Under Florida law,\u200b state residents are mandated to provide <em>either<\/em> an original \u2063signature or a digital signature that the Department of Highway Safety transmitted when registering to\u2064 vote. As noted by\u2064 the court, the signature signifies \u2064an affirmation\u2062 by each registrant that the information he or she\u2062 provided is factually correct.<\/p>\n<p>Defendants in the case included Florida Secretary of State Cord Byrd \u2063and Florida\u2019s 67 supervisors of elections. Meanwhile, the Republican National\u200d Committee and Pasco County GOP intervened\u2064 on behalf of said \u200ddefendants and RITE PAC, an\u200b election integrity group, <a href=\"https:\/\/riteusa.org\/in-florida-rite-pac-is-fighting-against-a-federal-takeover-of-honest-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">submitted<\/a> a brief pushing back against\u2062 a filing from the Biden Department of Justice.<\/p>\n<p>As \u2063The Federalist previously <a href=\"https:\/\/thefederalist.com\/2023\/08\/22\/thought-indicting-trump-was-the-only-way-the-doj-interferes-in-elections-think-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the DOJ <a href=\"https:\/\/www.politico.com\/newsletters\/florida-playbook\/2023\/07\/12\/department-of-justice-jumps-into-fl-voting-case-00105819\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> a \u201cstatement of interest\u201d earlier this year urging the court \u2063to dismiss the \u200cinterveners\u2019 \u2062motion to\u200c dismiss.<\/p>\n<p>In his Monday \u200cruling, Winsor specifically noted how the plaintiffs \u2014 \u200dwhich included <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-of-taxpayer-funded-antiracist-group-funneled-nearly-300k-to-husbands-law-firm\/\" title=\"President of Taxpayer-Funded Antiracist Group Funneled Nearly 0K to Husband\u2019s Law Firm\">left-wing organizations<\/a> such as Vote.org and the NAACP \u2014 failed to provide evidence \u201cshowing that the wet-signature requirement \u200dis immaterial.\u201d<\/p>\n<p>\u201cPlaintiffs\u2019\u2063 entire premise is that a copied, faxed, or otherwise non-original signature is equal in stature to an original, wet signature. But we know this not to be so,\u201d Winsor wrote. \u201cIt is true that times are changing and that electronic signatures are acceptable in situations they once were not. \u2026 But the acceptance of electronic signatures in certain circumstances does not render the wet signature \u200drequirement immaterial in this circumstance.\u201d<\/p>\n<p>At the center of Democrats\u2019\u200b arguments is the <a href=\"https:\/\/flvoicenews.com\/judge-dismisses-case-against-florida-over-voter-registration-process-signature-requirement\/\" target=\"_blank\" rel=\"noreferrer noopener\">false claim<\/a> that the \u201cwet\u201d signature requirement violated\u200b the \u2063\u201cmateriality provision\u201d of the 1964 Civil Rights Act and, therefore, disenfranchised voters. As noted by the\u200d court, Congress\u2064 originally enacted \u2064that provision to \u200ccombat barriers (e.g., literacy tests) instituted by state and local governments to \u2062disenfranchise potential black voters.
