Doesn\u2019t make\u200d up for the \u200charm New York inflicted, but will help protect us from more.&#8221;<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-blocks-vaccine-mandate-for-health-workers-in-missouri-becomes-10th-state-to-block-requirement\/\" title=\"Judge Blocks Vaccine Mandate for Health Workers in Missouri, Becomes 10th State To Block Requirement\">healthcare worker vaccine mandate<\/a> was first implemented in September 2021, resulting in the\u200c departure or termination of approximately 34,000 medical professionals from \u200dtheir positions.<\/p>\n<p>That mandate was originally\u200d struck down by \u200bthe state&#8217;s Supreme Court back in January, although the state&#8217;s executive \u200bbranch chose to appeal the decision.<\/p>\n<p>In his opinion on Medical Professionals for Informed Consent vs. Bassett, Judge Gerard Neri wrote that the state&#8217;s Department \u200cof \u2063Health was \u2062&#8221;clearly prohibited from \u200bmandating \u200bany vaccination outside of those specifically \u200dauthorized by the \u2064legislature&#8221; and that they had &#8220;blatantly violated the boundaries of \u2063its authority as set forth by the\u200d legislature.&#8221;<\/p>\n<p>Neri added that the mandate was &#8220;arbitrary and capricious&#8221; \u2064given that the COVID-19 vaccines failed to prevent transmission of the virus, meaning the policy had no rational basis.<\/p>\n<p>New York&#8217;s \u2063Democratic Governor Kathy \u2064Hochul \u2064had\u200b previously explained her opposition to\u2063 rehiring health care workers who lost their jobs as a result of the vaccine, saying \u2063that this \u200dwas &#8220;not the right \u2063answer.&#8221;<\/p>\n<p>\u201cI think everybody who goes into a health care facility or a \u2063nursing\u2062 home should have the assurance and\u200b their \u2064family member should know that we have taken all steps to protect the public health,&#8221; she said at the time. \u200d&#8221;And that includes making sure those who come in contact \u2063with them at their time of\u200b most vulnerability, when they are \u2063sick or \u200celderly, will not pass on the\u200d virus.&#8221;<\/p>\n<p>In April, \u200cthe state agreed to unilaterally drop the \u200cmandate of its own accord,\u2062 although \u200cit still contested the decision for the sake of maintaining executive authority.<\/p>\n<p>Last\u200d October, the \u200dNew \u200dYork Supreme Court also\u2064 struck down a mandate enforced\u200d specifically by New York City \u200con all public employees, with Justice Ralph Porzio arguing there \u2064was no evidence to &#8220;support the rationality of keeping a vaccination\u200d mandate for public employees, while vacating the mandate for private sector employees or creating a carveout \u2064for certain professions, like athletes, artists, and\u200d performers.&#8221;<\/p>\n<p>In January 2022, the U.S. Supreme Court similarly \u2064blocked an attempt by President Joe Biden to \u200denforce a mandate \u2064on large private companies that their employees\u2062 either get the vaccine or \u200cface regular testing.\u2064 However,\u2062 it did allow the\u2062 mandate to \u2064continue \u200bin medical\u200b facilities that took funding from \u200dMedicare\u2062 and Medicaid.<\/p>\n<p>&#8220;Although Congress has indisputably given OSHA the \u200cpower to regulate occupational dangers, it has not given that \u200bagency the power to regulate public health\u2062 more broadly,\u201d the court wrote in\u2062 its \u2062unsigned opinion. &#8220;Requiring\u2063 the vaccination of\u200d 84 \u2064million Americans, selected simply because they\u2064 work for employers with\u2064 more than \u200b100 employees, certainly falls in the latter category.&#8221;<\/p>\n<p>Margaret\u2063 Florini, a spokesperson for Medical Professionals for Informed Consent, called the latest decision a &#8220;historic&#8221; win that would help prevent such \u2064abuses of power from ever \u200dhappening again.<\/p>\n<p>&#8220;I think we\u200b will \u200csee \u200dmany new lawsuits come about\u2063 because of this historic win,&#8221; Florini said. &#8220;There is still\u200c plenty of work to be done.
