Just last week, American Federation of Teachers President Randi Weingarten\u200b took to X, formerly Twitter, to \u200dremind people that her organization\u200c <em>always<\/em> advocated for reopening schools. She made this \u200bproclamation from\u2062 her lofty perch on the moral high ground and chided\u2062 those who have a different recollection of events.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"yuJkDi67dmN\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We&#8217;ve always advocated\u200d for safe reopening of\u200b schools. Our role in\u2064 <a href=\"https:\/\/twitter.com\/CDCgov?ref_src=twsrc%5Etfw\">@CDCgov<\/a> guidance was one of many voices. I live in\u200d Chester County, one of\u200d the wealthiest counties in\u2063 Pennsylvania and home to \u200dat least six \u200bof the top 50\u200d public schools in\u200c the state. \u2063 <\/p>\n<p>When the pandemic first hit, \u200bI took it very seriously.\u2063 One of my children has asthma, \u2062so I closely followed the news out of China beginning in early January 2020. I grew so concerned about \u2064the\u2062 catastrophic potential of the\u200c virus that I pulled my children out of\u200d school\u200c a week or so before the \u2064state government ordered it. But by the summer of 2020, after carefully studying \u2062the available evidence, I concluded that the virus was serious but entirely manageable for the overwhelming majority of the population, especially\u2063 kids.<\/p>\n<p>As that summer drew to \u200da\u200d close, \u2062Pennsylvania Gov. Tom Wolf continued to flex dubious emergency powers. He\u200c kept churches, schools, businesses, and restaurants\u200c closed or severely restricted well into the spring of 2021. \u2064Even when kids finally returned to full in-person learning in Pennsylvania, many public schools still had mandatory masking. Some schools (like mine) even required masks when kids were engaged in athletics\u200c \u2014 outdoors.<\/p>\n<p>Public officials enforced these draconian measures \u2063even as they had actual knowledge that lockdowns\u2064 and masking were \u200dcausing serious educational, physical, and psychological damage to children of all ages. The\u200d Unionville-Chadds Ford School\u2063 District, where my \u200dfour children were enrolled, demanded strict compliance with their unlawful policies \u200cover the objections of parents like me.<\/p>\n<div class=\"fdrlst__b89e9-1e677810f29daf3d9edb47841a7e03ce fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-1e677810f29daf3d9edb47841a7e03ce\"><\/div>\n<h2 class=\"wp-block-heading\">Forced \u200binto Politics from Private Life<\/h2>\n<p>Before Covid-19 invaded America, I was not politically active. In what \u2064little\u200d free time I had, I\u200d was active in my church, coached youth sports, and volunteered as \u2064a football coach at the \u200bhigh school. I moved my family from \u2063Wilmington, Delaware, to Unionville\u2063 when our <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-domestic-terrorists-like-me-cant-forget-public-school-covid-tyranny\/\" title=\"Why I, a 'Domestic Terrorist,' Can't Forget Covid Tyranny in Public Schools.\">eldest daughter started elementary school<\/a> because of the district\u2019s reputation for providing a phenomenal public education. My wife and I went to public school, we have several family members \u2064who work in public education, and one of \u2062my children wants to be\u200d a teacher. We were steadfast proponents\u200b of the value of public education.<\/p>\n<p>For more than 20 years,\u200d I \u200dhave\u200b practiced law. My first job out of law \u2062school was as a\u2062 clerk to \u200ca senior justice of the Delaware Supreme \u2064Court. I \u2063became \u2064a lawyer because I believed it was an honorable \u2064profession. \u200dLawyers throughout our\u2062 country\u2019s brief history \u2064have played\u2064 a \u2064pivotal role in everything from the Declaration of Independence to leading the fight for civil\u2062 rights. I \u2063believe lawyers have a special duty to rise up\u2064 when government encroaches on our\u2063 liberties. This was \u200bone of \u200dthose occasions.<\/p>\n<p>When Unionville officials decided not to reopen schools at \u200cthe beginning of the 2020-21 school year, I started attending school board\u200c meetings to voice \u2063my concern that school officials lacked the legal authority\u200b to cancel in-person classes. Then I demanded that those officials either \u200bprovide my \u200dchildren with their statutory \u200bright to in-person education \u2062or produce a legal opinion setting forth the legal authority to deny \u200dthat right. They ignored\u2064 me.   <\/p>\n<p>As the \u2064months wore on and\u2063 the \u2062damage to \u200dchildren deepened, I testified about the harmful consequences of unlawful policies before \u2064the education committee of \u200cthe Pennsylvania State Senate, which was chaired by Republican state Sen. Scott \u2063Martin. In retrospect, state legislators used the hearing to \u2064grandstand. Neither chamber ever passed any meaningful legislation in defense \u200dof parental rights.<\/p>\n<div class=\"fdrlst__b89e9-13bef9f157b8b87a6410131f734b6a5f fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-13bef9f157b8b87a6410131f734b6a5f\"><\/div>\n<h2 class=\"wp-block-heading\">Fighting\u2064 Mandatory Masking<\/h2>\n<p>At the beginning of the 2021-22 school \u2063year, Unionville officials announced that the school district would \u2062continue to enforce its mandatory masking policy. The school district enforced the\u2062 mandates against the\u200c will\u200c of those who\u200b no \u2062longer \u2062wished \u200bto have their children masked and did not believe the \u2063orders were lawful. I again publicly objected to the enforcement of this \u2064policy\u200d on the basis \u200cthat it violated Pennsylvania law. School officials still ignored me.<\/p>\n<p>I believed so strongly\u2062 that this policy was unlawful that in August 2021 I attended the first in<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/parents-apoplectic-after-oregon-school-board-goes-virtual-amid-gender-ideology-concerns\/\" title=\"Parents Apoplectic After Oregon School Board Goes Virtual Amid Gender Ideology Concerns\">-person school board meeting<\/a> in over a year. At the meeting, I challenged the school district to \u2064produce a legal opinion setting forth the precise source of \u2062statutory authority to enforce a masking policy that was \u2062causing serious,\u200d demonstrable harm to\u2062 children against the express will of many\u200c parents. <\/p>\n<p>As I was speaking, the entire \u200bschool \u2064board and the \u2064highly paid district superintendent walked out of \u2064the meeting \u200drather than address or even acknowledge my legitimate concerns. Four \u2063months later,\u2064 the state Supreme Court \u2062declared the\u2063 masking policy void on the exact legal basis I persistently asserted for more than a\u2064 year.<\/p>\n<h2 class=\"wp-block-heading\">School District Stonewalls Citizens and Senators<\/h2>\n<p>I never attended another school board meeting. Instead, \u2062I \u200bchose to fight \u200bthe battle by seeking public records through the Pennsylvania Right to Know Law and by writing articles on a local media website. \u2063The school district stonewalled me\u2064 at every turn. To make matters worse, the school district spent tens of\u200c thousands \u2064of taxpayer \u2064dollars (<em>my money<\/em>) on legal fees \u2064concealing public records and fighting my\u2063 efforts for transparency and accountability.   <\/p>\n<p>After being denied due process by the \u200cschool district for \u200bwell over a year, I\u2064 sought the assistance of Martin.\u200d He was then still the\u200d majority chair of the\u2064 Senate Education \u200dCommittee, which supposedly has oversight responsibility\u2064 for Pennsylvania public schools.\u2064 After meeting with me and reviewing\u200d my complaint, Martin made inquiries \u2063on my behalf.   <\/p>\n<p>True to form, Unionville officials ignored him too. When, more than\u200d a month later, \u200dno one had responded, I sent a copy of the senator\u2019s letter to the entire school board.\u200d When the superintendent and school board president finally responded, they arrogantly dismissed\u2063 the senator\u2019s inquiries and tacitly\u200d suggested he\u2063 should mind his own business.  \u2062   <\/p>\n<p>After several more months of delay and obfuscation, \u200dthe senator appealed the district\u2019s refusal to produce the records. On Dec. 9, 2022, the Pennsylvania Office of \u200cOpen Records denied the senator\u2019s request on the basis of an affidavit, submitted under penalty\u200b of\u2062 perjury, that school district officials had no clue what the senator was \u200ctalking \u2062about.   <\/p>\n<h2 class=\"wp-block-heading\">Parents and\u200c Public Schools Battle for Authority<\/h2>\n<p>Upon reading the \u2062final determination in <em><a href=\"https:\/\/www.openrecords.pa.gov\/Appeals\/DocketGetFile.cfm?id=109087\" target=\"_blank\" rel=\"noreferrer noopener\">Martin v. Unionville<\/a><\/em>, I \u2062knew I had evidence conclusively demonstrating that school district officials had flagrantly ignored their duty in an official proceeding. Under\u2063 state law,\u2062 they were required to produce plainly responsive records\u2062 that were in \u200dthe possession of the superintendent, the\u200b school district solicitor, and every member of the school board. Because I was not a party to that proceeding, however, \u2063I lacked standing to intervene or appeal. Despite \u2064my pleas that state legislators do something (<em>anything<\/em>) to address this misconduct, \u200cMartin\u200d shrugged his shoulders\u200c and told me there was nothing else he could do.   <\/p>\n<p>If there is any question about who controls the\u200d balance of power between parents and public schools, ponder this fact. The superintendent, lawyers, and every member\u200b of the school board in my \u200ddistrict stonewalled a state senator responsible for oversight of public schools, and there is apparently nothing he can do\u2062 about it. Education interest groups obviously control the purse strings\u2062 in Harrisburg, so parents like \u2064me are\u2064 left\u200d hanging time and again.<\/p>\n<p>Earlier this year, I submitted a\u2063 complaint \u2064to the Unionville school board setting\u200c forth detailed, well-documented allegations of misconduct \u2062by school district officials.\u2062 School district \u200bpolicy \u200crequires a \u201cfair and impartial\u201d review of my \u200dcomplaint \u200b(and the evidence supporting it), a hearing,\u200d and a written determination by the school board addressing every allegation. As\u2062 of today, months after\u200d I first submitted the \u200bcomplaint, school board officials are\u2063 still silent and ignoring their \u200clegal duties. \u2064   <\/p>\n<p>So much for\u2063 transparency\u2062 and \u200caccountability. Public school officials, from the highest level all the way down \u2062to \u200bmy suburban school district, can\u2019t be bothered with parents like\u200b me. They <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-lefts-push-to-cancel-conservative-media-isnt-fighting-disinformation-its-censorship\/\" title=\"The Left\u2019s Push To Cancel Conservative Media Isn\u2019t \u2018Fighting Disinformation.\u2019 It\u2019s Censorship.\">pay lip service<\/a> to\u2062 parental rights when they must, but their behavior makes it clear that they don\u2019t really think the rules apply\u2062 to\u200b them. After all, as Vice President\u200d Kamala Harris <a href=\"https:\/\/www.foxnews.com\/media\/kamala-harris-catches-flak-saying-students-are-our-children-late-night-talk-show\" target=\"_blank\" rel=\"noreferrer noopener\">reminded us recently<\/a> \u2014 our kids <em>actually<\/em> belong to the state.<\/p>\n<h2 class=\"wp-block-heading\">School Choice, the Ultimate \u2063Covid Reckoning<\/h2>\n<p>Our rulers want us to move on, especially those who got everything wrong over \u2063the last few years. No one will ever \u200dhold Garland\u2062 accountable for directing the FBI to \u2064monitor parents who \u200bhad\u2063 the audacity\u2064 to speak\u2062 out at\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jordan-threatens-fbi-director-wray-with-contempt-over-targeting-parents-catholics\/\" title=\"Jordan warns FBI Director Wray of contempt for 'targeting' parents, Catholics.\">school \u200dboard meetings<\/a>. Weingarten will avoid \u200dresponsibility for the serious harm to \u200cchildren caused\u2062 by the policies her organization aggressively advanced. \u2063Pennsylvania Gov. Josh Shapiro \u200creneged on his campaign promise to expand school \u200cchoice yet will\u2063 likely seek\u200c even \u2064higher office. <\/p>\n<p>Republicans in D.C., Harrisburg,\u2063 and even my community \u200daren\u2019t much better. They promise action on \u200deducation \u200cpolicy and pander to conservative voters every election season, but they rarely follow through.   <\/p>\n<p>Meanwhile, in his\u200d most\u200d recent performance evaluation, the school board\u2019s nine members unanimously rated my district\u2019s superintendent as \u201cDistinguished.\u201d The superintendent will keep his ridiculously lucrative contract and taxpayer-funded \u200bpension. The school board members will \u2064probably win reelection in a few weeks by people in my community who either \u200cdon\u2019t know or don\u2019t care that they ignored their legal duties. <\/p>\n<p>These very same public officials, from top to bottom, expect us to \u2062forget the past and\u2063 blindly trust them with\u2064 our \u200cchildren. But we cannot move on until \u200cthere is a reckoning for their unlawful acts, which caused \u2062real harm to an\u200b entire generation. The path to reconciliation is through comprehensive school choice reform, but the monied interests\u2062 in Washington and\u200b state capitols are doing everything they can to make sure \u2063that never happens.
