudication,\u201d the lawyers wrote in a July <a href=\"https:\/\/www.documentcloud.org\/documents\/23870430-trumptrialskedflg071023\" target=\"_blank\" rel=\"noopener\">court filing<\/a>.<\/p>\n<p>On Wednesday, \u2063Trump\u2019s attorneys told Cannon that preparing for the special counsel\u2019s election interference case, scheduled to begin in Washington, D.C., in <a href=\"https:\/\/www.cbsnews.com\/news\/trump-dc-trial-date-to-be-scheduled-judge\/\" target=\"_blank\" rel=\"noopener\">March<\/a>, would get in the way of preparing for the\u200d documents case in May.<\/p>\n<p>The election interference trial could go on \u2064for months, the\u200b lawyers argued, bumping right into the \u200ddocuments case in\u2063 May, if the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mar-a-lago-judge-repeatedly-smacks-down-jack-smith-in-scathing-new-order\/\" title=\"Mar-a-Lago Judge Slams Jack Smith in Brutal New Ruling\">current start date stands<\/a>.<\/p>\n<p>Altogether, Trump is facing <a href=\"https:\/\/www.westernjournal.com\/going-convictions-donald-trump-election-alan-dershowitz-says\/\" target=\"_blank\" rel=\"noopener\">91 felony indictments<\/a> \u200dbrought by Democratic prosecutors in New York\u200c City; Fulton County, Georgia;\u200b and of course Smith\u2019s documents and election interference cases.<\/p>\n<p>The Democrats are\u200b brazen in their efforts to interfere in the 2024 election by keeping <a href=\"https:\/\/www.westernjournal.com\/trump-stands-judge-going-kids-leave-children-alone\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> in the courtroom and off the campaign trail, not to mention depleting his funds to \u2064pay the millions of dollars in legal bills.<\/p>\n<p>It\u2019s \u2064a despicable and unprecedented time in \u200dU.S. presidential election history.<\/p>\n<p>Hopefully, the American people \u200dsee through\u200c the Democrats\u2019\u2062 scheme\u200c and return Trump to the White House.<\/p>\n<p>Then he should be able to get all the federal charges dropped and <a href=\"https:\/\/www.westernjournal.com\/levin-takes-counterview-trump-power-potus-pardon-state-charges\/\" target=\"_blank\" rel=\"noopener\">perhaps<\/a> the state
