Donald\u2062 Trump<\/em> issued \u200ca gag \u2064order prohibiting a\u200d leading presidential candidate, Donald Trump, from engaging in \u2063speech aimed at \u201cgovernment\u200c staff,\u201d among others, during his trial.<\/p>\n<p>Listen, I understand the disdain some conservatives feel for the former president. I share the \u2064sentiment. But if\u2063 you\u2019re cheering on a judge who\u2019s inhibiting political speech on rickety grounds, you\u2019re no friend of the \u201cdemocracy\u201d or\u2064 the Constitution.\u200b Trump hasn\u2019t been found guilty of anything.<\/p>\n<blockquote>\n<p>\u201cMr. Trump may still vigorously seek public support\u2062 as\u200d a \u2063presidential candidate, debate policies\u2062 and people related to that\u2063 candidacy, criticize the current\u200d administration and assert his \u200cbelief\u2063 that this \u200cprosecution\u200d is\u2063 politically motivated,\u201d Chutkan explained. \u201cBut those critical First \u200dAmendment freedoms do not allow him to launch a pre-trial \u2062smear campaign against participating government staff, their families \u200band foreseeable witnesses.\u201d<\/p>\n<\/blockquote>\n<p>Who is Chutkan\u2064 to dictate the contours of a presidential candidate\u2019s political speech? What if \u200bone of the \u201cparticipating\u200b government staff\u201d or a\u2063 family member is compromised by partisanship? Moreover, suggesting\u200b that without gagging, \u2064Trump will engage\u200c in\u200c a \u201csmear campaign\u201d is \u2064more prejudicial to \u200dthe case \u200bthan\u2063 any of the inflammatory things Trump has said. The judge\u2019s public statement strongly implies that any\u2063 accusation now aimed at prosecutors or the court is untrue.<\/p>\n<p>Trump contends that \u2064he is being railroaded by special counsel Jack Smith, the longtime \u200dfederal \u2064prosecutor \u2062who works \u200bon \u200cbehalf of Democrats and Joe Biden. You might believe the special counsel is a chaste defender of Lady Justice, but there\u2019s ample evidence that partisan considerations are in \u200bplay. Fears of a politicized\u200b justice department are real. As we speak,\u2064 the head of the Democratic Party is\u200b being mollycoddled by the state in a very similar case\u2063 involving classified documents.<\/p>\n<p>Whatever the case, the Justice Department now\u200d plays a big part in Trump\u2019s campaign for\u200d the presidency \u2014 and \u200bprobably his legal case, as \u200bwell. If the state\u2019s accusations can be spread throughout the media before a trial, why can\u2019t the defendant\u2064 speak openly, as well?<\/p>\n<p>In the\u2064 name of fairness, Chutkan \u200bcontends that\u200b Trump does not enjoy unfettered First Amendment rights because \u200dhe might intimidate\u2063 witnesses. \u200bIt\u2019s already illegal to \u2063intimidate witnesses. Charge him if he does it. Laws already\u200b exist\u2063 to\u2064 cover\u2062 all the other \u2062premises Smith has used to rationalize the gag order.<\/p>\n<p>The notion\u200d that a jury pool\u200c is going to \u2063be impartial in\u200d a trial involving \u200da divisive former president,\u200c who \u200dis not only a leading contender \u2064for the presidency but one of the most famous people\u200b on Earth,\u200d is absurd. And \u200cthe notion a DC jury pool will be impartial when it comes to Trump is fantastical. There is little that can be done\u200d about\u2062 it. But further gagging the defendant\u2062 only feeds, at the very \u200dminimum, the perception that this is \u200call politically motivated.<\/p>\n<p>Establishment media informs us that the gag order is just \u201cnarrow\u201d and meant to \u201cprotect the integrity of the \u2063trial and the jury pool.\u201d In her Solomonic wisdom, Chutkan \u200dcut the\u2064 state\u2019s request in half. A \u201cnarrow\u201d\u2062 gag order\u200b limiting free speech is still a gag order limiting free speech.\u2062 The fact that Smith was seeking even broader limitations \u2064only \u2064makes Trump\u2019s claims more\u2062 plausible.<\/p>\n<p>Smith has also argued that Trump should not be afforded \u201cspecial treatment\u201d because he\u2019s a candidate. He\u2019s right. No one\u2019s right\u2063 to defend themselves or to engage in speech should be inhibited, not even during trials (though any good lawyer will tell clients, for \u2063their own good, to \u200cshut up.) Still, gag orders are almost always an unconstitutional prior restraint. For years, the ACLU and similar groups argued the same.<\/p>\n<p>I\u2019m sure \u200bmany people simply believe Trump deserves it. Think, though, about the precedent: administrations can \u2063now launch\u2064 prosecutions against\u200d political rivals \u2014 calibrated to take \u200bplace in favorable cities and timed to\u2062 coincide with elections \u2014\u2062 and then demand gag orders be\u200d implemented\u200b on \u200dthose running for office.
