Nehls (@RepTroyNehls) <a href=\"https:\/\/twitter.com\/RepTroyNehls\/status\/1719078340508659984?\">October 30, 2023<\/a><\/p>\n<\/blockquote>\n<p>\u201cThe Defendants may continue\u2063 to\u200d damage wires, which is especially likely because they damaged more property a mere day after this Motion was filed,\u201d the judge said, noting one reason for the temporary restraining order.<\/p>\n<p>The ruling noted that federal officials were trespassing because they did not have permission from <a href=\"https:\/\/www.westernjournal.com\/lone-star-state-hits-back-texas-ag-sues-biden-admin-destroying-border-property\/\" target=\"_blank\" rel=\"noopener\">Texas<\/a> or the owners of the property upon which the wire was located.<\/p>\n<p>Moses noted that \u200cTexas \u201calleges that \u200cby \u2018damaging, destroying, \u2063and exercising dominion over state property,\u2019\u200b the\u200b Defendants are causing the Plaintiff \u200bto incur \u2062\u2018extensive costs.\u2019\u201d<\/p>\n<p>Texas \u201cargues\u2062 that it will continue to incur considerable additional expenses \u2062to expand\u200d social services, \u200bmedical care, education, and other government programs,\u200d to accommodate the influx of illegal\u2062 aliens,\u201d the ruling said, adding that it provided \u201csworn declarations from various Texas state officials, who \u200ddescribe the significant annual cost of providing emergency medical services, social services, and public education to illegal aliens.\u201d<\/p>\n<p>The judge said Texas \u2063was able to prove the balance of <a href=\"https:\/\/www.westernjournal.com\/illegal-alien-fist-bumps-border-patrol-agent-cuts-border-wire\/\" target=\"_blank\" rel=\"noopener\">public interest<\/a> was \u2062on its side.<\/p>\n<p>\u201cFirst, the Plaintiff asserts that its use\u200d of concertina wire deters illegal entries and activities, including human trafficking,\u2064 drug smuggling, and terrorist infiltration,\u201d Moses wrote. \u201cSecond, the Plaintiff argues\u200d that the Defendants\u2019 actions are unlawful, and that even if\u200d a lawful basis exists, the Defendants must seek\u200c redress \u2018through\u200c legal proceedings, \u200bnot self-help actions.\u2019\u201d<\/p>\n<p>The Biden administration was banned from \u201cremoving the property from its present location for any reason other \u200dthan to provide or obtain\u200c emergency medical aid, as noted above\u201d as \u2064well as \u2064\u201cdisassembling, degrading, tampering with, or transforming the property \u200bin\u200c any way for any reason \u200bother than to provide or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/florida-abortionist-closes-permanently-after-watchdog-finds-he-endangered-women\/\" title=\"Florida Abortionist Closes Permanently After Watchdog Finds He Endangered Women\">obtain emergency medical<\/a> as noted in this order.\u201d<\/p>\n<p>A hearing on the injunction will be held \u2062on Nov. 7.<\/p>\n<hr>\n<h3>A Note from Our Staff:<\/h3>\n<p><em><b>Did you know that 90 percent of advertisers\u200d will \u2063have nothing\u2063 to do with The Western Journal?
