When a new \u200battorney general is\u2062 confirmed by the Senate to oversee the Justice Department, the attorney general has the authority to &#8220;essentially rewrite&#8221; how parts\u200c of immigration policy are interpreted and enforced, \u200bTsankov said.<\/p>\n<p>&#8220;Control over the courts has resulted in extreme pendulum swings across subsequent administrations,&#8221; Tsankov said. &#8220;Our judges must navigate their judicial responsibilities on the one hand, and heavy political scrutiny on the other.&#8221;<\/p>\n<p>That rewriting of how an administration \u2062wants to carry out\u200c existing \u200cimmigration laws\u200b has led to two problems: opening \u200djudges to political pressure for not abiding by\u200c one\u200b administration&#8217;s instruction and increasing the likelihood that an immigrant appeals a judge&#8217;s decision.<\/p>\n<p>&#8220;[For] all\u200b of the parties that are appearing before\u2063 us, [it] also\u200c creates incentives to appeal \u200bunfavorable rulings, because an unfavorable ruling today based on the\u200b law,\u2062 as it stands today, might be more favorable a few years down the \u2062road\u2064 when a\u2062 new attorney general is\u2064 appointed,&#8221; Tsankov, who added that the appeals of decisions \u200bfurther\u2063 burden the backlog, said.<\/p>\n<p>Tsankov\u200c has been an \u200cimmigration\u2064 judge during the Biden, Trump, \u2063Obama, and Bush administrations, where she has seen \u2064each attorney general \u200cshift how judges should proceed in cases. It was not\u2062 a huge issue until the past decade, as the \u200cnumber of\u200b new \u200bcases due to illegal immigration \u2064at the southern border began to\u2063 increase.<\/p>\n<p>The immigration court backlog doubled during the Trump administration\u200c and has since climbed under President\u200b Joe Biden \u200dto more than 2 million pending cases.<\/p>\n<p>Since Biden took office in January 2021, more\u200d than 5 million people have illegally crossed the \u2064southern border between ports \u200dof entry. More than 2 million people have \u2064been apprehended\u200c and then\u2063 released \u200binto the\u200c United States with a notice to appear in one of the 70 immigration courts nationwide closest to where\u2064 they are resettling.<\/p>\n<p>In an effort \u200bto get to more cases while immigrants were in custody at \u2063the border rather than years down\u200d the \u200broad after\u200d being released, the Biden administration has \u2062asked judges to serve for\u200b a period on the border.<\/p>\n<blockquote>\n<p>&#8220;With the recent high levels \u2064of migration at the border related\u2064 to migrants bypassing the\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-responds-to-feds-cutting-through-razor-wire-to-let-illegals-into-texas\/\" title=\"Biden administration reacts to federal action allowing unauthorized entry into Texas.\">lawful pathways rule<\/a>, \u2062many judges are being pulled from their home\u200d court dockets to handle border matters.\u200c These special assignments brought on by real need nevertheless wreak havoc\u2064 on our \u200bhome court\u200d docket,&#8221; Tsankov said. &#8220;The consequence is a ballooning backlog.&#8221;<\/p>\n<\/blockquote>\n<p>Tsankov was temporarily sent to \u200dthe border \u200btown of Laredo, Texas,\u200c this past summer to hear\u200d cases, which forced her to \u200creschedule for 2027 hearings in North Carolina that were already on the books.<\/p>\n<p>&#8220;Each new administration has different docketing priorities. And that shuffling of the docket results in Judges being \u2064at \u200cone \u200cin one administration sent to the border and their whole home court dockets languished for\u200d extended periods of time,&#8221; she said. &#8220;It&#8217;s\u200c the docket shuffling and the issue with the changing case \u200claw that\u200c I think\u2062 is the most problematic for our court.&#8221;<\/p>\n<p>Right now, Tsankov can schedule four hearings per day, and the average judge across the 70\u2062 courts nationwide\u200c has 3,700 cases on their docket.<\/p>\n<p>By pulling the courts out from under the DOJ, the attorney general would no longer have say\u200c over the judges, resulting in no more\u200b political scrutiny of their decisions and pressure on them, as well \u2063as fewer cases likely getting appealed and causing more delays.<\/p>\n<p>Judges would be responsible\u2064 for managing \u2064their own resources and dockets just \u200cas federal and state courts\u200c do. Moving the immigration courts out from under the DOJ\u2063 would require an act of \u2062Congress but &#8220;begin the process of healing this broken system.&#8221;<\/p>\n<p>But plenty more needs to be done,\u2062 including a mass hiring spree of Immigration judges are short of law clerk support, interpreters, and legal\u2064 assistants.
