Elections<\/h2>\n<p>Lawsuits challenging post-2020 Census congressional \u200bmaps could\u2064 see as many as 18 House incumbents\u2063 across a \u200cdozen states\u2014including\u200c up to 14 Republicans\u2014campaigning in 2024 in districts different than those they\u2062 won in 2022.<\/p>\n<p>Most were filed by Democrats and received a boost in June \u200d2023 when the United States Supreme Court \u200cruled Alabama\u2019s Republican-led Legislature redistricting plan disadvantaged black voters and violated the 1965 Voting Rights Act.<\/p>\n<div class=\"my-5\">\n<h3>Challenges Underway<\/h3>\n<p>A dozen similar <a href=\"https:\/\/www.theepochtimes.com\/us\/in-depth-federal-state-lawsuits-seek-constitutional-clarity-on-racial-gerrymanders-5487404\" target=\"_blank\" rel=\"noopener\">challenges underway<\/a> in state and federal courts \u2062across the \u200ccountry could result in redrawn Congressional \u2063districts before 2024\u2019s election, including <a Lawsuit May Result in GOP Losing Six House Seats\">special-master drawn congressional\u200c map<\/a>\u200d that saw GOP candidates gain four \u200bseats in 2022, turning Democrats\u2019 19\u20138 New York House bulge\u2063 into a competitive 15\u201311 contingent.<\/p>\n<div class=\"my-5\">\n<h2>Math Favors Democrats<\/h2>\n<p>Those four to six New \u200dYork seats are, \u200cpotentially, among \u2064as many\u2063 as \u200b14 GOP House incumbents who \u2062could see court \u2062rulings alter their 2022-won districts \u200cbefore\u200b 2024 elections.<\/p>\n<\/p><\/div>\n<p>In addition \u2064to\u2064 the\u2064 U.S. Supreme Court\u2019s Alabama ruling and pending South Carolina\u200d decision, if plaintiffs win \u200clawsuits in Florida, Georgia, Kentucky, and \u200dLouisiana, \u200das\u2064 many as 10 to 14 Republican-held congressional districts could be redrawn \u200cbefore \u200cnext November to benefit Democrats.<\/p>\n<p>The only 2024-pertinent legal action where Republicans could gain or retain \u200dseats for\u200b the next election is the Hoffman appeal \u2063in\u2062 New York, although the GOP is poised to gain as many\u200c as three North \u2063Carolina congressional seats following \u200d2023 \u2064redistricting.<\/p>\n<p>After the North Carolina Supreme Court rejected the state\u2019s 2022 maps, the GOP-dominant North Carolina \u2063state Legislature redrew a\u200b map analysts say imperils three\u2062 House\u200c Democrats\u2062 and could turn the state\u2019s 7\u20137 Congressional delegation into a 10\u20134 GOP-dominated contingent.<\/p>\n<p>The\u200c map has spurred legal challenges, but after Republicans flipped\u2062 North Carolina\u2019s Supreme Court in 2022, \u200cand the new Court \u200dpromptly undid the map crafted \u200dby its \u200dDemocrat-majority predecessor, state challenges are unlikely to \u200cprevail \u2062while \u2063accompanying federal suits are unlikely to be heard before 2024\u2019s\u200d elections.<\/p>\n<p>New Mexico\u2019s state GOP committee appeal of a state \u200ccourt reaffirmation of that state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pelosi-who-claims-to-oppose-gerrymandering-funnels-300000-to-democratic-gerrymandering-group\/\" title=\"Pelosi, Who Claims to Oppose Gerrymandering, Funnels 0,000 to Democratic Gerrymandering Group\">congressional maps<\/a> was denied in October, \u2064the only other\u2063 legal action \u200bthat could\u200b have benefited Republican House candidates.<\/p>\n<div class=\"my-5\">\n<h2>GOP \u2064in New York State of Bind<\/h2>\n<p>Post-Census redistricting is the responsibility of\u200c the New \u200bYork\u200b State\u2062 Independent\u200d Redistricting Commission (IRC). In early 2022, the bipartisan panel drafted two\u2064 maps but \u200dfailed to reach a\u200b consensus on which one to\u2063 endorse.<\/p>\n<\/p><\/div>\n<p>As a\u2063 result, state lawmakers stepped in. The Democrat-dominated General Assembly \u200bdevised a map that handicapped at least half\u2063 the state\u2019s House Republicans that Democrat\u200c Gov.\u200b Kathy\u200d Hochul subsequently \u200dapproved in March 2022.<\/p>\n<p>The General Assembly\u2019s map immediately drew a battery of lawsuits with\u2063 mostly Republican plaintiffs arguing \u200cthe \u200b\u201cHochul-mandering\u201d violated federal and state laws.<\/p>\n<div class=\"my-5\">\n<p>In April 2022, the\u2062 State Court of\u200d Appeals upheld those arguments in <a href=\"https:\/\/thearp.org\/litigation\/harkenrider-v-hochul\/\" target=\"_blank\" rel=\"noopener\">Harkenrider v. Hochul<\/a> and <a href=\"https:\/\/thearp.org\/litigation\/nichols-v-hochul\/\" target=\"_blank\" rel=\"noopener\">Nichols v.\u2064 Hochul<\/a> in a 4\u20133 \u200cruling penned by then-Chief Judge Janet \u200dDiFiore, who determined \u201cjudicial \u2062oversight is required\u200c to facilitate the expeditious creation of constitutionally conforming maps for use in the 2022 elections.\u201d<\/p>\n<\/p><\/div>\n<p>Her ruling ordered court-appointed \u200dspecial master Jonathan\u200b Cervas to redraw the map. During the ensuing 2022 midterm elections, Republicans\u200c gained four seats, turning what had been a\u200b 21\u20136\u2062 Democrat-dominated House\u2064 delegation \u200cin 2018 into a 15\u201311 contingent in 2022.<\/p>\n<p>The Democratic Congressional \u2062Campaign Committee filed a June 2022 lawsuit, Hoffman, \u200cinsisting the\u200b 2022 districts drawn by Mr. Cervas are only temporary and must be\u2064 redrafted by the IRC and signed into law by the governor.<\/p>\n<p>On July \u206313, 2023, \u200ban Albany\u2063 appellate court\u2064 agreed with Hoffman plaintiffs in\u200d a 3\u20132 ruling and\u200c ordered the \u200bIRC to redraw the state\u2019s congressional map.<\/p>\n<div class=\"my-5\">\n<p>\u201cThe\u2064 procedures governing the redistricting process, \u200ball too easily\u2064 abused by those who would seek to\u200b minimize the voters\u2019 \u200bvoice and entrench \u200dthemselves in the \u200bseats of power, must be guarded as jealously as the right to vote itself;\u200d in granting this \u200cpetition, we return\u2062 the matter\u2064 to \u2063its constitutional design,\u201d judges wrote in their <a href=\"https:\/\/decisions.courts.state.ny.us\/ad3\/Decisions\/2023\/CV-22-2265.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a>.<\/p>\n<\/p><\/div>\n<p>The ruling was applauded by Democrats.<\/p>\n<div class=\"my-5\">\n<h2>Appeal and Future Redistricting<\/h2>\n<p>Republican intervenors appealed the July 13\u200b decision within two weeks. On Sept. \u200d19, New York\u2019s \u200dCourt of Appeals\u2064 agreed \u2064to stay the IRC order until \u200dthe appeal is heard.<\/p>\n<\/p><\/div>\n<p>The appeal insists\u2063 Hoffman comes too late after post-Census redistricting. Under the state\u2019s Constitution, Republicans say, mid-decade redistricting is prohibited \u201cunless\u2064 to\u2064 remedy a violation of law.\u201d<\/p>\n<p>Petitioners\u200c argue the Court of Appeals\u2019\u200d April 2022 Harkenrider\/Nichols \u2062rulings \u200d\u201cremedied the violation in law,\u201d meaning \u201cthere\u2019s no \u200bcase.\u201d<\/p>\n<p>If the appeal fails, the\u200b IRC will get another chance to draw congressional\u2064 maps, although lawmakers can amend it before sending it to the governor\u2019s \u200ddesk.
