They argue that\u2062 it allows \u200dgovernment officials to escape accountability for their actions, even when \u200dthose actions are egregious.<\/p>\n<p>City officials are concerned that if the appeal is successful, qualified immunity could be \u200cundermined as \u2063a judicial policy.<\/p>\n<p>The Supreme\u2064 Court granted the petition for certiorari\u2063 in the case of Gonzalez v. Trevino (court file 22-1025) on October\u2063 13. \u200dNo reasons were provided for the \u200bdecision, and\u200b there\u2064 were no dissenting justices. At least four out of the nine\u2063 justices must vote in favor of a petition \u200bfor it to proceed.<\/p>\n<div class=\"my-5\">\n<p>The respondent in this case is Edward Trevino II, who is being sued in\u200b his official capacity as the mayor of Castle Hills, Texas.<\/p>\n<h2>Law Firm Alleges Campaign\u2063 of Retaliation<\/h2>\n<p>The First Amendment case dates back to 2019 when Sylvia Gonzalez\u2062 won an\u200b election and became\u2064 a councilwoman \u2064in \u200dCastle Hills. She led a nonbinding petition among citizens calling for the removal of city manager Ryan Rapelye, citing\u2064 his\u2064 failure to address\u2063 residents&#8217; concerns, such as fixing the streets.<\/p>\n<\/div>\n<p>According \u2062to the Institute for Justice (IJ), a public interest law firm representing Ms. Gonzalez, \u2064city officials launched a campaign of retaliation against her.<\/p>\n<p>The city argued \u2063that she was not properly sworn in and replaced her on the city council\u200c with the candidate she had defeated in the election.\u200d However, a judge \u2064later reinstated Ms. Gonzalez. A group of residents \u2064aligned with the \u200cmayor then sued\u2063 her, claiming\u200d incompetence. She\u2062 ultimately prevailed\u200c in that \u200clawsuit as well.<\/p>\n<p>However, city officials &#8220;engineered Sylvia&#8217;s arrest for misplacing a document in her binder at a\u200d council \u2062meeting,&#8221;\u200c which happened\u200b to be \u200bthe same petition she \u200chad championed to remove the city \u2062manager, according to IJ.<\/p>\n<p>Ms. Gonzalez was charged under a \u200drarely invoked Texas law that \u200cprohibits the destruction or tampering of government documents.<\/p>\n<p>Federal Judge David Alan\u2062 Ezra \u200bcriticized the city&#8217;s actions, stating, &#8220;Instead of issuing \u2062a summons for the nonviolent misdemeanor, [the city] obtained a warrant to arrest the 72-year-old, which ensured that she would spend time in jail rather than remaining free and appearing before a judge.&#8221;<\/p>\n<p>After spending a day\u200d in jail, Ms.\u2063 Gonzalez&#8217;s \u200bmugshot appeared in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/health-care-workers-mandated-to-wear-masks-in-several-counties-officials\/\" title=\"Healthcare workers in multiple counties required to wear masks: Officials.\">local media \u200breports<\/a>. The local district attorney later dropped the charges, but \u2063Ms. Gonzalez believed that the effort to \u2062intimidate\u200d her would continue and subsequently resigned from the \u200ccity council.<\/p>\n<p>&#8220;I\u2064 didn&#8217;t think this could happen in America,&#8221; Ms. Gonzalez said in a\u2063 statement\u200d following the Supreme Court&#8217;s decision to \u200dhear \u200dthe case. &#8220;No one should be arrested for standing up\u2062 for \u200bwhat\u200c they believe in. However, the U.S. Court of Appeals for the 5th Circuit overturned the decision, arguing\u200c that there was sufficient probable cause to justify her arrest \u200cand that she \u2064could not bring a First Amendment claim.<\/p>\n<h2>Prior Ruling<\/h2>\n<p>During \u2063the upcoming oral argument, the Supreme Court is expected to examine the Nieves \u200dv. Bartlett ruling from \u200c2019. This\u2063 ruling\u2062 established that when a plaintiff claims retaliatory arrest for constitutionally protected speech, they must demonstrate that the authorities lacked probable cause for the arrest. However, the court\u200d made an\u200b exception\u200d for cases\u200b where the plaintiff can show that they were arrested while others who did not engage in\u200c protected speech were not.<\/p>\n<\/div>\n<p>In Ms. Gonzalez&#8217;s case, the 5th Circuit determined that the\u200d evidence she \u2063presented \u2063did not \u2063meet the requirements for the Nieves exception. The court stated that \u2062she\u200c needed to provide examples of individuals who \u2063mishandled \u2063a government petition but were not\u200c prosecuted under \u2063the Texas law.<\/p>\n<p>Senior Attorney Patrick Jaicomo from the Institute for Justice expressed his concerns, saying, &#8220;Constitutional rights mean nothing if they can&#8217;t\u2063 be \u2063enforced against government officials \u2062who violate them. This blatant abuse of power by government officials should \u2062have never happened.&#8221;<\/p>\n<p>The Epoch Times has reached out to\u2064 Mr. Trevino&#8217;s attorney \u200bfor comment,\u2064 but as of now, no response \u2062has been received.
