NOT CONSTITUTIONAL! MAKE AMERICA GREAT AGAIN,\u201d<\/strong> the leading GOP contender in the 2024 presidential race said \u200din a Sunday post on his <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111321180492444530\" target=\"_blank\" rel=\"noopener\">Truth Social<\/a> platform.<\/p>\n<\/p>\n<p><strong>\u201cI have just learned that the very Biased, Trump Hating Judge \u2064in D.C., who should have RECUSED herself due to her blatant and \u2062open loathing of your favorite President, ME, has reimposed a GAG ORDER which will\u200d put me at a disadvantage against my \u200bprosecutorial and political opponents,\u201d<\/strong> he said \u200din\u200d a follow-up <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111322079015303492\" target=\"_blank\" rel=\"noopener\">post<\/a>.<\/p>\n<p><strong>\u201cThis\u200b order, according to many legal scholars, is unthinkable!\u201d<\/strong> Trump said. <strong>\u201cIt \u2062illegally and unconstitutionally \u200btakes away my First Amendment\u2062 Right of Free Speech, in the middle of \u200dmy campaign for President, \u200cwhere\u200d I am\u2063 leading against BOTH Parties in\u2062 the Polls.<\/strong><\/p>\n<p><strong>\u201cFew can believe this\u2063 is happening, but I\u2064 will \u200cappeal. How \u200dcan they tell the leading candidate \u200dthat he, and only \u200bhe, is seriously\u2062 restricted from campaigning in a \u2062free and open manner?\u2063 It will not stand!\u201d<\/strong><\/p>\n<\/p>\n<p>Chutkan imposed the gag order this month after special\u2064 prosecutor <a href=\"https:\/\/www.westernjournal.com\/fed-judge-smacks-jack-smiths-prosecutors-wasting-courts-time\/\" target=\"_blank\" rel=\"noopener\">Jack \u200bSmith<\/a> called for it. In her\u200d ruling Sunday, she said\u2062 the order will remain \u2062in effect while Trump\u2019s legal team appeals it.<\/p>\n<p>The <a href=\"https:\/\/www.axios.com\/2023\/10\/17\/trump-gag-order-jan-6-case-read\" target=\"_blank\" rel=\"noopener\">order<\/a> bans Trump from \u201cmaking any public statements, \u2063or directing others to make any public statements, that target\u200c (1) the\u2064 Special Counsel prosecuting this case or his staff; (2) defense\u200b counsel or their staff; (3) any of this court\u2019s staff or other supporting \u2063personnel; or \u200c(4) any reasonably foreseeable\u200b witness or the substance of their testimony.\u201d<\/p>\n<p>In\u200c the ruling \u2062Sunday, the judge said Trump\u2019s \u2064claim that his supporters have a right to hear\u2063 what he says \u200d\u201cdoes not alter the fundamental principle \u200bthat First Amendment rights, whether those of \u200bthe \u200dspeaker or the listener, may be curtailed to preclude statements that\u2063 pose sufficiently \u2063grave threats to the integrity of judicial\u2064 proceedings.\u201d<\/p>\n<p>Chutkan \u2014 who \u2063was appointed to the federal bench in D.C. by former President Barack Obama \u2014 also said the ban could prevent witness intimidation. \u201cThe\u200b evidence is in the \u200brecord; \u2062Defendant simply fails to acknowledge it,\u201d she \u200bwrote.<\/p>\n<p>In \u200bresponse to Trump\u2019s claims that the order was not \u2062necessary,\u2062 the \u2062judge quoted her\u2062 prior order \u2064that\u2064 read, \u201cDefendant\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-chutkan-files-formal-gag-order-on-trump-calls-his-comments-a-grave-threat-to-court-proceedings\/\" title=\"Judge Chutkan imposes gag order on Trump, deems his remarks a serious court threat.\">statements pose sufficiently grave threats<\/a> to the integrity \u200dof these proceedings that cannot be addressed by alternative means,\u200d and it \u200chas tailored \u2064its order \u200cto meet the force of those threats.\u201d<\/p>\n<p>\u201cDefendant has not made a strong showing that he is likely to succeed on the \u200dmerits,\u201d she\u2064 wrote. \u201cAs \u200bthe court has explained, the First Amendment rights of participants in criminal proceedings must yield, when necessary, to the orderly\u2064 administration\u200d of justice\u2014a principle reflected in \u200dSupreme Court precedent, the Federal Rules of Criminal Procedure, \u2064and the Local Criminal Rules.\u201d<\/p>\n<p>The ruling included examples of\u2062 what \u200dit would allow and what <a href=\"https:\/\/www.westernjournal.com\/jack-smith-runs-judge-chutkan-claims-trump-violated-terms-release-gun-video\/\" target=\"_blank\" rel=\"noopener\">Chutkan<\/a> said was over the\u2063 line.<\/p>\n<p>She said a Truth Social post by Trump on Oct. 20 would not be \u2064banned.\u200c It read, \u201cDoes anyone notice that the \u200bElection Rigging\u2063 Biden Administration never \u200dgoes after the Riggers, but only after those that want to catch and expose the Rigging dogs. Massive information \u2064and 100% evidence will be made available during \u2063the Corrupt \u2062Trials\u2062 started by our Political Opponent.\u200b We will never let 2020 happen again. Look at the result, OUR\u200c COUNTRY IS BEING\u2063 DESTROYED.\u00a0 MAGA!!!\u201d<\/p>\n<p>Then there was a Tuesday post on Truth Social.<\/p>\n<p>\u201cI don\u2019t think Mark\u2062 Meadows would lie about the Rigged and Stollen 2020 Presidential Election merely for getting\u2064 IMMUNITY against Prosecution (PERSECUTION!) by\u2063 Deranged \u2062Prosecutor, Jack Smith,\u201d\u2063 Trump posted. \u201cBUT, when\u2062 you really think about it, after being hounded\u200b like\u2064 a dog for three years,\u2064 told you\u2019ll be going to jail for the rest of your \u200blife,\u2062 your money and your \u200bfamily will be\u200b forever gone, and we\u2019re not \u200dat all\u2062 interested in exposing\u200b those that did the RIGGING \u2014\u200d If you\u2062 say BAD THINGS about that terrible \u2018MONSTER,\u2019\u2063 DONALD J.
