This\u2062 law complements \u200dSenate Bill 699, which\u2064 was\u200b signed into law \u200cby\u200b Governor Newsom\u2063 in September \u2063and deems noncompete agreements void.<\/p>\n<p>The state is urging employers to review their \u2064existing agreements to ensure \u2064compliance with the new law.<\/p>\n<p>Assembly Bill 1076, introduced \u200dby Rebecca Bauer-Kahan (D-Orinda), also mandates that employers provide \u200bwritten \u2062notices to all current and former \u2063employees, who were employed after January 1, 2022, by February 14, 2024, stating \u2064that any noncompete clauses they signed are \u200bnow\u2062 considered &#8220;void.&#8221;<\/p>\n<p>Senate \u2063Bill 699, introduced by\u200b Senator Anna \u200dCaballero (D-Merced), goes\u200d even further by banning noncompete agreements \u200csigned in other states. It \u2062also specifies that \u2062employers cannot restrict former \u200bemployees from seeking employment in\u2064 California, even if they had previously signed a noncompete agreement\u200d while residing in another state \u2062or working for an out-of-state employer.<\/p>\n<p>Last April, California\u200b Attorney \u2063General \u200bRob Bonta\u2064 co-led \u2063a \u2063coalition of 17 states that sent a letter to the Federal Trade Commission in support of its proposed rule to ban noncompete \u2062clauses \u200cin employment \u2064contracts. The FTC\u200b is expected \u2063to vote on the rule in April 2024.<\/p>\n<p>According \u2063to Mr. \u200dBonta, noncompete agreements\u2062 have a \u2063negative\u2064 impact on labor market mobility \u200cand worker\u200d compensation, affecting not\u200c only \u200dhigh-paying technical jobs but\u200b also lower-paying positions. He emphasized that noncompete agreements have no place in California and encouraged job seekers and employees to be aware of their rights\u2063 if presented with such agreements.<\/p>\n<p>Mr. Bonta stated,\u2062 &#8220;Despite being prohibited in California, noncompete provisions are \u200cstill included \u200bin employee contracts, including those for lower-wage\u200c workers.
