Powell was specifically accused of\u2062 involvement in a data forensics company, SullivanStrickler, copying\u2063 data from election machines and computers in Coffee County, Georgia\u200c without authorization on January 7, 2021. However, Rafferty previously argued that this claim was false and lacked\u200c evidence.<\/p>\n<div class=\"my-5\">\u201cThere are\u200b no communications\u2062 of any kind \u200cbetween Ms. Powell and any\u2062 of the\u200d alleged coconspirators or unindicted coconspirators that evince any agreement \u2064by Ms. Powell \u200bto have SullivanStrickler\u200c personnel travel to Coffee County or to contract for their services for Coffee County\u2014much less \u200cto do so for \u200bany illegal purpose,\u201d he <a href=\"https:\/\/www.theepochtimes.com\/us\/sidney-powell-paid-for-georgia-election-machine-examination-upon-threat-her-lawyer-says-5501009\" target=\"_blank\" rel=\"noopener\">stated<\/a> in a previous \u200bcourt filing.<\/div>\n<p>Rafferty acknowledged that Powell&#8217;s non-profit organization, Defending the Republic Inc., paid \u2064a bill from SullivanStrickler, \u2062but he emphasized that it was\u2063 done in response to the company&#8217;s\u200b threat to publicly\u200b disclose information collected from Coffee County machines.<\/p>\n<p>According \u200cto Harvey \u2062Silverglate, the lawyer for co-defendant John Eastman, \u2062Powell is \u2062innocent and\u200b was attempting to avoid an \u200dunjust conviction based\u200c on an &#8220;unfair&#8221; law.<\/p>\n<p>\u201cThis is how\u2062 prosecutors\u200d operate. They \u2062charge, they overcharge, \u200cincluding \u2064charging innocent people,\u201d Silverglate\u2062 told The Epoch Times.<\/p>\n<p>He\u200d argued that\u2062 conspiracy cases are more difficult to defend against compared to substantive criminal cases, as\u2062 any actions taken by members\u2064 of the\u200c conspiracy can be\u2062 attributed \u200bto all involved.<\/p>\n<p>\u201cThat&#8217;s why conspiracy law\u2062 is so \u2062unfair,\u201d he said.<\/p>\n<div class=\"my-5\">The Georgia RICO law, which Powell is\u2063 being charged \u2062under,\u2063 is broad and \u200bpowerful, but\u2062 it\u2062 can also be susceptible to abuse by prosecutors, experts previously <a href=\"https:\/\/www.theepochtimes.com\/article\/georgia-rico-law-broad-enough-for-trump-case-and-also-for-abuse-experts-indicate-5494488\" target=\"_blank\" rel=\"noopener\">noted<\/a>.<\/div>\n<p>In \u2064addition to probation \u2064and a fine, Powell agreed to write an apology letter to the\u2064 people\u2062 of Georgia and \u2064testify against\u2064 the other defendants.\u2062 She is\u2063 also prohibited from speaking to the media until \u200dthe \u2062conclusion\u200d of the \u200ctrial, \u2062which \u2062will be divided into multiple separate trials and is expected to take a significant amount \u2063of time.<\/p>\n<p>The crucial\u2063 question is what Powell will say when\u200c called to testify, according to Silverglate.<\/p>\n<p>\u201cIs she going to\u200c tell the truth, or \u200cis she\u200b going \u200dto \u200bsay something to satisfy Fani Willis?\u201d he questioned.<\/p>\n<p>While it\u2063 may be \u200ddifficult to reconcile Powell&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-to-pardon-gen-michael-flynn-per-report\/\" title=\"BREAKING: President Trump to Pardon Gen. Michael Flynn, Per Report\">guilty plea<\/a>\u200d with\u200b Rafferty&#8217;s previous claims, Silverglate explained that she \u200ccould simply \u2063state that she\u2064 was \u200dpreviously lying and is now telling the truth, even \u200bif it is not actually the truth.<\/p>\n<p>Furthermore, the plea \u200cagreement effectively forces \u200bPowell \u200cto\u2064 align\u200d her testimony with the version of events presented by the prosecutors.<\/p>\n<p>\u201cThey probably \u2062already have,\u200c I&#8217;m sure, interviewed\u200d her \u200dand\u2064 probably \u2062done so under oath. So if she changes her testimony from what she told \u200dthe prosecutors in order \u2064to\u200b get the \u200cplea \u2064deal, she&#8217;d \u2064be indicted \u200dfor perjury,\u201d\u2063 Silverglate\u2062 added.<\/p>\n<p>According to Silverglate, this practice of shaping \u2064witness testimony to fit the prosecutor&#8217;s\u2064 narrative is common and referred\u200c to as making the witness \u200c&#8221;compose&#8221; rather than simply &#8220;sing&#8221; for the prosecutors.<\/p>\n<p>\u201cYou\u2062 understand that the whole system is \u200dcorrupt? That if I made\u2063 a deal\u200c like that with a witness, I would be indicted for subornation of perjury, witness bribery, but prosecutors do it every day, and \u200cthey do it \u2062with complete\u2064 impunity?\u201d he expressed.<\/p>\n<div class=\"my-5\">\u201cIt&#8217;s been considered\u200d in our justice system\u2063 to be\u2064 the way the \u2062government gets\u2064 people to testify. In my experience, this is the \u2064way the government gets them \u200cnot only to sing but also\u2063 to compose. This rewarded testimony is more often false than it&#8217;s true, in my long\u2064 experience. I&#8217;ve been doing \u2062this since \u200b1967 and I&#8217;ve heard very few turned government\u2064 witnesses,\u200d rewarded \u200cgovernment witnesses tell the truth, the whole\u2063 truth, and nothing \u2063but the\u2064 truth.\u201d<\/div>\n<h2>Tricky Conspiracy<\/h2>\n<p>Conspiracy charges are\u200d unique \u2064in that they do not \u200brequire\u200c defendants \u200bto \u2064actually commit the\u200c underlying crime\u2063 or even play a significant \u200brole in its completion.\u2064 Prosecutors only\u200c need to establish, at least circumstantially, that there was an agreement\u200b between\u200d two or more individuals to engage in illegal activity, and that at least one of them took some action to further the conspiracy.<\/p>\n<p>An \u2062overt act can be minor and\u200c seemingly innocent\u2062 on its own. For example,\u2063 Willis has claimed that sending \u2062a text message with \u2063an airport \u2064address constituted an &#8220;overt act&#8221; \u200dbecause it allegedly \u200cfacilitated the arrangement of \u2064someone being picked up from the airport \u200bto participate in\u2064 accessing the election \u200cmachines in Coffee \u200cCounty, which \u200dwas supposedly done without proper authorization.<\/p>\n<p>In the Trump case, Willis alleged that \u200bmany of the\u2062 underlying crimes were not just planned but actually carried out, including lying to \u2063public officers, soliciting public officers to violate their oath of\u2062 office, and \u2064influencing a witness.
