It puts our \u200ccountry and our citizens at risk,\u201d Paxton said in \u200ca statement, according to <a href=\"https:\/\/www.foxnews.com\/politics\/texas-ag-paxton-sues-biden-admin-cutting-razor-wire-southern-border-illegal\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>. \u201cThe courts must put a stop to it, or Biden\u2019s free-for-all will make this crushing immigration crisis drastically\u2064 worse.\u201d<\/p>\n<p>Paxton also announced the lawsuit\u200c on social media.<\/p>\n<p>\u201cToday, \u200bI filed a \u200dlawsuit against \u200dthe <a href=\"https:\/\/www.westernjournal.com\/bad-news-biden-campaign-spotted-rolling-road-ohio\/\" target=\"_blank\" rel=\"noopener\">Biden<\/a> \u200dAdministration regarding their \u2064cutting razor \u2063wire\u200b at the border. Texas \u2064is and will continue \u2063to be America\u2019s greatest backstop\u2062 to the failures of the federal government,\u201d Paxton tweeted.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">BREAKING: Today, I filed a lawsuit against the Biden Administration regarding their cutting razor wire at the border. Texas is and will \u2062continue to be \u2063America\u2019s \u2062greatest backstop to the failures of the federal government. <a href=\"https:\/\/t.co\/rfzJWYqYxH\">https:\/\/t.co\/rfzJWYqYxH<\/a><\/p>\n<p>\u2014 Attorney General Ken Paxton (@KenPaxtonTX) <a href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1716890863241236856?\">October\u2064 24, 2023<\/a><\/p>\n<\/blockquote>\n<p>Recently acquitted after a sham <a href=\"https:\/\/www.westernjournal.com\/ken-paxton-acquitted-impeachment-trial\/\" target=\"_blank\" rel=\"noopener\">impeachment<\/a>, the Texas attorney general \u200bhas wasted\u200b no time renewing his fight against illegal immigration.<\/p>\n<p>In his complaint, filed with\u2062 the U.S. District Court, Western District of Texas, Paxton charged the federal government with so badly neglecting border security that the state had no choice but\u200c to erect concertina wire, also\u2064 called \u201crazor\u201d wire.<\/p>\n<p>\u201cTexas has acted to fill the breach\u2062 created by the federal\u200b government\u2019s \u200cindolence,\u201d Paxton wrote.<\/p>\n<p>Alas, near Eagle Pass, Texas, which <a href=\"https:\/\/www.westernjournal.com\/texas-ag-paxton-returns-4-month-impeachment-trial-find-bidens-border-antics\/\" target=\"_blank\" rel=\"noopener\">Paxton<\/a> called the \u201cepicenter\u201d of a \u201crecent\u201d and \u201cunprecedented\u201d surge of illegal immigrants, CBP \u2063agents \u201cincreased\u2064 this federal practice of\u200c cutting, destroying, or otherwise \u200ddamaging Texas\u2019s concertina wire that had been strategically positioned for the purpose of securing the border and stemming the flow of illegal migration.\u201d<\/p>\n<p>Paxton even cited\u200b a specific date on which\u2062 the federal agents\u2019 shocking and subversive behavior began.<\/p>\n<p>\u201cSince September 20, 2023, federal agents\u200b have \u200cdeveloped and implemented a\u2064 policy, pattern, or practice of destroying Texas\u2019s concertina wire to encourage and assist \u200dthousands of aliens to illegally\u2063 cross \u200bthe Rio Grande and enter Texas,\u201d he wrote.<\/p>\n<p>Thus, federal agents have committed multiple crimes, according \u2063to <a href=\"https:\/\/www.westernjournal.com\/republican-ag-ken-paxton-flips-script-tried-impeach\/\" target=\"_blank\" rel=\"noopener\">Paxton<\/a>.<\/p>\n<p>\u201cBy cutting Texas\u2019s \u2063concertina wire, the federal government has not only illegally destroyed property owned by the State of Texas; it has\u200d also disrupted the State\u2019s border security \u2062efforts, leaving gaps in\u200b Texas\u2019s border barriers and damaging Texas\u2019s \u200cability to effectively deter illegal entry into \u200dits territory,\u201d the \u200cattorney general wrote.<\/p>\n<p>As a \u200bstate attorney general, <a href=\"https:\/\/www.westernjournal.com\/tx-ag-ken-paxton-says-knows-100-democrats-cheat-tells-tucker-stop-looking-machines\/\" target=\"_blank\" rel=\"noopener\">Paxton<\/a> has taken \u200bappropriate action. In any case, it is the only\u2062 course \u2063of \u200baction \u2063available to him. Whether dragging the federal government into\u200b court will do \u200bany good, only \u200btime will tell.<\/p>\n<p>For the rest of us,\u200b however, this situation raises a \u200cmuch deeper question.<\/p>\n<p>Assuming Paxton\u2019s complaint has merit, federal \u200dagents have acted both in defiance of the law and against Texans\u2019 interests. This has left Paxton no choice but to appeal to the U.S. District Court.<\/p>\n<p>If the U.S. District Court \u2014 another federal entity \u2014 provides\u2063 no relief, then what next? In other words, \u200bwhat recourse do \u2062Americans have when every branch of the federal government ignores their rights and interests?<\/p>\n<p>In 1798, for\u2063 instance, the federal government trampled the First Amendment by passing the hideous \u200bAlien and Sedition Acts. <a href=\"https:\/\/www.westernjournal.com\/providence-jefferson-adams-died-50th-anniversary-declaration-independence\/\" target=\"_blank\" rel=\"noopener\">Thomas Jefferson<\/a> and James Madison responded by arguing \u2064that the states had \u200dan obligation\u200d to shield their citizens from the federal government\u2019s patently unconstitutional behavior.<\/p>\n<p>Decades later, in\u200d the hands of <a href=\"https:\/\/avalon.law.yale.edu\/19th_century\/ordnull.asp\" target=\"_blank\" rel=\"noopener\">South Carolina<\/a> \u2062 firebrands, Jefferson\u2019s \u201c<a href=\"https:\/\/oll.libertyfund.org\/page\/1798-kentucky-resolutions-jefferson-s-draft\" target=\"_blank\" rel=\"noopener\">nullification<\/a>\u201d argument became twisted, and\u2064 therefore, infamous.<\/p>\n<p>Madison, however, called the states\u2019\u2062 act of shielding its own citizens \u201cinterposition.\u201d He explained it at length \u200din his \u201c<a href=\"https:\/\/founders.archives.gov\/documents\/Madison\/01-17-02-0202\" target=\"_blank\" rel=\"noopener\">Report\u2064 of 1800<\/a>.\u201d The Founding Era \u200bproduced no more\u200b important statement on the principles of federalism \u200dand constitutional liberty.<\/p>\n<p>Significantly, no one \u200chad yet dreamed of submitting all constitutional questions to \u2062courts. The American revolutionaries would have chafed at an idea so obviously hostile to liberty and self-government.<\/p>\n<p>With this in mind, <a href=\"https:\/\/www.westernjournal.com\/gov-greg-abbott-shares-video-border-wall-construction-texas-doesnt-rest\/\" target=\"_blank\" rel=\"noopener\">Texas<\/a> must do whatever it takes to shield its citizens from hostile federal actors.
