They argued it was necessary because President \u2063Trump had the potential to \u2062influence the public, and therefore potential \u200bjurors, \u200cin his favor.<\/p>\n<h2>Third-Party Actions<\/h2>\n<p>After a hearing, Judge Tanya Chutkan indeed issued a gag order,\u200d but with different limitations and reasoning. The order \u200cprohibited statements that would &#8220;target&#8221; the prosecution and defense legal teams, court\u2063 staff, and potential witnesses. \u200dIt did not elaborate on what \u2063constituted targeting these parties. \u2062The judge also specified that this would not prohibit\u2063 statements about President\u200c Joe Biden or the government\u200d in general, \u200cbecause they were not parties in the case and \u2064cited the rationale\u2063 that \u200dthese parties could come to harm if targeted in public statements.<\/p>\n<\/div>\n<p>President Trump&#8217;s attorneys are now \u2062arguing that\u200b this line of reasoning has proven unconstitutional in\u2062 Supreme Court rulings.<\/p>\n<p>&#8220;The Supreme Court has held, time and time again, that a person may \u2062not be prohibited from speaking because of the unsolicited actions\u2063 of others,&#8221; they argued, adding that speech has only been prohibited when it is &#8220;directed&#8221; to produce criminal activity.<\/p>\n<p>&#8220;Even where an\u2064 audience &#8216;might react with \u200cdisorder or violence&#8217; to a speaker\u2019s statements, the Supreme Court repeatedly rejects government \u2063attempts at censorship.&#8221;<\/p>\n<p>The attorneys wrote that such censorship of a political\u200d candidate constituted a &#8220;heckler&#8217;s veto.&#8221;<\/p>\n<p>They further note that the prosecutors \u200crevealed in the reply that they were not arguing for a gag order because of fear of violence but because of &#8220;the clear \u200bpattern of a portion of the audience agreeing with \u2063the\u2063 defendant&#8217;s implicit wishes.&#8221;<\/p>\n<p>&#8220;President \u200dTrump\u2019s speech does not constitute incitement, and the prosecution never\u2063 contends \u200dthat it does,&#8221; they added.<\/p>\n<div class=\"my-5\">\n<p>In \u2063several other motions the defense recently filed, attorneys note that though President Trump was never charged with inciting violence, prosecutors have made public statements implying this is a given fact, including\u200c in the indictment.
