There is one set \u2064up in Miami but not in \u200bFort Pierce, where the court and case reside.<\/p>\n<p>So far, the government has provided 1.3 million\u2063 pages of unclassified materials, \u200d3,500 pages of classified material, and about 10 years&#8217; worth of\u200d security footage.<\/p>\n<p>Defense\u2063 attorneys \u2064argued that they have not finished going through this volume of\u200c evidence and\u200d will still need to\u2063 compel further discovery from the prosecution after an adequate review. The original deadline to file\u2063 motions to compel was Oct. 20,\u2063 which prompted \u200cthe \u200drequest for an \u2063extension.<\/p>\n<p>They noted\u200c as an \u200dexample\u2062 that \u2062the files \u200bgiven to them \u200cincluded 60\u200c terabytes of CCTV footage, which were sorted\u2064 into\u2062 zipped folders, and one\u2062 of the folders had taken over \u206424 hours to \u2064unzip. Things like this added up to\u200c delay the \u200ddefense&#8217;s access to\u200c review \u200bmaterials, they argued.<\/p>\n<p>A total of 5,500 pages of classified documents \u2063with accompanying discs that\u200c hold audio recordings of transcripts included in\u200d those pages, as well\u200c as \u2062more than 3 gigabytes of emails.<\/p>\n<p>Prosecutors argued that the CCTV\u200c footage amounts\u2063 to\u2062 5 years rather than 10 years and directed the defense \u200bto only look at what they argued was &#8220;relevant&#8221; and the key dates\u2062 of the case.<\/p>\n<p>Mr. Blanche\u200d added that the material has been extraordinarily dense, and they expect\u2063 to file \u200bmotions to compel more evidence after they \u2062have digested all of it.<\/p>\n<div class=\"my-5\">\n<p>The judge asked how long it \u200cwould take to complete\u2063 a motion to compel \u200dwithout review of classified documents, and Mr. Blanche estimated two weeks,\u200b with a week for\u2064 the special counsel&#8217;s office to \u200crespond.<\/p>\n<h2>Clearance<\/h2>\n<p>Further delaying matters is\u200c that not all parties\u200b have had\u200d the clearance to review materials when they were made available.<\/p>\n<\/div>\n<p>Mr. De\u2062 Oliveira&#8217;s \u2062attorney John Irving got \u2062clearance\u2064 to review classified materials on Oct. 11, and his local\u2064 attorney Larry Murrell got\u200d clearance the same day as the hearing, on Nov. 1.<\/p>\n<p>Mr. Nauta&#8217;s attorney, Stanley Woodward, said\u2063 he\u200b has not \u200byet \u2064been given clearance and so has not \u2063had the opportunity to \u200benter\u2062 the SCIF to review materials and\u2062 discuss them with his client.<\/p>\n<div class=\"my-5\">\n<p>Earlier on Nov. 1, the judge had rejected the prosecutors&#8217; motion for a blanket \u2062order that would prevent Mr. De Oliveira and Mr. Nauta from viewing classified documents and allow only their \u200battorneys. Judge\u200b Cannon wrote\u200b in an opinion accompanying the order\u2064 that the prosecutors&#8217; \u2063interpretation of statutes\u2062 was without merit and rejected \u200btheir reading of &#8220;defendants&#8221; to mean only defendants&#8217; attorneys and not the\u2062 defendants themselves.<\/p>\n<h2>Multiple \u200bTrials<\/h2>\n<p>The trial for the classified documents case was originally \u2063scheduled to begin in May \u20622024.<\/p>\n<\/div>\n<p>President \u2062Trump is facing four criminal trials; one in New York is scheduled \u200bfor \u2063March 25, 2024, and another federal case \u2062in\u2062 Washington\u200b is set for March 4, 2024. Yet\u200d another state criminal case in Georgia has not had\u200d a trial schedule set yet.<\/p>\n<p>Attorneys Mr. Blanche\u2062 and Chris \u2064Kise argued for President Trump at the Nov.\u200b 1 hearing, and \u200dboth of these attorneys are\u200d representing \u2064President\u200b Trump in\u200d other cases. Mr. Kise has been attending a civil trial \u2064in New York, in \u200cwhich \u2062President Trump is scheduled\u2063 to testify on Nov. 6, and called in\u2064 to \u200dthe Florida hearing.<\/p>\n<p>Mr. Blanche is representing President Trump in\u2064 the case in Washington, \u200dalso prosecuted by Mr. Smith&#8217;s office. He estimated this case would take two and a half months, with \u200btwo weeks for\u200b President Trump\u200b to \u200dpresent his side.<\/p>\n<p>He argued that the special counsel&#8217;s\u200c office\u200c made their schedule for a\u200c March 2024 trial \u2064date in the other case despite knowing the schedule for this case, and as it\u200b stands, President\u2062 Trump could be facing three trials in as many months.<\/p>\n<p>Prosecutors argued that it \u2063was President Trump&#8217;s own decision \u2063to \u200cchoose \u200bto have the same attorney \u2064on multiple \u2062cases \u2063and showed\u2064 little sympathy\u2062 for what \u2064Mr. Kise described as an &#8220;extraordinarily challenging&#8221; effort to work on several overlapping cases. They said it was not surprising \u200dthey were \u200btrying to move\u200b the trial until after the 2024 elections, but the other federal \u200dtrial should not \u200caffect this schedule.<\/p>\n<p>Judge Cannon \u200dended the hearing by saying she would \u200dassess all the information and announce any changes to\u200c the \u200dschedule, if they are made, as \u200dsoon as\u200b possible.<\/p>\n<\/div>\n<p> <\/p>\n<h2> What concerns were raised \u200cregarding\u200d the security clearances for the\u2064 defense attorneys and their clients, and how does it affect the fairness and efficiency of the legal \u200cprocess<\/h2>\n<p><span>  \u200cCutors had \u2062failed to prove that allowing the defendants to view the classified documents\u2062 would pose a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-considering-not-giving-trump-intelligence-briefings\/\" title=\"Biden Considering Not Giving Trump Intelligence Briefings\">national security risk<\/a>. Therefore, she granted Mr. De Oliveira\u2064 and Mr. Nauta access to \u2064the\u200d materials, provided they obtain \u2064the necessary \u2062security clearance.<\/p>\n<p>In light of the ongoing\u200b discovery process and the need for the defense to \u200creview the vast amount of evidence, both parties\u200b requested an extension of \u2063the trial date.\u200b Mr. Blanche\u2062 argued that \u200cthe original trial date was set before the full extent of the evidence was known, and since then, new evidence has \u2063emerged \u200dthat could significantly impact the case. Additionally, he stated that the defense needs \u2062more\u2062 time to complete their review of the\u2063 materials and potentially seek further discovery from the prosecution.<\/p>\n<p>The \u200cprosecution countered by stating \u2063that the defense should only focus on what they \u200bdeem &#8220;relevant&#8221; and the key dates of the case, rather than reviewing all the provided evidence.\u200c They argued\u2064 that the \u200bdefense&#8217;s request for an extension is \u200cunnecessary and could unduly prolong the proceedings.<\/p>\n<p>The judge acknowledged the volume of evidence and\u200c the complexity of the \u200bcase.
