The plaintiffs are represented by\u200d Roberta Kaplan, \u2062the same attorney who represented\u200d E. Jean Carroll in her successful sexual battery and \u2063defamation suit against Mr. Trump.<\/p>\n<blockquote>\n<p>U.S. District Judge Lorna G. (Drew Angerer\/Getty \u2064Images)<\/figcaption><\/figure>\n<\/div>\n<p>Trump responded to Tuesday&#8217;s order by declaring victory and alleging that Ms. Kaplan \u200bwas a &#8220;Far Left&#8221; lawyer\u2063 and\u2062 suggesting \u200cher case was an attempt at election interference.<\/p>\n<p>&#8220;Today we had a Total \u200band Complete Victory against Far Left Lawyer, Roberta Kaplan,\u2062 on her ridiculous ACN\u200c Class\u200b Action Suit, yet another Election Interference Case,&#8221; he said on TruthSocial. &#8220;It was ruled that there can \u2063be no Class Action, and Certification was denied!&#8221;<\/p>\n<p>Ms. Kaplan did not respond to The Epoch Times&#8217; multiple requests for comment. According \u2063to its website, her firm\u2014Kaplan, Hecker,\u2062 and \u2062Fink LLP\u2014also represented Mr. Trump&#8217;s niece, Mary\u200b Trump, in a lawsuit \u200calleging that the former president and his children attempted to defraud Ms. Trump of a share of her \u200bfather&#8217;s inheritance.<\/p>\n<p>Three of Mr.\u2062 Trump&#8217;s children\u2014Ivanka, Donald Jr., and Eric\u2014were also named as defendants in the initial complaint\u2064 brought by Ms. Kaplan. It alleged\u2063 that the Trumps &#8220;conned&#8221; four plaintiffs &#8220;into\u2062 giving up hundreds\u200d of thousands of dollars\u2014losses that \u200bmany experienced as devastating and life-altering.&#8221; Judge Schofield signed an order in 2023 releasing the\u200b Trump children as defendants but said their depositions and \u2064discovery responses could be used in the \u2063trial.<\/p>\n<p>The Trumps pushed for arbitration\u2063 based on a clause in ACN&#8217;s \u200cagreement with plaintiffs. The company itself is not a defendant but featured Mr. Trump in its promotional materials. An appeals court ruled that &#8220;there is no evidence to suggest that\u2064 the plaintiffs treated the defendants as if they were effectively parties to the \u2026 agreement.\u201d<\/p>\n<p>The ACN case comes as the former president is\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rapper-travis-scott-facing-multiple-lawsuits-over-astroworld-festival-carnage\/\" title=\"Rapper Travis Scott Facing Multiple Lawsuits Over Astroworld Festival Carnage\">facing multiple lawsuits<\/a> in New\u200d York, the District of Columbia, and Georgia.<\/p>\n<p>On Monday, Judge Chutkan issued a gag order prohibiting him from speaking about certain parties to the case. Mr. Trump derided the gag order as\u2064 unconstitutional and vowed to repeal the case,\u2062 which he\u2062 has framed \u2064as part of a broader set of politicized attacks on him. He&#8217;s repeatedly blasted Judge Chutkan, who is overseeing his case in Washington, and noted that she was appointed by President Barack Obama\u2014something she shares with Judge Schofield.<\/p>\n<p> <\/p>\n<h2> What is the significance of\u2064 the denial of class action \u2064certification in this lawsuit against Trump<\/h2>\n<p><span>  Ory,&#8221; Trump tweeted. &#8220;I was \u200csued \u2063by\u200c the Radicals when I ran for President, and I won. They argue \u200cthat Trump&#8217;s statements were fraudulent and that they \u2062suffered\u2062 financial losses as \u2064a result.<\/p>\n<p>In her\u2063 ruling, \u2062Judge \u200cSchofield determined that \u2063the plaintiffs did \u200dnot meet \u2063the requirements for class certification.\u2062 She stated that there \u2063was no common evidence showing that the putative class members enrolled\u200d in \u2063ACN because of Trump&#8217;s alleged misstatements.
