The case revolves around \u200ca dispute between Long Lake Township and Todd Maxon, who had been accused by the township of operating an illegal junkyard on his property. In 2017, town officials \u2063hired a drone operator to gather evidence\u200c of Maxon&#8217;s alleged zoning violation.\u200b Maxon argues \u2062that this surveillance violated his Fourth Amendment rights.<\/p>\n<p>Representing Maxon, \u200bRobert\u2063 Frommer,\u200b a senior attorney with \u2062the Institute \u200dfor Justice, a national nonprofit, stated, \u200b\u201cRunaway drone surveillance\u2063 is\u2064 pretty much the start of \u2063every dystopian \u200bscience\u200d fiction novel.\u201d He further \u200bemphasized that if the family loses the case at the state level, they are prepared to appeal to the U.S. \u200cSupreme Court.<\/p>\n<p>Maxon \u200bdescribed the\u2063 surveillance as \u200dintrusive, stating, \u201cThis is high-definition, zoom-in still photographs, video. It\u2019s\u2063 \u2013 people today, society today, is not ready to accept that as the norm. Nobody would want any drone\u2064 watching you.\u201d He also mentioned instances where he was captured on video while outside his \u2063house with his family.<\/p>\n<p>The township\u200c argues\u200b that it was necessary to conduct the surveillance because Maxon had violated the terms of a previous settlement. They claim that\u2062 the drone never entered Maxon\u2019s\u200d property \u2064and\u2063 that there was no law prohibiting such\u2062 surveillance.\u2064 Michigan law allows drones to fly up to 400 feet.<\/p>\n<p>The Michigan\u200c Supreme Court had previously referred the case to \u2062the Michigan Court of Appeals \u200dto determine whether the exclusionary rule, which \u2064prohibits the use of illegally obtained evidence, applies.\u200d The Court of Appeals\u200c ruled that in\u2064 a civil matter, violating Fourth Amendment rights was not \u2062a concern.<\/p>\n<p>The American Civil \u2064Liberties\u200b Union (ACLU) has intervened on \u200dbehalf \u200cof \u2062the Maxon family, arguing that the drone surveillance violates the Fourth Amendment.
