He\u200c described an operation where Bankman-Fried had oversight of\u2062 all the moving\u200d pieces and knew full \u200dwell, at every stage, what his employees were doing with\u200d customer deposits. He said that Bankman-Fried knew that Alameda had drained\u200b $8 billion from FTX\u2019s coffers despite assurances from the exchange\u2019s \u200dCEO that customers need not worry about the disposition of their funds.<\/p>\n<p>Notwithstanding these promises, as much as $10 \u2062billion of customers&#8217; money went to finance a\u2064 lavish lifestyle, the purchase of a \u200dBahamas\u2062 home, \u200ctrips \u2062abroad, political bribes in both the United States and China, and other excesses not within the scope \u2063of the exchange\u2019s ostensible \u200brole \u2062and purview.<\/p>\n<p>Exactly how much \u200dblame falls on\u2064 Mr. Bankman-Fried?\u2063 Agency, or the lack of it, is the critical bone of contention\u2063 for both the prosecution and defense cases.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<p>That\u2019s the view \u2064of Thomas Plunkett, a \u2064professor at Harrisburg University in Pennsylvania who specializes in cryptocurrency regulation. (Marco\u200d Bello\/Reuters)<\/figcaption><\/figure>\n<p>\u201cThey\u2019re trying to get at the fact that customer funds were used inappropriately,\u2062 and the fact that there\u200d was a whole pattern \u2062of fraud \u200bhere, that [FTX executives] were fraudulently trying to get loans and make lots of false statements. And they\u2019re trying to show that Sam Bankman-Fried was the ringleader of all that,&#8221; Mr.\u200d Plunkett\u200b said. &#8220;He was the one in charge.\u201d<\/p>\n<p>How\u200b has the defense responded to the scandalous allegations?<\/p>\n<p>\u201cYou can see in the cross-examination \u2064that defense lawyers were trying to imply that\u200c other people had motives to do these things.\u200c But that doesn\u2019t exonerate Bankman-Fried, it just implies that the witnesses were \u2063also guilty. So, I think it will be very hard\u200b to defend against,\u201d he said.<\/p>\n<p>Given \u2062these realities and the considerable evidence of false representations \u2064on Mr. Bankman-Fried\u2019s\u200d part, the defense team is pushed into something of a corner, Plunkett suggested. One where they and their\u2064 client must fight hard to drive home \u200dto jurors the difference between insufficient oversight, or a managerial approach that\u200b merely had unintended consequences, and the presence\u2063 of scienter, or\u2062 the knowledge and will to commit fraud.<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>  Former crypto hedge fund Alameda Research\u200b CEO Caroline\u200b Ellison. Santiago\/Getty \u200bImages)<\/figcaption><\/figure>\n<p>\u201cI think \u2063they will try to make the argument that though Bankman-Fried was \u2064the high-level executive, he wasn\u2019t paying a lot of attention to his underlings. At the end of the day, \u200bthat\u2019s the only way\u200d they can defend,\u201d Mr.\u200d Plunkett said.<\/p>\n<p>Part of the legal case may rest on an argument that FTX\u2019s terms of service did not preclude the use of \u2063customer funds at its executives\u2019 discretion,\u200c he predicted.\u200c Such claims have already been the \u200dsubject\u200c of motions and witness testimony since Oct. 3, noted Mr.\u200d Plunkett, with more likely to \u200bfollow.<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>  Donations\u200c by Sam Bankman-Fried to U.S. lawmakers\u2062 (Source: UnusualWhales.com, Federal\u200b Election Commission)<\/figcaption><\/figure>\n<p>\u201cTo a certain extent, I\u2019m sympathetic to that argument,\u200b but that still doesn\u2019t excuse lying, and the prosecution evidence, I think, is \u2062fairly \u200cconvincing\u2062 that there were some \u200blies told by FTX,\u201d \u2063Mr. Plunkett continued.<\/p>\n<p>\u201cThat being \u2063said, they were\u2063 certainly not the only crypto company \u2062telling lies in 2021 and 2022.\u201d<\/p>\n<p>Mr. Bankman-Fried and his \u200dlawyers are \u2063also likely to make the rather familiar\u2063 case \u200bthat a lack of clarity in crypto regulations helped\u200c foster an environment where executives\u2062 committed violations simply because they didn\u2019t grasp \u2063what the rules of the road were.<\/p>\n<p>\u201cThey\u2064 will make the case that \u2064it was an immature \u200dbusiness, a brand new startup, they didn\u2019t know \u2064they \u2062were doing wrong,\u201d said Mr. Plunkett.<\/p>\n<p>The defense \u200bteam\u2019s hope, and that of Mr. Bankman-Fried himself,\u2062 will be to evoke sympathy\u2064 on \u2063the part of jurors who do not want to\u200d send someone away for life for what were, at bottom, innocent mistakes.<\/p>\n<div class=\"my-5\">\n<p>  \u2064 If one member\u2064 of the jury\u2014just one out of the 12\u2014comes around to this view,\u2063 then the defense will have \u2063succeeded, Mr. Plunkett observed.\n<\/p><\/div>\n<h2><strong>A Question of Presence of Mind?<\/strong><\/h2>\n<p>The question of whether FTX\u2019s CEO was fully\u200c <em>compos mentis<\/em> \u200d when the serious offenses occurred \u200bmay loom large \u200cduring the trial\u2019s remaining weeks, said \u200dJeffrey Hooke, a senior \u2062lecturer at\u200d the John Hopkins Carey Business School and a former investment banker at Lehman Brothers and Schroder Wertheim.<\/p>\n<p>\u201cThe defense might argue that Bankman-Fried didn\u2019t have any malicious intent, he just got a \u2063little carried away and did these things,\u201d\u2063 Hooke told The Epoch Times.<\/p>\n<p>\u201cHe\u2019s a bit of a prodigy, he\u2019s a little erratic, he was talking on YouTube\u200c before he was even charged,\u201d Hooke said.<\/p>\n<p>Besides the questions about presence of mind, Mr. Hooke concurred\u2063 with Mr. Plunkett that Mr. Bankman-Fried does \u2064have some room for legal maneuvering with regard to the technical \u2063legal \u2062status \u200dof FTX.<\/p>\n<p>Mr. \u200cBankman-Fried may well use part of his time on the \u2062stand \u200cto argue that he was running a private exchange not subject to the \u2063same rules regarding commingling or\u200d campaign donations as a \u200cregistered public exchange, Mr. Hooke suggested. Hence, his activities\u200d fell outside\u2064 the \u2064purview of the Securities and Exchange Commission \u2064(SEC) and the Commodity Futures Trading Commission \u200c(CFTC).<\/p>\n<p>\u201cHe wasn\u2019t running an\u200c exchange regulated \u2064by the government.\u2064 The SEC \u200dnever cracked down, the CFTC never cracked\u200b down, it\u200d was sort of in a gray\u2064 area,\u201d Mr.\u200d Hooke observed.<\/p>\n<p>While Alameda may well have siphoned off\u2064 funds from FTX, the rules \u200bon segregation of funds \u200dmay simply not apply given the funds\u2019 status as, in essence, unsecured loans from FTX customers, said \u2062Mr. Hooke. From this point of view, FTX was wholly different\u200d from, say,\u2063 the New York Stock Exchange, which must follow highly specific\u2064 and detailed \u2062rules about the use of customer funds, he continued.<\/p>\n<div class=\"my-5\">\n<p>  But some of the other charges against\u2062 Mr. \u200cBankman-Fried will be more tricky to refute, particularly with regard to false \u2062representations about \u200dFTX assets on bank loan applications, said Mr.\u2063 Hooke. \u2062Not to \u200bmention the <a href=\"https:\/\/www.reuters.com\/legal\/ftxs-bankman-fried-charged-with-bribery-conspiracy-new-indictment-2023-03-28\/\" target=\"_blank\" rel=\"noopener\">allegations<\/a> that FTX\u2019s CEO\u200c bribed Chinese officials, to the tune of $40 million, in \u200cthe hope of getting them to unfreeze\u2064 Alameda accounts.\n<\/div>\n<p>\u201cLying on bank forms and making foreign campaign contributions and foreign bribes are a lot more clear-cut \u2064for the prosecution. (Elizabeth Frantz\/Reuters)<\/figcaption><\/figure>\n<div class=\"my-5\">\n<h2><strong>The Right Move?<\/strong><\/h2>\n<p>  Given the preponderance of evidence against Mr. Bankman-Fried and the defense\u2019s need\u2063 to try to disprove scienter, Mr. Bankman-Fried\u2019s decision to\u200c take the stand is not quite so surprising.\n<\/p><\/div>\n<p>\u201cI think a lot of people\u2014and he may do \u200dthe same\u2014would just plead\u200d ignorance \u200cand say that underlings were handling \u200bthis or that. I don\u2019t \u200csee \u2062who else could\u2064 make that argument except him,\u201d said Mr. Hooke.<\/p>\n<p>But, in electing to take this \u2062course,\u2063 Mr. Bankman-Fried may walk right into the government\u2019s trap.<\/p>\n<p>Having testified during trials involving allegations of fiscal fraud, Mr. Hooke knows well the psychological pressures that\u200d aggressive prosecutors hell-bent on breaking a witness \u2063tend to apply.<\/p>\n<p>\u201cI\u2019ve been in trials as an expert witness where they\u2019re cross-examining you for six or seven hours. That\u2019s pretty wearing. \u2064They\u2019re trying to wear you down, \u2062make \u2063you slip up,\u201d \u2063Mr. Hooke said.<\/p>\n<p>\u201cOften, \u200cthe lawyers on the other side\u2064 are \u2063going to try to repeat a question six different ways. You might just give the wrong answer one time out of six, because you\u2019re so worn out.\u201d<\/p>\n<p>Given the pitfalls, it is relatively rare for the top\u200b executive of a bank or\u2062 exchange at the center of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-denounces-kicking-out-unvaccinated-troops\/\" title=\"DeSantis Denounces Kicking Out Unvaccinated Troops\">high-profile lawsuit<\/a> to testify, and\u2062 when they do so, \u2062things often \u200bdo not \u200dgo as they hoped, Mr. Hooke said.<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>  JPMorgan Chase &#038; Co. (Elizabeth Frantz\/Reuters)<\/figcaption><\/figure>\n<div class=\"my-5\">\n<h2><strong>The Likely Outcome<\/strong><\/h2>\n<p>  \u200d While Mr. Hooke is under no illusions\u200b about the dangers of \u200bMr. Bankman-Fried\u2019s chosen course, he conceded that the worst \u2063possible \u200doutcome evoked by some commentators might \u2064not materialize. Even if convicted, Mr. Bankman-Fried might\u200b yet avoid a century-long prison sentence.\n<\/p><\/div>\n<p>\u201cHe\u2019s a first offender. I can\u2019t see that kind of sentence. I\u2019d say he\u2019ll probably get 20 years, which is\u200b still a\u2063 long time. I think it would have to be \u200ca minimum- or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-marines-family-pleads-with-biden-to-retrieve-son-from-russian-prison\/\" title=\"Former Marine\u2019s Family Pleads With Biden To Retrieve Son From Russian Prison\">medium-security prison<\/a>,&#8221; \u200dMr Hooke said.<\/p>\n<p>&#8220;You can\u2019t put him in with convicted murderers; he\u2019d get killed.\u201d<\/p>\n<p>If there is a silver lining,\u2063 it is that\u200b crypto\u200d exchanges and \u2063firms may \u200dderive lessons with respect to \u2064governance\u200b and transparency, and avoid the catastrophe that befell FTX and its founder.<\/p>\n<p>\u201cCrypto companies should <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bankman-fried-testifying-is-a-dangerous-ploy-that-may-offer-only-hope-of-exoneration-legal-experts\/\" title=\"Bankman-Fried's testimony is a risky move that could be their only chance for exoneration, say legal experts.\">implement strong corporate governance structures<\/a> so that there are appropriate checks and controls on how\u200b business activities are undertaken and how funds and assets belonging to \u2062their customers are managed,\u201d Christopher\u2063 Odinet, a professor at the University of\u2063 Iowa College of Law, told\u200d The Epoch Times.<\/p>\n<p>But the industry may not yet be \u200bat a mature enough stage to draft, implement, and codify rules \u2062that can\u200d avoid shenanigans in the future.<\/p>\n<p>\u201cAdmittedly, some regulatory regime that requires them to do this would be ideal because I am not \u200bconfident that one can \u2062consistently rely on crypto firms to do it in all \u200bcases, or\u2063 to do it in a\u200c robust way across the industry,\u201d Mr. Odinet said.<\/p>\n<p>Meanwhile, the restructuring of FTX under its current CEO,\u200d John Ray III, who oversaw Enron\u2019s remaking after its December 2001 insolvency, will proceed regardless of the \u200cfate of Mr. \u200bBankman-Fried.<\/p>\n<p>\u201cI think\u200b the outcome of the trial\u200c is unlikely to impact\u200c the bankruptcy very much. Whether he incurs criminal \u200bliability \u2063doesn\u2019t really have a bearing on how the\u2064 defrauded customers of \u2064FTX get paid &#8230; and how much. These are separate matters,\u201d said Mr. Odinet.<\/p>\n<p>The Epoch Times has\u200b reached out to Sam Bankman-Fried\u2019s legal team for \u2062comment.<\/p>\n<p> <\/p>\n<h2> What challenges does the defense face in convincing the jury that Bankman-Fried lacked the necessary knowledge and intent to commit fraud?<\/h2>\n<p><span>  \u200bE><\/p>\n<p>Another critical \u200baspect of the case will \u2062be whether the \u200dprosecution\u200d can successfully prove \u200bthat Bankman-Fried had direct knowledge of the fraudulent activities taking \u2063place \u2063within FTX. This will require presenting evidence that links Bankman-Fried to the specific actions taken by his subordinates.<\/p>\n<p>While the defense may argue that Bankman-Fried lacked the necessary knowledge and intent \u2064to commit fraud, they face an uphill battle in convincing the jury. With testimonies from key individuals within FTX who\u200b have directly \u2063implicated Bankman-Fried, the defense must\u200b work \u2064diligently to counter these damaging statements.<\/p>\n<p>However, the\u2064 decision for Bankman-Fried\u200b to testify could be a strategic move\u200c by the defense to humanize the defendant, presenting him as a\u2062 charismatic leader who \u200cwas \u200dtaken advantage of by those around him. By taking the stand, Bankman-Fried\u200b has the\u200b opportunity to tell\u2063 his\u2062 side\u2064 of the story and \u2064potentially sway\u200c the jury&#8217;s\u2064 perception in\u2063 his favor.<\/p>\n<p>It \u2064is important to note that\u200b Bankman-Fried&#8217;s testimony also entails significant risks. Prosecutors will undoubtedly seize the opportunity to \u200bcross-examine him vigorously, with the goal of undermining his credibility and further incriminating him. Each statement made by Bankman-Fried will be scrutinized, and any inconsistencies or contradictions could be used to strengthen the prosecution&#8217;s case.<\/p>\n<p>Ultimately, the success of Bankman-Fried&#8217;s testimony\u200d will \u2064depend on his ability to provide a compelling narrative that aligns with the \u2062evidence presented throughout the trial.
