The\u200d lawsuit specifically claimed CBP personnel created \u2062numerous breach points along these rows of razor wire\u2062 near Eagle Pass, Texas,\u200c in September and October, as the town began dealing \u200cwith a surge\u2064 of illegal immigrants.<\/p>\n<p>The lawsuit \u200dalleges CBP personnel \u2062have \u200balso begun \u200battaching ropes to their pickup trucks to throw to \u200dillegal border crossers to help them climb up at steep points on the riverbanks\u200d on the\u200b Texas side of the\u200b Rio Grande.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<p>The \u2062lawsuit accuses the various defendants of\u2064 destroying Texas&#8217; property by cutting\u200c and removing the fences.<\/p>\n<p>The lawsuit also accuses the defendants of\u200c &#8220;trespass to chattels&#8221;\u2014a legal term describing \u200bone\u2063 party&#8217;s interference with \u200ca second party&#8217;s ability to use\u2064 its\u2062 property.<\/p>\n<p>The lawsuit also argues the various defendants exceeded their legal authority by cutting and moving aside the razor wire barriers.<\/p>\n<p>&#8220;No statute authorizes Defendants to destroy and\u2064 seize border \u2064infrastructure\u200c belonging \u200dto another sovereign in order to facilitate unlawful\u200b entry of aliens into the United States,&#8221; the complaint reads.<\/p>\n<div class=\"post-figure\" style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>A migrant from Venezuela prays as he\u2064 waits for a U.S. Border Patrol agent to cut \u2063the razor wire after he crossed the \u2064Rio Grande to Eagle Pass, Texas, on Sept. 24, 2023. (Andrew Caballero-Reynolds\/AFP via Getty Images)<\/figcaption><\/figure>\n<\/div>\n<p>The lawsuit further argues that the DHS is bound\u200c by the Administrative Procedures Act to give notice and allow for\u200d public comment before cutting\u2063 and removing the razor wire barriers.<\/p>\n<p>Mr. Paxton is seeking an\u2064 injunction to\u200b prevent DHS personnel from continuing to\u2062 cut through Texas&#8217; razor wire barriers for the duration of the lawsuit and \u200dis asking for \u200ba judge to ultimately rule that the\u200d efforts by DHS personnel to cut through Texas&#8217; razor wire\u200d barriers\u200c are unlawful.<\/p>\n<p>\u201cTexas\u2064 has \u200cthe sovereign right to construct border barriers\u2063 to prevent\u2064 the entry of \u200cillegal aliens,\u201d \u2062Mr.\u2063 Paxton said on Tuesday\u200d as he announced the lawsuit.<\/p>\n<p>\u201cAmericans across\u200d the country were horrified to\u2063 watch Biden\u2019s open-border \u200bpolicy \u200bin action: agents were physically cutting wires and assisting the aliens\u2019 entry into our \u2064state. This is\u2062 illegal. It puts \u2063our country and our citizens at risk. (John Moore\/Getty Images)<\/figcaption><\/figure>\n<\/div>\n<p>In response to an NTD \u200dNews request for comment, a\u200c DHS spokesperson said the department does not comment on pending litigation but said Border Patrol agents generally have \u200ca\u200d responsibility \u200cto\u2063 take illegal\u2062 border crossers into custody once\u2064 they set\u2062 foot on U.S. soil.<\/p>\n<p>The DHS spokesperson said <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/faced-with-a-coming-wave-of-illegal-immigration-bidens-plan-is-simply-to-open-the-border\/\" title=\"Faced With A Coming Wave Of Illegal Immigration, Biden\u2019s Plan Is Simply To Open The Border\">federal border officials<\/a> are also generally required to act &#8220;when there are \u2064conditions that put our workforce\u200b or migrants at risk.&#8221;<\/p>\n<p>In a \u2062statement following\u200c the June wire-cutting\u2063 incident, a CBP spokesperson similarly\u200d told NTD News\u2062 that federal border personnel were acting in line with their duties to apprehend and process people who had already crossed\u200d over to the U.S. side \u200cof the Rio \u2064Grande.<\/p>\n<p>&#8220;The individuals had already crossed the Rio Grande from Mexico, \u2062were on U.S. soil, and are \u2064subject to U.S. immigration \u2062laws,&#8221; the CBP \u200dspokesperson said at the\u200c time\u200b of the \u2064June incident.<\/p>\n<p>&#8220;Individuals\u2063 who cross unlawfully\u200b will be \u2062subject to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congress-must-break-immigration-courts-free-from-doj-bureaucracy-to-survive-judge\/\" title=\"Judge: Congress must free immigration courts from DOJ 'bureaucracy' to survive.\">lawful pathways rule<\/a>, \u200bwhich <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-responds-to-feds-cutting-through-razor-wire-to-let-illegals-into-texas\/\" title=\"Biden administration reacts to federal action allowing unauthorized entry into Texas.\">places common-sense conditions<\/a> on asylum eligibility, with certain exceptions.
