Defense attorneys \u200cargued in the new filing that \u200bthis\u2062 is not the case.<\/p>\n<p>&#8220;The text of the Constitution\u2014namely the Impeachment Judgment Clause\u2014straightforwardly supports Presidential immunity from \u2064criminal prosecution absent conviction in the Senate,&#8221; the new filing reads. &#8220;A convicted party\u200c is liable\u200b to criminal prosecution. Thus, \u2062a\u2062 President \u200bwho is not &#8216;convicted&#8217; is not liable.&#8221;<\/p>\n<div class=\"my-5\">\n<p>The <em>Nixon v. Fitzgerald<\/em> ruling that clarified presidential immunity said as much, they argued, as it\u200b specifically pointed\u200b to the impeachment \u200dprocess as the proper venue to indict a president:<\/p>\n<\/div>\n<div class=\"my-5\">\n<p>\u201cA rule of absolute immunity \u2062for the President will not leave the Nation without sufficient protection against misconduct on the part of the Chief Executive. There remains the constitutional remedy \u2063of \u200bimpeachment.\u201d<\/p>\n<h2>Other Motions to \u2064Dismiss<\/h2>\n<p>On Oct. 23, President Trump&#8217;s team filed three additional motions to dismiss the case on statutory grounds, constitutional grounds,\u2064 and for &#8220;selective and vindictive prosecution.&#8221; Another motion was filed to strike inflammatory allegations from the indictment.<\/p>\n<\/div>\n<p>The attorneys argued that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-reasserts-presidential-immunity-in-federal-election-case\/\" title=\"Trump claims presidential immunity in federal election case.\">original indictment repeatedly mentions individuals involved<\/a> \u2063in\u2062 the \u200dJan. 6, 2021, Capitol breach event, \u200cwithout holding President \u200cTrump responsible for those actions.<\/p>\n<p>&#8220;The public \u2062has a\u2064 high awareness of, and strong views regarding, the actions at the \u200cCapitol on January\u200b 6, 2021,&#8221;\u2063 the \u2063filing reads. &#8220;Allegations in the indictment relating to these actions, when President Trump has not been charged with responsibility for them, is highly prejudicial and inflammatory\u2063 because members \u200bof \u2064the jury may wrongfully impute fault to President Trump for these\u200b actions.&#8221;<\/p>\n<p>The motion was filed after a \u2064gag order was issued for President Trump, prohibiting\u200d him from making statements about individuals\u2064 involved in the case, including prosecutors and potential witnesses. Prosecutors argued that his &#8220;inflammatory&#8221; remarks could bias jurors.<\/p>\n<p>This claim of prejudice was echoed in the other motions to dismiss, which assert that the case is politically motivated.<\/p>\n<p>&#8220;Biased prosecutors pursued charges despite the evidence, rather than based on it, with one prosecutor violating DOJ rules\u200d and ethical norms\u2064 by forecasting the investigation in a television interview on &#8217;60 \u200dMinutes,'&#8221; the motion read.<\/p>\n<p>They noted\u2063 that President Joe Biden\u2062 had stated \u200bin a press conference, &#8220;We just have to\u200c demonstrate that \u2064he will\u200d not take power,&#8221; referring to President Trump.<\/p>\n<p>&#8220;Three days \u2063after President Trump formally announced his candidacy, the Special Counsel was put \u200bin place as part of a flawed effort to insulate Biden and his supporters from \u2064scrutiny of their obvious and illegal bias,&#8221; the motion reads, \u200darguing that the \u2063sequence of events &#8220;demonstrates vindictiveness.&#8221;<\/p>\n<p>In a separate motion,\u200b attorneys argued that the prosecutors fail to provide evidence \u200dthat President\u200c Trump violated the statutes mentioned in the indictment.<\/p>\n<p>&#8220;Targeting an audience other than this Court, the prosecution&#8217;s indictment in \u200bthis matter rants endlessly\u2062 about President Trump&#8217;s politics and\u2014in a shockingly un-American display of authoritarianism\u2014accuses \u200chim\u2063 of crimes for\u2063 having and expressing the &#8216;wrong&#8217; opinions,&#8221; the motion to dismiss reads.<\/p>\n<p>Furthermore, in arguing\u2063 that the case lacks constitutional standing, attorneys wrote\u200d that the prosecutors&#8217; arguments and indictment violate the First Amendment\u2064 and due process laws.
