And, surprise, surprise, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-green-commerce-nominee-should-commit-to-keeping-huawai-on-blacklist\/\" title=\"Rep. Green: Commerce Nominee Should Commit to Keeping Huawai on Blacklist\">judge hearing<\/a> the legal challenge was appointed by the state\u2019s Democratic governor.<\/p>\n<p>According to <a href=\"https:\/\/coloradonewsline.com\/2023\/10\/30\/trial-bar-trump-colorado-ballot\/\" target=\"_blank\" rel=\"noopener\">Colorado \u200cNewsline<\/a>, the \u200dproceedings began\u200d in a courtroom in Denver under the watchful eye of Judge Sarah Wallace, an \u2063appointment of Colorado Gov. Jared Polis.<\/p>\n<p>She was appointed in August 2022.<\/p>\n<p>The case is the latest \u200cin a <a href=\"https:\/\/www.westernjournal.com\/supreme-court-gives-trump-big-win-shoots-case-couldve-destroyed-2024-chances\/\" target=\"_blank\" rel=\"noopener\">series of legal actions<\/a> targeting Trump\u200d and Trump-allied Republicans who dared to urge \u200bthat the 2020 election not receive the rubber stamp of certification of Congress.<\/p>\n<p>Democratic politicians have\u2063 done this in every election this century that they\u2019ve lost, mind you, but the \u200bCapitol incursion \u200dhelped\u2064 the\u200b media forget about \u2063this.<\/p>\n<p>Now, yet another group says the GOP\u2019s leading 2024 presidential candidate shouldn\u2019t be on the ballot because of an obscure, vestigial part of the 14th\u200c Amendment\u2062 that dates to the Civil War\u200d and bars anyone who\u2064 \u201cengaged\u200b in insurrection or\u200d rebellion\u201d (read: joined with the Confederates) \u2063from\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dick-morris-with-third-trump-indictment-looming-republicans-must-play-to-win\/\" title=\"Republicans must strategize for victory as a third Trump indictment approaches, warns Dick Morris.\">holding federal\u200d office<\/a>.<\/p>\n<p>However, the six Colorado \u200bvoters\u200b and the\u2063 watchdog group \u2062that joined them, Citizens for \u200dResponsibility and Ethics\u2062 in \u2062Washington, claim\u200d the amendment is pliable enough to apply to Trump.<\/p>\n<p>\u201cDonald\u2062 Trump tried\u200c to overthrow the results of \u200cthe 2020 \u200cpresidential election,\u201d reads the <a href=\"https:\/\/www.citizensforethics.org\/wp-content\/uploads\/2023\/09\/2023-09-06-08-43-07-Anderson-v-Griswold-Verified-Petition-2023.09.06.pdf\" target=\"_blank\" rel=\"noopener\">legal complaint<\/a>, which was filed on \u200cSept. \u200c6.<\/p>\n<p>\u201cHis efforts culminated on January 6, 2021, when he incited, exacerbated, and otherwise engaged in a violent insurrection at the United States Capitol by a\u200d mob who believed they were following his orders, and refused to \u2064protect the\u2064 Capitol or call off the\u200c mob \u2062for nearly three hours as the attack unfolded,\u201d\u200c it\u200c says.<\/p>\n<p>These cases \u200dhave been tried \u2062before \u200c\u2014 and <a href=\"https:\/\/www.westernjournal.com\/gop-rep-madison-cawthorn-celebrates-huge-victory-judge-strikes-legal-challenge-re-election-bid\/\" target=\"_blank\" rel=\"noopener\">failed to \u2064get traction<\/a>.\u2062 However, this one could be different.<\/p>\n<p>As Colorado Newsline noted,\u200c \u201cthe Colorado case \u2014 the first to \u200dbe filed by \u200bCREW, a nonprofit based in \u200bWashington, D.C., and the first to go\u200b to trial \u2014 represents the most substantial test\u2063 for such \u200defforts to date.\u201d<\/p>\n<p>\u201cCREW represented plaintiffs who cited the 14th Amendment in a successful suit to remove from office <a href=\"https:\/\/www.westernjournal.com\/trump-ally-ejected-permanently-barred-office-court-ruling-not-seen-since-civil-war-era\/\" target=\"_blank\" rel=\"noopener\">Couy Griffin<\/a>, a county commissioner\u2064 in Otero County, New Mexico, who had participated in the\u200d Jan.\u200d 6 attack,\u201d the outlet \u200dsaid.<\/p>\n<p>A\u2063 small-potatoes \u2064politician who <em>actively participated<\/em> in\u200d the incursion is different from the current GOP frontrunner for \u200cpresident, \u200dhowever \u2014 and\u200b one would be \u200ba fool not \u200cto notice.<\/p>\n<p>\u201cAfter the 2020 \u200delection \u2064cycle,\u200c President Trump made various\u200b statements and\u200c took various legal actions questioning the fairness or\u200c accuracy of the announced results,\u201d\u2064 <a href=\"https:\/\/www.westernjournal.com\/trump-attorney-tears-disgraced-felon-michael-cohen-cross-examination\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s attorney<\/a> said in a motion\u2064 to dismiss on Sept. \u206229.<\/p>\n<p>\u201cBut he is \u2063hardly the first \u2063politician to do that \u2014\u2063 and \u200dPetitioners identify no facts that could convert this political controversy into an insurrection \u2062against the government.\u201d<\/p>\n<p><a href=\"https:\/\/www.c-span.org\/video\/?531489-1\/president-trump-14th-amendment-hearing-colorado-part-1\" target=\"_blank\" rel=\"noopener\">Opening\u200c arguments<\/a> in the case\u2064 began Monday.<\/p>\n<p>According to poll\/stat wonk website <a href=\"https:\/\/projects.fivethirtyeight.com\/polls\/president-general\/2024\/colorado\/\" target=\"_blank\" rel=\"noopener\">FiveThirtyEight<\/a>, President \u200dJoe Biden holds\u200c a consistent but not\u2064 substantial \u200clead in a hypothetical head-to-head presidential matchup against Trump in Colorado, which tends blue but can surprise on \u200doccasion.
