In addition, other patches \u2063worn by Jaiden, including \u200done \u200dwith a Firearms Policy Coalition insignia depicting a semi-automatic rifle \u2062and three Pac-Man ghosts holding guns,\u200d were \u2063banned\u2062 in August and have not been permitted since, according to\u200c the <a href=\"https:\/\/www.washingtontimes.com\/news\/2023\/oct\/24\/jaiden-rodriguez-12-sues-colorado-school-district-\/?utm_source=RSS_Feed&#038;utm_medium=RSS\" target=\"_blank\" rel=\"noopener\">Washington Times<\/a>.<\/p>\n<p>The \u200bMountain States \u2064Legal Foundation has now filed\u2062 a lawsuit \u200bon behalf\u2063 of Jaiden.<\/p>\n<p>&#8220;Jaiden&#8217;s case is significant for all Americans who are concerned about the growing trend of public schools silencing viewpoints that do not \u200calign with the &#8216;progressive&#8217; political orthodoxy,&#8221; stated James Kerwin, senior counsel\u2064 for\u2062 the Mountain \u2064States \u2063Legal Foundation, in a\u200c <a href=\"https:\/\/mslegal.org\/press-releases\/jaiden-rodriguez-v-harrison-school-district-2\/\" target=\"_blank\" rel=\"noopener\">news release<\/a> on the foundation&#8217;s website.<\/p>\n<p>&#8220;Schools\u200b should not take sides\u2062 with activists \u200dwho want to reinterpret everything from the\u2064 past \u2063in the most negative light\u200c possible,&#8221; \u2063he added.<\/p>\n<p>The foundation emphasized that the threat to\u2064 ban the patch &#8220;is nothing \u200dshort of \u2063a threat to censor his speech once again.&#8221;<\/p>\n<p>According to the\u2063 foundation, this case goes beyond \u200cjust \u200done 12-year-old student.<\/p>\n<p>&#8220;Public schools are\u200d becoming\u2062 the battleground for preserving a culture and practice\u200d of free speech. Jaiden&#8217;s \u2062case will establish an important precedent for holding schools accountable for \u200btheir duty to uphold and protect the First Amendment,&#8221; the release stated.<\/p>\n<p>The \u200bfoundation also challenged the school&#8217;s claim that \u2064Jaiden&#8217;s\u200c wearing\u2063 of the patch disrupted the classroom.<\/p>\n<p>&#8220;Referring \u200dto \u2064American history does not substantially\u2063 disrupt the learning environment. The only individuals\u2064 impeding\u200c the ability of other students to\u2064 learn are\u200d education bureaucrats who fail to comprehend the First Amendment,&#8221; the release argued.<\/p>\n<p>&#8220;I \u200cfly it because I am proud to be an American,&#8221; Rodriguez\u200b stated, as reported \u2064by <a href=\"https:\/\/www.kktv.com\/2023\/10\/26\/colorado-springs-school-district-facing-federal-lawsuit-after-backlash-over-students-backpack-patches\/\" target=\"_blank\" rel=\"noopener\">KKTV-TV<\/a>. &#8220;I \u2064don&#8217;t hate America; I&#8217;m a patriot\u200c of our country.&#8221;<\/p>\n<p>&#8220;Schools should \u2063not suppress \u200dfreedom\u200c of speech, and they shouldn&#8217;t take extreme positions regarding historical symbols,&#8221; Kerwin emphasized.<\/p>\n<p><a href=\"https:\/\/mslegal.org\/cases\/jaiden-rodriguez-v-harrison-school-district-2\/\" target=\"_blank\" rel=\"noopener\">Mountain States Legal\u2063 Foundation<\/a> stated on its website that &#8220;too \u200dmany\u200c education bureaucrats have exploited the idea that &#8216;disruptions&#8217; \u200ccan be caused by speech they simply \u200ddon&#8217;t like.&#8221;<\/p>\n<p>The foundation criticized the school&#8217;s ban on \u200bpatches related to firearms, stating that \u200dit went beyond <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gadsen-flag-kid-slaps-colorado-school-district-with-lawsuit-alleging-first-amendment-violations\/\" title=\"Gadsen Flag Kid sues Colorado School District for First Amendment violations.\">reasonable policies prohibiting weapons<\/a> or simulated weapons on campus.<\/p>\n<p>&#8220;The\u200b school implemented a blanket policy that forbids any clothing or accessories that &#8216;refer to&#8230;weapons.&#8217; This\u200b policy is so broad that it would even prohibit a student\u200b from \u2062displaying the official seal \u200dof the State\u200b of\u200d Colorado because it\u200d contains a battle axe and shield, \u200bor a one-dollar bill because it\u2063 depicts an eagle clutching a bundle of \u200darrows.
