Suppression \u200cof Free Speech on Social Media<\/h2>\n<p>In a decision that conservatives\u2063 are mostly applauding, the Supreme Court will hear a case that will set a precedent on \u200dhow far the\u2062 government can go \u200bin \u2064suppressing free speech on social media.<\/p>\n<p>On Friday, the nation\u2019s \u200chighest court \u2063announced it\u200d had issued a writ of certiorari in a case known by various names that basically pits the states of \u2064Louisiana and Missouri against the\u2064 Biden\u200c administration,\u200b in which the states aimed to curtail the federal government\u2019s goading of \u200dplatforms\u200d such\u200d as\u200d Facebook, YouTube and Twitter\/X to censor unpopular opinions without directly telling\u2063 them to \u2014 which would\u200b be an obvious breach of the First Amendment\u2019s protection of freedom of speech.<\/p>\n<p>Louisiana Solicitor\u2063 General Liz \u2063Murrill hailed the decision \u200bin a statement Friday.<\/p>\n<p>\u201cWe \u200care pleased to learn that the U.S.\u2062 Supreme \u2064Court will hear this case, \u2063giving us \u2062yet\u200d another opportunity to defend the people \u200bfrom this assault on our First Amendment rights,\u201d Murrill said.<\/p>\n<p>\u201cIt brings us one step closer to reestablishing the protections guaranteed to us \u2062in the Constitution and under the First Amendment,\u201d\u2063 she said.<\/p>\n<p>\u201cWe hope that\u2064 the Supreme Court will agree that this gross\u2064 abuse of power must stop and never happen again.\u201d<\/p>\n<p>The lawsuit, initially filed by Louisiana Attorney\u200d General Jeff Landry and\u200d Missouri Attorney General \u2064Eric \u2062Schmitt in May 2022, dealt with how the government \u2063put pressure on tech giants to censor certain \u2062information, particularly as it related\u2064 to the COVID-19 pandemic\u200d \u2014 \u200band the efficacy of and\/or dangers potentially posed by mask-wearing, vaccines and other measures.<\/p>\n<p>In a ruling on\u200d July 4, U.S.\u200d District Court Judge Terry\u200b Doughty\u200d fired the first shot in the legal volley on the case, issuing a decision that blocked \u200ba number of federal agencies \u2014 specifically, the Department of \u2062Health and Human Services, the National Institute of\u2063 Allergy and Infectious\u200d Diseases, the Centers for\u2063 Disease Control and Prevention,\u2064 the U.S. Census Bureau, the FBI\u200c and the Department of Justice \u2014 from interacting with companies in a \u200bway that\u200b could \u2062be\u200d construed as \u201cencouraging, pressuring, or inducing in any\u200b manner the removal, \u200cdeletion, \u2064suppression, \u200bor reduction\u2063 of\u2062 content containing protected free speech.\u201d<\/p>\n<p>In September, according\u2064 to The Associated Press, the \u200d5th U.S.\u2063 Circuit Court of Appeals in New Orleans ruled mostly in\u2063 favor of the two states while it \u201ctossed out broader \u2063language\u2062 in an order that a Louisiana-based federal judge had issued July 4 that effectively blocked\u200b multiple government\u200d agencies from contacting platforms like Facebook and X (formerly Twitter) to\u2064 urge the removal of\u2062 content.\u201d<\/p>\n<p>And here we \u200bcome to the \u2062part that has conservatives only mostly applauding\u200c the decision to grant\u2064 a writ of certiorari to hear \u200bthe case: According \u200bto CBS News, while the case is being\u200c presented to the \u2062nation\u2019s highest bench, \u200cthe injunction issued by Doughty will be\u2063 paused, period.<\/p>\n<p>Three justices on the conservative end of the bench \u2064\u2014 Justices Samuel Alito, Neil Gorsuch and Clarence \u200dThomas \u2014 signed on\u200d to a\u200b dissent of the stay of the injunction.<\/p>\n<p>\u201cDespite the \u200bGovernment\u2019s conspicuous failure \u200cto \u200bestablish a \u200dthreat of irreparable harm, the majority \u200bstays the injunction\u200b and thus allows the defendants to persist in committing \u2064the type of First Amendment violations\u200d that \u2062the lower courts identified,\u201d Alito wrote in the dissent. \u201cThe majority takes \u2062this action\u200b in the face of the lower courts\u2019 \u2062detailed findings of fact.\u201d<\/p>\n<p>\u201cApplying \u2062our settled test for granting a stay, I would\u200b deny\u2062 the Government\u2019s application,\u2063 but I would specify in \u200dthe order that in the\u200b unlikely event that a concrete occurrence presents a risk of irreparable harm, \u200cthe\u200c Government can apply \u200bfor relief at that time, including, if necessary, by filing an emergency application here,\u201d \u200che continued. \u201cSuch an order would fully \u200dprotect the ability of Executive Branch officials to speak out on matters of public concern.<\/p>\n<p>\u201cAt this\u2062 time in the history of our country, what the Court has done, I fear, will be seen by some \u2062as giving \u2064the Government a green light to use <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-taps-u-s-attorney-opposed-to-prosecution-of-drug-dealers-and-thieves\/\" title=\"Biden Taps U.S. Attorney Opposed to Prosecution of Drug Dealers and Thieves\">heavy-handed tactics<\/a> to skew\u200d the presentation \u200dof views\u2064 on\u200c the medium that increasingly dominates the dissemination of news.\u2063 That is most\u200b unfortunate.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Justice Alito continued:<\/p>\n<p>\u201cMoreover, it does not appear that any\u2062 of \u200bthe Government\u2019s hypothetical \u2062communications would actually be prohibited \u200bby\u200d the injunction. Is a swampy, angry unelected government apparatchik promising to make themselves\u200c a nuisance to you if\u2063 you don\u2019t do what they so clearly want you\u2062 to do any different\u200b from \u2064a government \u200ddirective?<\/p>\n<p>That\u2019s what the Supreme Court will decide, and \u2062one hopes the decision\u200c is \u200dan easy\u200d one.<\/p>\n<p>Yes, the administration will certainly make \u2062the argument\u2062 that its\u200d obvious intimidation of these tech giants didn\u2019t constitute de\u200c jure suppression of speech, but de facto government intimidation ought to be reason enough to prohibit the\u200c kind of behavior this lawsuit\u200d seeks to\u2063 end.<\/p>\n<p>Friday\u2062 was likely \u200djust the first step in a long and grueling process for conservatives and\u200c other free speech proponents to claw back our most precious of rights as Americans from nanny-state bureaucrats and pusillanimous tech companies \u2063who know the only entity more powerful and monopolistic than themselves is the government.<\/p>\n<hr>\n<h3>A Note from Our\u2064 Founder:<\/h3>\n<p>Silicon\u200d Valley \u200cand the Big Tech tyrants have done everything they can\u2063 to put The Western Journal out of business.
