Cities that\u200b fail \u2062to comply can lose local control over their \u200dability to deny housing\u2063 projects that go against local\u2064 zoning regulations, or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-against-christian-college-suing-biden-administration-over-trans-mandate\/\" title=\"Judge Rules Against Christian College Suing Biden Administration Over Trans Mandate\">face financial penalties<\/a>.<\/p>\n<p>\u201cEvery single city and county in the state\u2063 will be held accountable \u200bfor building their fair share\u2063 of \u200dhousing. If we could get it done in Coronado, an island city where a military base and a port\u200d sits on more than half of it, we can \u200dget it done elsewhere, too,\u201d he said.<\/p>\n<\/blockquote>\n<p>As part of the settlement, \u2063the state\u2019s Department of Housing and Community Development (HCD), agreed to count 374\u2063 of the city\u2019s planned homes on the island\u2019s naval base towards their mandated goal, which is it zone for 912 units between 2021 and 2029.<\/p>\n<p>\u201cWe are glad \u200bto see the City of Coronado commit to bringing their housing element into \u2062compliance with Housing Element Law. (Mario Tama\/Getty \u200dImages)<\/figcaption><\/figure>\n<\/div>\n<p>Last year, Coronado legally challenged the state\u2019s mandate, arguing that zoning\u200c for over 900 units was\u200c unrealistic. \u2062They were joined in the legal action with the cities of Imperial Beach, Lemon Grove, and Solana Beach,\u200b who were also suing over their mandated plans, as reported by The Coronado Times, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/counting-down-the-worst-moments-of-the-medias-love-affair-with-michael-avenatti\/\" title=\"Counting Down The Worst Moments Of The Media\u2019s Love Affair With Michael Avenatti\">online news outlet<\/a>. Coronado lost in that case.<\/p>\n<p>In an interview\u2063 last year, Coronado Mayor Richard Bailey\u200b told the publication that after the state\u2019s last mandated plan for the years 2013\u2064 to 2020 where they were told\u2062 they had to\u200b zone for 50 more units, the city actually zoned for 600 and built 350 units.<\/p>\n<p>\u201cThis &#8230; cycle, \u2062we are required to allow for more than 900 units. Our \u2062zoning\u200c does not allow for that many \u200bnew units,\u200c so we would have to change our zoning if that &#8230; number holds,\u201d he said.<\/p>\n<p>Previously, the city\u2014which has a population of about 20,000 according to\u200d 2022 estimates by the \u2063U.S. \u200cCensus and where the current median price for a home\u2062 is $3.65 million and studios rent for $4,000 a month, according\u200b to the most rent \u2062data from the California\u2064 Association of Realtors and Zillow, respectively\u2014was also denied using the planned \u2062housing on its naval base \u2064to count towards \u2064their most recent plan, but was able\u200b to get that approved in \u200dthe settlement, Mr. Bailey said\u200d in the governor\u2019s press release.<\/p>\n<p>The state mandates are known as the Regional Housing Needs Assessment,\u200c or \u200bRHNA, and they come in eight-year cycles.<\/p>\n<p>\u201cGrappling with\u2064 a RHNA allocation that is\u200c much greater than in prior cycles, \u200cthe combined creativity of the City \u200band State was brought to bear for this workable\u2064 solution. With \u200ca shared goal of developing a meaningful and achievable plan to reach compliance, we\u2019ve found resolution to a years-long challenge,\u201d\u2063 he\u2063 said.<\/p>\n<p>Under the settlement, the city\u2014specifically its city council\u2014must adopt a compliant housing plan by April \u200c2024 and rezone \u200cby May, three years past the original deadline.<\/p>\n<p>Under the settlement, the city also agrees to not deny housing projects that\u2063 don\u2019t comply\u2063 with either the city\u2019s general plan or its zoning regulations, until an approved housing plan is adopted.<\/p>\n<p>Cities without an approved plan must allow developers,\u2063 whose projects meet certain affordability requirements, to bypass local zoning regulations or city-mandated \u200crules such as density limitations.<\/p>\n<p>The settlement also rules that the city will begin to receive fines if \u200cthe terms of the settlement haven\u2019t been fulfilled within 12 months.<\/p>\n<div class=\"post-figure\">\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Huntington Beach city officials gather with residents to\u200c discuss housing issues with the state in Huntington\u2063 Beach,\u2062 Calif., on Feb. 14, 2023. (John Fredricks\/The Epoch Times)<\/figcaption><\/figure>\n<\/div>\n<p>Huntington Beach is another \u200bcoastal city to \u2064recently challenge the state over its mandated housing objectives.<\/p>\n<p>It filed \u2063a lawsuit in March arguing the more\u200b than 13,000 units \u2064of housing they\u2019re required to\u2063 zone for is the largest allocation in the state and disproportionate to other\u2062 jurisdictions, such as San\u2062 Bernardino, which has a similar population to Huntington Beach\u2019s\u2062 200,000 and is five square miles \u2064larger. \u200bThat city, Huntington Beach\u2019s lawsuit \u2064says, is only being asked to plan for 8,000 units.<\/p>\n<p>City leaders also\u2062 use Huntington Beach\u2019s status as a charter city, which follows its own charter instead of general law, allowing more self-governing, as a reason for not following state housing laws.<\/p>\n<p>California is using \u201cunconstitutional legislative and administrative means &#8230; stripping \u200bCharter cities of their ability to make their own land use decisions,\u201d the city posted\u2062 on Facebook March 9.<\/p>\n<p>The state is counter-suing the city seeking full compliance.<\/p>\n<p> <\/p>\n<h2> \u2064 How many units\u200c does Coronado need to zone for between 2021 and 2029 to\u200b comply with \u200bthe state&#8217;s recommendations?<\/h2>\n<p><span>  L\u2014has agreed \u2063to \u200crevise\u200b its housing element to comply with\u200b the\u2063 state&#8217;s recommendations. \u2063This includes zoning\u2062 for 912 \u2063units between 2021 and 2029, \u2063with 374 of these units being \u200dcounted from \u2063the city&#8217;s planned homes on \u200cthe naval base.<\/p>\n<p>The settlement marks the end of \u2062a\u200b two-year legal battle between Coronado \u2064and the state. Coronado, along with \u200bseveral other cities, had challenged the state&#8217;s\u2064 mandate, arguing that zoning for over \u2063900 units was unrealistic. However, they were unsuccessful in their legal action and lost the case.<\/p>\n<p>Coronado Mayor Richard Bailey explained that in the previous cycle, the city was mandated to\u2062 zone for \u206350 more units but ended up zoning for 600 and building \u200d350 units. This time,\u2062 the city would have had to change its zoning\u2064 to accommodate the required \u2063number of \u200dunits. The city\u200c is committed to bringing its housing element into compliance with the Housing Element Law.<\/p>\n<p>Governor Gavin Newsom \u200demphasized the state&#8217;s focus on building \u2064more\u2063 housing to\u2063 support Californians. He stated that every city and county in the state will be held \u2062accountable for building their fair \u2063share of housing. The state\u200d is actively \u2063working to \u2062streamline construction processes and collaborate with communities to expedite housing development.<\/p>\n<p>Attorney General Rob Bonta\u2062 emphasized the significance of the settlement, stating that if Coronado can achieve\u200b compliance, any\u200b county or city in the state can also \u2064accomplish it. The settlement serves\u200c as\u2064 a valuable\u200c lesson for other jurisdictions, reminding\u2063 them that state leaders are willing and able to help\u2063 deliver housing for all \u200dresidents.<\/p>\n<p>Overall, the\u2064 settlement between Coronado and the state demonstrates a\u200c commitment to addressing \u200dCalifornia&#8217;s housing shortage and \u2063promoting\u2063 affordable \u200bhousing.
