There is one set up in Miami but not in Fort Pierce, where the \u2062court and case reside.<\/p>\n<p>So far, the government has provided 1.3 million pages of \u2062unclassified materials, 3,500 pages of\u2064 classified material,\u200d and about 10 years&#8217; worth of security footage.<\/p>\n<p>Defense attorneys\u200c argued that they have\u200d not finished going through this volume of evidence and will still need\u2062 to compel further discovery from the prosecution after an adequate review. The original deadline \u200dto file motions to compel was Oct. 20, which prompted the request for an extension.<\/p>\n<p>They noted as an example that the files given to them included 60 \u200bterabytes of CCTV footage, which were\u200d sorted into zipped folders, and \u2064one of the folders had taken over 24 hours to unzip. Things like this added up to \u2064delay\u200d the defense&#8217;s access to review\u2064 materials, they argued.<\/p>\n<p>A total of 5,500 pages of classified documents\u200d with accompanying discs that hold audio recordings of transcripts included in those pages,\u200d as well as more than 3 gigabytes of emails.<\/p>\n<p>Prosecutors argued that the CCTV footage amounts to 5 \u200dyears rather than 10 years and directed the defense to only look at what they argued was &#8220;relevant&#8221; and the key dates of the \u200ccase.<\/p>\n<p>Mr. Blanche added that the material has been extraordinarily dense, and they expect to file motions\u200c to compel more evidence after they have digested all of it.<\/p>\n<div class=\"my-5\">\n<p>The judge\u2064 asked how long it\u200c would take to \u200ccomplete \u200da motion to compel without review of classified documents, and Mr. Blanche\u200c estimated two weeks, with a week for the special counsel&#8217;s office to respond.<\/p>\n<h2>Clearance<\/h2>\n<p>Further delaying\u2062 matters is \u2063that\u200b not all parties have had the clearance to review materials when they were made available.<\/p>\n<\/div>\n<p>Mr. De Oliveira&#8217;s attorney John Irving got clearance to review classified materials on Oct. 11, and his local \u200cattorney Larry Murrell got clearance the same day as the hearing, on Nov. 1.<\/p>\n<p>Mr. Nauta&#8217;s attorney, Stanley Woodward, said he has not yet been given\u2063 clearance and so has not had \u200bthe opportunity to enter the SCIF to review materials and discuss them with his client.<\/p>\n<div class=\"my-5\">\n<p>Earlier on Nov. 1, the judge had rejected the prosecutors&#8217; motion for a blanket order that would prevent \u200bMr.\u200c De Oliveira and Mr. Nauta from viewing classified documents and allow only their attorneys. Judge \u2062Cannon wrote in an opinion\u200b accompanying the order that the\u2064 prosecutors&#8217; interpretation of\u200c statutes was \u200dwithout merit and rejected their reading of &#8220;defendants&#8221; to mean only defendants&#8217; attorneys and not the defendants themselves.<\/p>\n<h2>Multiple Trials<\/h2>\n<p>The trial for the classified \u200bdocuments case\u2063 was originally scheduled to begin in May 2024.<\/p>\n<\/div>\n<p>President Trump is facing\u200c four criminal trials; one \u200cin New \u2063York is scheduled\u2064 for \u200cMarch 25, 2024, and another federal case \u200din Washington is set for\u200d March 4, 2024. Yet another state criminal case in Georgia has \u200dnot had a trial schedule set yet.<\/p>\n<p>Attorneys Mr. Blanche and Chris Kise argued for President Trump at the Nov. 1 hearing, and both of these attorneys are representing President Trump in other cases. Mr. Kise \u200bhas been\u200c attending a civil trial \u2062in New York, in which President Trump is scheduled to testify on Nov. 6, and\u2064 called in to the Florida hearing.<\/p>\n<p>Mr. Blanche is representing\u2063 President Trump in the case in Washington, also prosecuted by Mr. Smith&#8217;s office. He estimated this case\u2062 would take two and a half months, with two weeks for President Trump to present his side.<\/p>\n<p>He argued that the special counsel&#8217;s office made their schedule for a March 2024 trial date in the other case despite knowing the schedule for this \u200bcase, and as it stands, President Trump could be facing three trials in as many months.<\/p>\n<p>Prosecutors \u200bargued that it \u200bwas President\u2064 Trump&#8217;s \u2062own decision to choose to have the same attorney on multiple cases and\u200d showed little sympathy for what Mr. Kise described as an &#8220;extraordinarily challenging&#8221; effort to work\u200c on several overlapping cases. They said it was not surprising\u200b they were trying \u200cto move the trial\u200b until after the 2024 elections, but the other federal\u200b trial should not affect this schedule.<\/p>\n<p>Judge Cannon ended the hearing by \u2062saying she would assess all the information and announce any changes to the schedule, if they are made, as\u2064 soon as possible.<\/p>\n<\/div>\n<p> <\/p>\n<h2> Why\u2062 did the defense attorneys raise concerns about the potential overlap\u200d of this case with other criminal cases involving President Trump?<\/h2>\n<p><span>  Nying her order, \u200b&#8221;The \u200cCourt finds that \u200bit would be prejudicial to the defendants&#8217; right to assist their attorneys in reviewing and \u200cdiscussing the classified materials, and to meaningfully participate in their own defense, to exclude \u2062them from the review process.&#8221;<\/p>\n<h2>Overlap\u2060<\/h2>\n<p>The defense attorneys also raised concerns about the \u200bpotential overlap of this case with other criminal cases involving President Trump.<\/p>\n<p>Blanche argued that\u2064 if President Trump is indicted on \u200bother\u200d charges, it may affect the \u200dscheduling and resources available for this case.<\/p>\n<p>He mentioned specifically the ongoing\u200d civil fraud trial in New\u2062 York that is\u200c set to \u200dcontinue on Nov. 1. Blanche \u2064noted that President Trump&#8217;s trial in New York is expected to last at \u200dleast three weeks and\u200c could \u200dpotentially impact\u200b the\u2064 availability of his \u200blegal team for the case in\u200c Fort Pierce.<\/p>\n<p>Given these concerns, the defense requested an extension of the current\u200d trial date to allow for a more \u200cthorough review of the evidence \u200dand to\u200b account for any potential overlap with\u200b President Trump&#8217;s other \u200ccases.<\/p>\n<h2>Ruling<\/h2>\n<p>Judge Cannon stated that she \u200dunderstood the magnitude and complexity of the case and recognized that additional \u200dtime might be needed to ensure a fair trial.<\/p>\n<p>She ordered the government to provide a timeline of when \u200cit expects to complete the production of evidence.
