In the footnote, Chutkan refused a prosecution request\u2063 to make the \u200dformer president\u2019s freedom contingent on his following the strictures of \u2064the <a href=\"https:\/\/www.westernjournal.com\/turley-savages-jack-smith-lays-truth-narrowly-tailored-gag-order\/\" target=\"_blank\" rel=\"noopener\">gag order<\/a>.<\/p>\n<p>\u201cThe government also asks the court to incorporate the Order into Defendant\u2019s conditions of release \u2026,\u201d she wrote\u200d in the first footnote of <a href=\"https:\/\/s3.documentcloud.org\/documents\/24097512\/chutkan-reimposes-trump-gag-order-in-2020-election-subversion-case.pdf\" target=\"_blank\" rel=\"noopener\">the \u2064ruling<\/a>. \u201cEven assuming that request is \u2064procedurally\u2063 proper, the court concludes that granting it is not necessary to effectively enforce the\u200d Order at this time.\u201d<\/p>\n<p>Still, Chutkan reinstated the gag order\u200c \u2014 requested by special counsel Jack Smith last month \u2014 after a temporary hold. Smith had argued that Trump\u2019s comments about the charges and\u200b the \u2063personalities involved in the case could intimidate witnesses and interfere \u2062with the prosecution.<\/p>\n<p>Chutkan wrote that\u200b \u201cthe \u200cright to a fair trial is\u200b not [Trump\u2019s] alone, but belongs also to the government and \u200cthe public.\u201d<\/p>\n<p>Now,\u200b the gag order itself \u200cis a farce, particularly in \u2062the middle of an \u200celection process in which the government is both prosecuting and silencing the Biden administration\u2019s main political \u2063opponent.<\/p>\n<p>Thankfully, <a href=\"https:\/\/www.westernjournal.com\/trump-responds-gop-candidate-respected-drops-goes-45\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> doesn\u2019t \u2063seem to particularly <em>care<\/em>, since <a href=\"https:\/\/www.newsweek.com\/donald-trump-2020-election-case-gag-order-bill-barr-truth-social-1838937\" target=\"_blank\" rel=\"noopener\">Newsweek<\/a> noted that \u201cjust 75 minutes after Chutkan gave notice that the order had been reinstated, Trump appeared to violate it by attacking his former attorney general and a potential witness, William P. Barr.\u201d<\/p>\n<p>That attack came not \u2063to silence any testimony <a href=\"https:\/\/www.westernjournal.com\/huckabee-bill-barr-drops-bombshell-democrats-try-dismiss-biden-bribery-scandal\/\" target=\"_blank\" rel=\"noopener\">Barr<\/a> may give in \u2063the trial, mind you, but was a response to the former attorney general criticizing \u2062Trump\u2019s speaking \u2062skills.<\/p>\n<p>\u201cHis verbal skills are limited,\u201d Barr\u2062 said during a speech at\u200c the University of Chicago on Friday, as <a href=\"https:\/\/thehill.com\/homenews\/4280503-bill-barr-knocks-trump-for-having-verbal-skills-that-are-limited\/\" target=\"_blank\" rel=\"noopener\">The \u2063Hill<\/a> reported.<\/p>\n<p>\u201cIf you get him away from \u2018very, very, very\u2019 \u2026 you know, the adjectives \u2026 they\u2019re unfamiliar \u2064to him and they sort of spill out, \u200cand he goes too far,\u201d \u200cBarr said. \u201cHe\u2019s\u2063 not very disciplined when it comes to what he says.\u201d<\/p>\n<p>Well, Trump fired up his <a href=\"https:\/\/www.westernjournal.com\/trump-posts-epic-welcome-biden-joining-truth-social-congratulations-joe\/\" target=\"_blank\" rel=\"noopener\">Truth Social<\/a> account and laid into the former attorney\u200c general.<\/p>\n<p>\u201cI called Bill Barr\u200c Dumb, Weak, Slow Moving, Lethargic, Gutless, \u2062and Lazy,\u2064 a RINO WHO COULDN\u2019T DO THE JOB,\u201d Trump wrote in the post.<\/p>\n<p>\u201cSo now this Moron says about me, to get even, \u2018his verbal skills are limited,&#8217;\u201d he continued.<\/p>\n<p>\u201cWell,\u200d that\u2019s one I haven\u2019t heard before. Tell that to the biggest political crowds in the history of politics, by far. Bill Barr is a LOSER!\u201d<\/p>\n<p>Well, cue liberal outrage. Here\u2019s \u2063prolific, witless social media polluter <a href=\"https:\/\/www.westernjournal.com\/fact-check-no-tucker-carlson-not-tell-men-tan-testicles-words-prove\/\" target=\"_blank\" rel=\"noopener\">Ron Filipkowski<\/a>, editor of the liberal website <a href=\"https:\/\/www.meidastouch.com\/\" target=\"_blank\" rel=\"noopener\">Meidas Touch<\/a>,\u00a0alleging that the post\u200d violates the gag order:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Since Bill Barr is \u2064a witness against Trump in the J6 case, this new post violates his gag order in\u2062 DC. <a href=\"https:\/\/t.co\/9q4MwM0fNP\">pic.twitter.com\/9q4MwM0fNP<\/a><\/p>\n<p>\u2014 Ron\u200d Filipkowski (@RonFilipkowski) <a href=\"https:\/\/twitter.com\/RonFilipkowski\/status\/1718790244407902556?\">October\u200c 30, 2023<\/a><\/p><\/blockquote>\n<p>This is likely true, but it\u2019s also exactly what\u2019s \u200dwrong with\u2062 the gag order in the first place.<\/p>\n<p>All of the court cases against the former\u2062 president that just \u200bso happened to come together \u2062right as \u2063the presidential campaign season geared \u2064up \u2014 what a coincidence! \u2014 put us in terra nova as\u2064 a republic.\u200d However, out of all of \u200cthese, \u200dthe Jan. 6 case presents the thorniest one, \u2064because it involves political \u2062speech that\u200b will play a critical part in the 2024 campaign \u2062if\u200c Trump wins the\u2062 <a href=\"https:\/\/www.westernjournal.com\/major-republican-donors-circling-back-supporting-trump-want-win\/\" target=\"_blank\" rel=\"noopener\">Republican nominee<\/a>.<\/p>\n<p>Virtually anyone involved in this case in the most \u200btangential manner can say the most vicious calumnies about Trump and what happened during the Capitol incursion \u2014\u200b or \u2063otherwise, as Bill Barr \u200dproved by calling a man given to two<a title=\"Judge denies DOJ's bid to imprison Trump.\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-shoots-down-dojs-request-to-have-trump-jailed\/\">-hour extemporaneous stump speeches verbally \u201climited<\/a>.\u201d<\/p>\n<p>Trump, however?\u2062 He\u2019s\u200d expected to shut his trap\u200d by order of the court.<\/p>\n<p>And \u200cif \u200bhe doesn\u2019t, there are more\u200c than a few\u2064 Democrats who want him \u2062in jail.<\/p>\n<p>There are plenty of reasons to be suspicious of <a href=\"https:\/\/www.westernjournal.com\/ap-trump-moves-judge-chutkan-seeks-off-case-good\/\" target=\"_blank\" rel=\"noopener\">Judge\u200c Chutkan<\/a>, but blocking\u2063 the DOJ from sending Trump \u200dto jail for violating a preposterous, un-American gag order isn\u2019t one of them.<\/p>\n<p>Three \u200dcheers aren\u2019t\u200c in order, but maybe a quarter of a halfhearted cheer is called for.<\/p>\n<p>For all her faults, Chutkan made sure on Sunday that we didn\u2019t slip further into banana republic territory \u2014 no matter \u200dhow much her leftist cohort wants to see the former president in prison.<\/p>\n<p>It\u2019s worth noting, though, that the footnote ends with \u201cat this time.\u201d<\/p>\n<p>So, time will tell.
