Trump has \u200dappealed \u200dthe order to the U.S. Court of Appeals for the District of Columbia Circuit.<\/p>\n<p>The ACLU argues that Trump&#8217;s \u2062First Amendment right to speak\u200d should be \u2064protected, and that silencing him could set a \u200bdangerous precedent for other voices,\u200b even those \u2062the ACLU agrees with. They\u200b believe that the\u200d order is too\u200c broad and vague, and that the word &#8220;target&#8221; is unconstitutionally ambiguous.<\/p>\n<p>The ACLU acknowledges the concern that Trump&#8217;s statements could incite\u2062 violence, but they assert that the First \u200dAmendment does not allow\u2064 a judicial gag order simply because some individuals\u200b may react negatively to his words.
