Dave Min,\u200b a Democrat representing parts of Orange County. \u2062The\u200d first, Senate Bill 264, bans the\u2063 sale of firearms or ammunition \u2062on\u2063 Orange County Fairgrounds. Judge Holcomb, however, said those regulations are \u2062going too far.<\/p>\n<p>&#8220;Even \u2062if \u2063the Court were to conclude that banning lawful firearm sales \u200dat the \u200bOrange County Fairgrounds directly advances California&#8217;s\u200b interest in \u2063stopping illegal weapon\u2064 sales, the regulation would still be more extensive \u200cthan is necessary to serve that interest,&#8221; wrote Judge\u2063 Holcomb, who was\u2064 appointed by President Donald Trump.<\/p>\n<div class=\"my-5\">\n<p>&#8220;California&#8217;s interest \u2064in\u2064 stopping\u2064 crimes committed with illegal weapons, &#8216;as important as it is, cannot justify&#8217; prohibiting the complete sale of\u200b lawful firearms at \u200bgun shows, especially when those same firearms are available for purchase at regular\u2062 gun stores,&#8221; he continued, quoting from the 1980 U.S. Supreme Court ruling in Central Hudson Gas\u2063 &#038; \u2062Electric \u2063Corp. v.\u2062 Public \u200dService \u200dCommission.\u200d &#8220;In fact, the firearms \u2062purchased at gun shows \u2062must \u2064be retrieved at brick-and-mortar gun stores.&#8221;<\/p>\n<h2>Supreme Court Ruling on Guns<\/h2>\n<p>In a landmark Second Amendment ruling in June 2022, Supreme Court Justice Clarence Thomas wrote that gun laws can only\u2062 be\u2063 deemed constitutional \u200cwhen they \u2064are &#8220;consistent with this Nation&#8217;s historical tradition.&#8221;\u200c Citing this\u200b legal standard, Judge Holcomb said that California failed to show evidence that the two challenged laws have any parallel from the time\u200c of the Second\u200b Amendment&#8217;s framing.<\/p>\n<\/div>\n<p>&#8220;No law that Defendants cite\u200b permitted\u200b the \u200bstate arbitrarily to ban firearm sales in disfavored forums,\u2063 nor did those laws discriminate\u200b between\u2063 gun vendors based upon\u200d whether the sales took place on\u2064 public or private land,&#8221; he wrote.<\/p>\n<p>In\u2063 their complaint, the\u2063 plaintiffs challenged the California laws on both First and Second Amendment grounds,\u200b claiming that the state has engaged in viewpoint discrimination against gun owners.<\/p>\n<p>Specifically, they argued that a gun\u200b show is more than just\u200b a place where people trade guns, but also \u2063a \u200dpublic forum that\u200b allows gun owners to meet and discuss\u2063 topics\u2063 such\u200b as\u200b hunting, target practice, \u200bgunsmithing, and political \u200badvocacy.
