This rule aims to crack down \u200don states whose industries are\u2062 believed \u200dto be contributing to smog.<\/p>\n<div class=\"my-5\">\n<p>The emergency application in Ohio\u2063 v. Environmental Protection Agency (court file 23A349) was \u2064docketed \u2063by the court on Oct. 18. To prevent these harms, the Court should step in now.&#8221;<\/p>\n<p>The federal\u200c Clean Air Act establishes a competitive-federalism scheme, where states and\u2062 the EPA share responsibility for the nation&#8217;s air quality. Each state\u200c has the authority to develop its own plan to prevent\u200b emissions from significantly affecting air quality in other states, according to Ms. Sridharan.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<\/div>\n<p>The EPA reviews each state plan, but the\u2064 review process is\u200d supposed\u200b to be deferential to the state. The law states\u200d that &#8220;if\u200b a State&#8217;s plan meets statutory requirements, the EPA &#8216;shall \u200bapprove&#8217; it, \u2062regardless of whether the EPA has a better idea for how to accomplish the Act&#8217;s goals,&#8221; she explained.<\/p>\n<p>In other words, &#8220;the EPA can only impose a federal plan if a State fails to submit a compliant \u2062plan,&#8221; but the \u2062agency has a different interpretation.<\/p>\n<p>At the\u2064 beginning of last year, the EPA \u2064announced its rejection of air quality plans from \u2063about \u200chalf of \u200cthe country&#8217;s states and introduced its own federal plan that favored a nationwide approach to emissions reductions.<\/p>\n<p>Despite objections, the EPA finalized \u200cits &#8220;Federal &#8216;Good Neighbor Plan&#8217; for the 2015 Ozone National Ambient Air Quality&#8221; regulation on June 5. The \u200cplan imposes emissions standards on &#8220;23 upwind states,&#8221; according to Ms. Sridharan.<\/p>\n<p>&#8220;However, due to litigation and interim rulemaking, a\u2062 dozen of\u2062 those states and over three-quarters of the emissions targeted by the plan are already exempt. Nevertheless, the\u2063 EPA insists that its federal plan should\u200c still apply to the remaining\u200c states.&#8221;<\/p>\n<p>Ohio&#8217;s deputy solicitor general argues that \u2062the Supreme Court \u2063should stay the rule because the challenging states are likely to succeed in court. She states that the regulation is already a failed \u200bexperiment, as it applies to less \u2063than half of the states and only a fraction\u200c of the emissions it aimed to\u2063 regulate.<\/p>\n<p>&#8220;In reality, the federal \u2063plan was always doomed; the EPA&#8217;s attempt to work around the\u2063 Clean Air Act&#8217;s structure of cooperative federalism was never going \u2063to succeed,&#8221; she added.<\/p>\n<p>Several federal \u200dcourts of appeal have already stayed seven of \u200bthe EPA&#8217;s disapprovals of state clean air plans, some\u200b even before\u2062 the federal plan was finalized, according to the application.<\/p>\n<p>The EPA defended the rule, emphasizing that it would reduce ground-level ozone and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-trucking-group-sues-state-over-wildly-unrealistic-new-zero-emissions-rule\/\" title=\"California trucking group sues state over 'unrealistic' zero-emissions rule.\">improve air\u2062 quality<\/a> for millions\u2064 of people.\u200b However, Republicans on Capitol \u2064Hill have criticized the regulation, claiming it unfairly targets energy suppliers and industrial regions.<\/p>\n<p>Other emergency applications seeking to stay the rule are also \u2062pending in the Supreme Court, including Kinder Morgan Inc. v. EPA (court file 23A350) and American\u2062 Forest \u200band Paper Association \u2064v. EPA (court file 23A351).<\/p>\n<p>Additionally, at least 17 petitions for review of the EPA rule are currently before the Supreme Court. The timeline for the court&#8217;s\u200b action on the \u200cemergency application remains uncertain.<\/p>\n<\/blockquote>\n<p> <\/p>\n<h2> What are \u200cthe potential economic impacts and electric grid emergencies that the coalition claims will \u2064arise from the implementation of the EPA&#8217;s\u200b plan<\/h2>\n<p><span>  T aimed to combat air pollution caused by emissions from power plants. This plan became known\u2062 as the &#8220;good neighbor&#8221; rule.<\/p>\n<p>The\u200b purpose of the &#8220;good neighbor&#8221; rule is to ensure that states take responsibility for\u200b the air \u2063quality impacts of their emissions and prevent their pollution from affecting other states. It requires states to limit their emissions of ozone and other \u200cpollutants that contribute to smog and haze. If a state fails to develop an adequate plan to \u200caddress these emissions, the EPA can impose its own plan to ensure compliance with the Clean Air Act.<\/p>\n<p>However, \u200dthe coalition of Republican-led states\u200b and the energy industry argues that the\u200b EPA&#8217;s interpretation\u2063 of the\u2062 &#8220;good neighbor&#8221; \u2064rule \u200bgoes beyond its authority and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-rogan-thinks-he-knows-what-california-school-was-trying-to-do-to-his-5-year-old\/\" title=\"Joe Rogan believes he understands the intentions of the California school towards his 5-year-old.\">imposes unnecessary burdens<\/a> on states and industries. They claim that\u2064 the EPA&#8217;s \u2062plan\u200b will have\u200d significant economic impacts and could even lead to emergencies in \u200cthe electric grid.<\/p>\n<p>The coalition has \u2064filed an emergency application to the Supreme Court, urging Chief Justice John Roberts to \u200dtake immediate action\u2062 and block the implementation of the EPA&#8217;s plan. According to Ohio Deputy\u2062 Solicitor General Mathura Sridharan, the plan inflicts irreparable economic\u2064 injuries on the states and other stakeholders. She also warns that the plan could cause electric-grid emergencies as \u2062power suppliers \u200bstruggle \u200cto comply with its terms.<\/p>\n<p>Ms. Sridharan argues that the Clean Air Act establishes a system of cooperative\u2064 federalism, where states and the EPA share responsibility for protecting the nation&#8217;s \u2064air quality.
