Biden that CISA is\u2062 barred from continuing\u2064 to \u2064violate the Constitution, but,\u200d according to experts, the only \u2062sure way to stop CISA from illegally censoring\u2062 Americans is to defund\u200b the agency.<\/p>\n<h2 class=\"wp-block-heading\">\u2018Poorly\u2019 Drafted\u200c Legislation<\/h2>\n<p>Instead of defunding \u2062CISA, members of Congress\u200d added provisions within their Department of Homeland Security appropriations bill to allegedly put \u2062an end \u200bto the agency\u2019s\u2063 illegal activity.<\/p>\n<p>According to the bill, none of the DHS\u200c funds can be used \u201cto classify or facilitate the classification of any communications by\u2063 a United States person as mis-, dis-, or \u2062mal-information,\u201d nor can the funds be\u2064 used\u200c to \u201cpartner with or fund nonprofit\u200c or other\u2062 organizations that in any way instruct, influence, direct, \u200cor recommend that private companies in any way censor,\u200d prohibit,\u200d or obstruct lawful and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-u-s-senate-acquits-trump-seven-republicans-vote-guilty\/\" title=\"BREAKING: U.S. Senate Acquits Trump; Seven Republicans Vote Guilty\">constitutionally protected speech<\/a> of United States persons on <a media platforms<\/a>.\u201d<\/p>\n<div class=\"fdrlst__b89e9-c89d42813b555940107cff7ddb2bf99d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-c89d42813b555940107cff7ddb2bf99d\"><\/div>\n<p>Cato \u2062Institute Senior Fellow\u2064 Patrick Eddington, who \u2062is\u200c an \u200bexpert on homeland security \u200cand civil liberties, wrote in \u2064a\u200c statement to\u200c The Federalist that this part of the\u200c bill \u200cis \u201cthe most\u200b poorly\/sloppily drafted pieces of legislation\u200d I\u2019ve seen \u200cin \u200dmy 35 years in D.C.\u201d The first issue, Eddington says, is that \u201cThere\u2019s no definition of\u200b what constitutes \u2018misinformation\u2019 or \u2018disinformation\u2019 or \u2018malinformation,\u2019\u201d leaving \u201cthe entire \u200csection wide open to attack\u200b in federal court.\u201d<\/p>\n<p>Eddington\u200b foresees\u2063 issues with another section of the bill, where the lawmakers\u200c state, \u201cAny officer or \u2064employee \u200bof the federal government whose salary is funded by this Act and\u200b who conducts\u201d the\u2064 illegal censorship activity, \u201cshall be removed from the Federal service.\u201d According\u2063 to Eddington, this would be \u201ca flagrant violation of the separation of powers and also, as drafted, is a de facto bill of \u2064attainder\u2014both\u2064 unconstitutional.\u201d A \u2063bill of attainder is \u200da law\u200c that legislates \u200dconsequences without going through the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-nuclear-scientists-sound-alarm-on-lab-vaccine-mandates-fallout-will-be-felt-for-months-to-come\/\" title=\"Exclusive \u2014 class=\"wp-block-heading\">How To Handle CISA<\/h2>\n<p>Brian\u2063 Cavanaugh, a \u2062visiting fellow at Heritage and a former member of President Trump\u2019s National Security Council, told The Federalist \u200cthat he doesn\u2019t think CISA should be abolished because it plays an important part in the security apparatus. \u201cCISA has a very important role,\u201d said\u200c Cavanaugh, particularly because we are at a \u201cprecarious \u2063point in time with quantum computing and AI capabilities.\u201d Enemies of\u2064 America, for\u2062 instance, have \u201cthe capability to turn off all the lights in the\u200d U.S.,\u201d he said.<\/p>\n<p>To fix the abuses prevalent across the entire Department of Homeland Security, Cavanaugh\u200d told\u2062 The Federalist\u200d that DHS needs to \u201cconsolidate its\u200d mission\u201d and diminish the size of \u201cbureaucratic middle \u2063management.\u201d The best \u200cway to \u200caccomplish this \u2063would be \u201cto have the next Republican president ask Congress for presidential reorganization \u200dauthority for DHS,\u201d\u2064 he stated.<\/p>\n<div class=\"fdrlst__b89e9-bcdb7fde164884ef86abe4402e38540f fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-bcdb7fde164884ef86abe4402e38540f\"><\/div>\n<p>\u201cWhat needs to \u200bbe done is somebody needs \u200cto sit back and say, \u2018What are the fundamental things we need to \u200cdo to protect the homeland that are <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/expert-says-congressional-republicans-plan-to-curb-cisas-criminal-censorship-practices-is-ineffective-and-sloppy\/\" title=\"Expert criticizes GOP's ineffective and sloppy plan to curb CISA's censorship practices.\">inherently government-oriented responsibilities<\/a>?\u2019\u201d said\u2062 Cavanaugh. \u201c\u2018And how do we focus our efforts and get rid of the fluff\u2063 and the waste and\u200d abuse?\u2019\u201d<\/p>\n<p>In \u200dthe meantime, however,\u2062 Congress can make headway by cutting CISA\u2019s funding. \u201cCISA has been given more money \u200dthan they know\u2064 what to do with,\u201d \u2062Cavanaugh said. \u201cUp until this past\u2063 year, they have gotten what\u200b they\u2019ve asked for, if\u2063 not more, than what they\u2019ve asked for.\u201d Cutting \u2063CISA\u2019s funding\u200b would \u200bincentivize the agency \u200bto \u201claser \u2064focus on their\u2064 actual mission and\u200d use the funding they\u2019ve received \u200bto\u2064 demonstrate that they\u2019re moving \u2063the needle on the areas that they\u2019ve actually been authorized to \u200cexecute by Congress,\u201d explained Cavanaugh.<\/p>\n<h2 class=\"wp-block-heading\">Congressional Republicans Must Cut Funding<\/h2>\n<p>Two weeks ago, Rep. \u200bAndrew Clyde (R-Ga.) introduced\u200c an amendment\u200b that would strip CISA of 25 percent of\u2063 its funding. Unfortunately, \u200b\u200b109 Republicans voted\u2064 against the \u200camendment, and it failed on \u2063the House\u2062 floor.<\/p>\n<p>In\u200b a \u200bstatement \u2064to The\u2063 Federalist, Clyde said \u2064that he is \u201chopeful that\u2062 many of my colleagues\u200d will reconsider\u201d their\u200d decision to vote against \u200bcutting CISA funding \u201cand\u2062 join with me\u2062 in holding this weaponized agency accountable\u200d through the power of the purse following \u200cnew information that has come to light regarding \u200cits nefarious censorship\u2063 practices.\u201d<\/p>\n<p>\u201cConsidering\u2063 that CISA has \u200bshamelessly\u200d violated Americans\u2019 First Amendment freedoms for years, it is incumbent upon Congress to take additional \u2063steps to eliminate this taxpayer-funded government-by-proxy censorship from further tarnishing our \u2064nation,\u201d Clyde continued.<\/p>\n<p>Clyde told The Federalist that there is still another opportunity\u2063 for Congress to cut CISA\u2062 funding and protect the\u2062 American people and the integrity of the upcoming 2024 election.
