The court \u2063determined that these regulations should have been\u200d issued as properly\u200b promulgated Administrative \u200cProcedures Act (APA)\u2064 rules.<\/p>\n<p>Despite the trial court&#8217;s ruling in October 2022, Benson sought to keep the \u200dguidance in place for the \u2063November \u2062midterms. The Michigan Supreme Court, controlled by Democrats, allowed the unlawful guidance to\u2064 be used, disregarding the objections of dissenting justices who agreed with the trial court&#8217;s analysis.<\/p>\n<p>This is not the \u2062first time Benson\u2062 has been found to have violated Michigan law. They contended that the guidelines imposed unreasonable restrictions on\u2063 poll challenger activities, impeding their \u2062ability to protect the integrity of the voting \u200cprocess.<\/p>\n<p>In response,\u200c the Secretary of State&#8217;s office defended the guidance, asserting that it was necessary to ensure the smooth functioning of polling locations and to prevent voter intimidation.
