Chinese Leader Set To Meet President Biden Virtually\">top political opponent<\/a>, that\u2019s because they are.<\/li>\n<\/ul>\n<p><strong>[RELATED:[RELATED:<a href=\"https:\/\/thefederalist.com\/2021\/02\/09\/time-magazine-gushingly-profiles-the-successful-conspiracy-to-rig-the-2020-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">Time Magazine \u200bGushingly Profiles The Successful \u2018Conspiracy\u2019\u200d To Rig The \u20642020 \u2064Election<\/a>]<\/strong><\/p>\n<p>Trump\u2063 now faces a barrage of <a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/us\/trump-investigations-charges-indictments.html\" target=\"_blank\" rel=\"noreferrer noopener\">91<\/a> state and federal \u2062charges just more\u2063 than a year\u200d out \u2063from Election Day. Despite a wide <a href=\"https:\/\/www.nytimes.com\/interactive\/2023\/us\/politics\/presidential-candidates-2024.html\" target=\"_blank\" rel=\"noreferrer noopener\">field<\/a> \u200dof rival candidates trying to topple him\u2062 for the Republican nomination,\u200d Trump\u2019s main obstacle to reclaim the presidency is\u200d effort by the\u2063 federal\u2062 government and\u200c other Democrats to jail him. With a more than <a href=\"https:\/\/www.realclearpolitics.com\/epolls\/2024\/president\/us\/2024_republican_presidential_nomination-7548.html\" target=\"_blank\" rel=\"noreferrer noopener\">46-point<\/a> \u2064 lead in the\u200b Republican primary, Trump\u2019s near-certain rematch against Joe \u2063Biden is \u200breally a match against the incumbent\u2019s Department of Justice\u2064 (DOJ).<\/p>\n<p>The third of Trump\u2019s\u200d four indictments\u2063 was handed down in August, <a href=\"https:\/\/thefederalist.com\/2023\/08\/02\/doj-indictment-of-trump-is-a-declaration-of-war-against-american-voters\/\">ostensibly related<\/a> to the Jan. 6 Capitol riot.\u200c The charges,\u200b brought by Special Counsel Jack Smith, accuse Trump of \u2064conspiracy to defraud\u200c the United States, \u200bconspiracy\u2062 against civil rights,\u2062 obstruction\u2064 of an official proceeding,\u2063 and conspiracy\u2064 to \u200cobstruct a proceeding, all for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" title=\"Judge Chutkan won't step aside in Trump's J6 case; she's determined to prove her narrative.\">raising electoral objections similar<\/a> to those that \u2064Democrats have <a href=\"https:\/\/thefederalist.com\/2022\/06\/13\/second-j6-hearing-criminalizes-republicans-for-election-objections-after-democrats-made-them-for-decades\/\" target=\"_blank\" rel=\"noreferrer noopener\">made<\/a> for \u200ddecades. The DOJ\u2019s attempts \u200dto convict Trump as an \u201cinsurrectionist\u201d \u2063then \u2064set up Democrats to try to disqualify him from the\u200b November ballot in\u200b states around the country. At \u2064the\u200c same time, partisans \u2064in\u2063 the judiciary\u200d are \u200dpreventing\u200d Trump from even mounting\u2062 an \u200deffective\u200c campaign.<\/p>\n<h3>Obstacles in\u2062 the Legal Battle<\/h3>\n<ul>\n<li>Once the indictments were dropped, U.S. District Court Judge \u200bTanya \u200cChutkan, a <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">far-left activist<\/a> with \u2062an obvious animus against Trump and his supporters, was miraculously assigned to \u2062preside\u200c over the former president\u2019s Jan. 6 case. In September, Chutkan <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> Trump\u2019s request to move the case outside\u200d of Washington, a move the former president\u2019s team\u2062 sought \u2062due \u2062to the city\u2019s \u206492 to 5 \u200dpercent voting record in favor of\u2062 President Biden.<\/li>\n<\/ul>\n<p>This month, Chutkan issued a <a href=\"https:\/\/thefederalist.com\/2023\/10\/16\/judge-bars-trump-from-campaigning-against-his-top-political-opponent\/\" target=\"_blank\" rel=\"noreferrer noopener\">gag order<\/a> barring Trump from publicly speaking out against potential \u2063witnesses, \u200dcourt personnel, or federal prosecutors\u2062 in the\u200c case, including \u2064Special Counsel Jack Smith \u2014 hamstringing his ability\u2063 to\u200d campaign\u2062 against the political crusade. The\u2064 gag \u2063order\u200c was \u2064 <a href=\"https:\/\/x.com\/julie_kelly2\/status\/1718964213832433730?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">allowed to \u2062go into\u200d effect<\/a> on Monday after a temporary hold.<\/p>\n<p>Meanwhile in New York,\u2064 a\u200d Manhattan judge \u2063presiding \u200bover Attorney General Letitia James\u2019 attempt \u200cto ensnare Trump on\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-seek-to-disenfranchise-coloradans-from-voting-for-2024-frontrunner\/\" title=\"Democrats aim to prevent Coloradans from voting for the leading candidate in 2024.\">civil fraud \u200bcharges implemented<\/a> \u200da \u2062separate gag order and <a href=\"https:\/\/thefederalist.com\/2023\/10\/26\/new-york-judge-fines-trump-10000-for-benign-campaign-comment\/\" target=\"_blank\" rel=\"noreferrer noopener\">fined<\/a> the former president $10,000 last week for a <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/trump-fined-10000-over-comment-about-judges-staff-in-new-york-civil-fraud-trial\" target=\"_blank\" rel=\"noreferrer noopener\">comment<\/a> made outside the courtroom \u2062about \u201ca person\u2062 who\u2019s very partisan sitting alongside\u201d the judge. The fine followed a separate $5,000 punishment for another supposed\u2064 violation.<\/p>\n<h3>Efforts to Disqualify Trump<\/h3>\n<ul>\n<li>But even before\u200b a \u200cruling is handed down in\u2063 Trump\u2019s Jan. 6 case, Democrats are moving forward with efforts to kick Trump off the \u200dballot\u2063 as if he had already been\u200b convicted, \u2063never\u2063 mind the \u200dpartisan nature of the prosecutions. To be fair, the plaintiffs have good reason to assume Trump <em>will<\/em> be convicted \u2014 \u2064less because of his actions and \u200cmore\u200d because he\u2019s defending himself in a politicized trial in front of \u200ca judge and \u2063jury whose allegiances and prejudices\u200c are largely predetermined.\u2062 <a href=\"https:\/\/thefederalist.com\/2023\/09\/06\/new-poll-shows-trump-wont-get-a-fair-jury-trial-from-d-c-residents-whove-already-decided-hes-guilty\/\" target=\"_blank\" rel=\"noreferrer noopener\">According <\/a>to a September poll \u200cfrom Emerson College, a majority\u200d of D.C. residents, 64 percent, were already decided that they would \u200bvote in favor of a conviction in the case. Just 8 percent said they \u2062would find Trump innocent, and another 28 percent \u200cwere unsure.<\/li>\n<\/ul>\n<blockquote>\n<p>\u201cThe plaintiffs in \u200cthe cases argue the issue is simple,\u201d the\u2064 AP claimed Monday. \u201cTrump\u2019s \u2063efforts to \u2063overturn his\u2063 2020 election loss,\u2064 leading to the Jan. 6, 2021, attack on the U.S. Capitol, mean he\u2019s disqualified from\u2062 the \u200bpresidency just as\u200b clearly as\u200b if he were not a natural-born citizen, another constitutional prerequisite for the office.\u201d<\/p>\n<\/blockquote>\n<p>In other words, the \u2062goal is simple: \u200bKeep the most popular Republican in the country \u2014 who is\u2064 also <a href=\"https:\/\/www.realclearpolitics.com\/epolls\/2024\/president\/us\/general-election-trump-vs-biden-7383.html\">beating<\/a> President Joe Biden\u2063 in the polls \u2014 off \u2063the ballot, \u200cand pretend it\u2019s for \u201cdemocracy.\u201d<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2>\n<li>Does the use of a gag order to silence Trump&#8217;s campaign comment, which was unrelated to the ongoing trial, infringe upon his freedom of speech and \u2062violate his constitutional rights?<\/h2>\n<p><span>  =&#8221;_blank&#8221; rel=&#8221;noreferrer \u200bnoopener&#8221;>benign campaign comment<\/a> that he made during a rally. The comment was deemed to be a violation of the\u200d gag order, despite the fact that it had nothing to\u2064 do with the ongoing trial.<\/p>\n<h3>The Constitutional\u2063 Question<\/h3>\n<ul>\n<li>So, what is the basis for the attempt to keep Trump off the Colorado ballot?\u200c Democrats are\u2062 relying on the 14th \u2063Amendment\u2063 of\u200b the Constitution, which states that no person shall hold office if they have \u2062engaged in insurrection against\u200b the \u2064United States.<\/li>\n<\/ul>\n<p>The Democrats argue that the charges brought \u2063against\u2064 Trump in\u2062 relation to the Capitol riot constitute acts of insurrection, and therefore disqualify him from running for office. However, it must \u2062be noted that Trump has never been convicted of any crime related to the events \u2064of January 6, and the burden of proof lies with the prosecution.<\/p>\n<p>The use of the 14th Amendment in this manner sets a dangerous precedent. It\u200d allows political opponents to weaponize the legal system to prevent their\u200b rivals from running in elections. If this tactic is \u200dsuccessful, it could have far-reaching implications for the future of our democracy.<\/p>\n<h3>A Violation of Due Process<\/h3>\n<ul>\n<li>Furthermore, the attempts to keep\u2064 Trump off the ballot not \u200donly raise constitutional concerns, but also \u2062violate the principle of due process.
