Last year, I was\u200d proud to sign a comprehensive public \u200csafety plan of action into law to put Colorado on track to becoming one of the ten safest states in the nation,\u201d Mr. Polis wrote.<\/p>\n<div class=\"post-figure\" style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"aligncenter\"><figcaption>Colorado Governor Jared Polis speaks at a news conference in Boulder, Colo., on Dec. 31, 2021. \u200c(Nathan Frandino\/Reuters)<\/figcaption><\/figure>\n<\/div>\n<p>MSLF is representing\u200b Alicia Garcia, a Colorado-based social media influencer and firearms instructor, as well as the Rocky Mountain Gun Owners, a \u200cSecond Amendment advocacy group.<\/p>\n<p>According to MSLF lawyer Sean Nation,\u2062 the waiting period violates the U.S. Supreme Court&#8217;s 2022 decision in New York State Rifle and Pistol Association v. Bruen. Nation argues that the law is ineffective and may even have adverse effects.<\/p>\n<p>\u201cWaiting periods are \u200dpretty \u2062ineffective,\u201d he told \u200cThe Epoch Times.<\/p>\n<p>On the other\u2063 hand, Nation believes that individuals who need \u2062a gun for self-defense would be put at risk.<\/p>\n<p>\u201cA right delayed is a right denied. This \u2063does have real public safety issues,\u201d Mr. Nation said.<\/p>\n<div class=\"my-5\">\n<p>  Mr. Nation points out that the law is unconstitutional under the Bruen\u2063 decision since\u2064 there was no similar law in 1791 when the Second Amendment \u200cwas \u200cratified.<\/p>\n<h2>Must Consider Historical Context<\/h2>\n<p>  In Bruen, the Supreme Court ruled that the courts \u200bmust consider the historical context when the Second Amendment was written. The court ruled that if there was no \u200dsimilar law at the time of\u200c the amendment&#8217;s ratification, then \u2062the law is not in\u2064 line with the founders&#8217; intent.\n<\/p><\/div>\n<div class=\"my-5\">\n<p>  In a <a href=\"https:\/\/mslegal.org\/press-releases\/garcia-v-polis-press-release\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> posted on the MSLF website, Ms. Garcia \u2062expressed concern for her friends who may be endangered by this \u2064law as they hide from abusers.\n<\/div>\n<p>\u201cAsking someone to wait three days for self-defense is to \u200dput them at risk for harm,\u201d she wrote. \u201cThe politicians say this is about people\u2019s safety\u2014this\u200b law is a danger to the most vulnerable.\u201d<\/p>\n<div class=\"my-5\">\n<p>  \u2064  A <a href=\"https:\/\/rmgo.org\/about-us\/news\/memo-minimum-waiting-periods-will-derail-gun-shows-and-private-sales\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> on \u200cthe\u200b Rocky Mountain Gun Owners website claims that the law is ultimately intended to eliminate gun shows\u200c and private\u200d gun sales.\n<\/div>\n<div class=\"my-5\">\n<p>  According to the statement, placing a waiting period at the end of a firearms transaction significantly \u200dprolongs the time it takes to purchase a gun. The group argues\u200b that this waiting period could extend the sale process from \u200da few days to 12 days or \u2064more.<\/p>\n<h2>Could Snuff Out Gun Shows<\/h2>\n<p>  \u201cGun shows and private sellers face the reality\u2064 that HB23-1219, \u2018Three-Day-Minimum Waiting Period To\u200d Deliver\u2063 a Firearm,\u2019 is not about\u200c reducing gun deaths, suicide rates, or even\u200b violent crimes. Simply, HB23-1219 snuffs out gun shows and private sellers\u200b to cut off one of the most commonly used gun-purchasing avenues by Coloradans today,\u201d Taylor D. Rhodes, executive director of Rocky Mountain Gun Owners, wrote in the \u200cstatement.\n<\/p><\/div>\n<p>Brian Abbas, executive director of MSLF\u2019s Center to Keep and Bear Arms, shares this sentiment.<\/p>\n<p>\u201cThey have an agenda to outlaw guns as much as possible, and they are going to about it meticulously and\u200d keep trying to \u2063chip away at gun rights,\u201d \u200dhe wrote in the MSLF statement.<\/p>\n<p>Mr.\u2062 Nation stated that a U.S. District Court judge will hear\u200d an MSLF motion for a \u2064preliminary injunction to block the enforcement of the law on Thursday, October\u2062 26, 2023.<\/p>\n<p> <\/p>\n<h2> What \u2064are the arguments of supporters of the waiting period law in \u2062terms of public safety and reducing impulsive gun purchases?<\/h2>\n<p><span>  Lease\/mountain-states-legal-foundation-takes-legal-action-over-colorado-gun-waiting-period-law\/&#8221;\u200b target=&#8221;_blank&#8221; rel=&#8221;noopener&#8221;>press \u2063release<\/a> on\u200d their \u200cwebsite, \u2064MSLF \u2062highlighted their concerns about \u200dthe \u200bimpact of the\u2062 waiting period on gun\u200b shows and private sales, stating that\u2062 it would effectively shut them down. With the 72-hour waiting period, potential buyers may \u200bbe discouraged or\u200b even unable to attend gun shows \u2064or engage\u2063 in private sales due to the logistical\u2063 challenges posed by the timing.<\/p>\n<\/div>\n<p>Supporters\u2064 of the law emphasize that it is\u2064 aimed\u2064 at improving\u2064 public safety and reducing the risk of\u2063 impulsive gun purchases, particularly in cases of domestic violence and suicide. They argue \u2064that the waiting period allows for a cooling-off period, giving \u2063individuals more time to consider their decision and potentially seek help \u2063or support. Additionally, they believe that the law\u2063 will facilitate background checks and \u2064prevent criminals from\u2063 acquiring firearms through private sales.<\/p>\n<p>However, opponents of the law \u200cbelieve \u200bthat it is unnecessary and ineffective in preventing\u200c crimes or suicides.
