This ban has been implemented by numerous Democrat-controlled cities and\u200c local governments\u200d as part\u200b of their efforts to \u2062combat climate change.<\/p>\n<div class=\"my-5\">\n<p>The <a href=\"https:\/\/www.npga.org\/wp-content\/uploads\/2023\/10\/2023-10-12-Complaint-Mulhern-Gas-v-Rodriguez.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a>, \u200bfiled on Oct. 12, involves the National Association of Home Builders, the National Propane Gas Association,\u2064 and other \u2064organizations. They argue that New York \u200dState is violating federal law by prohibiting the use of \u200bgas stoves and appliances \u200cin\u2062 new buildings.<\/p>\n<\/div>\n<p>The\u2064 plaintiffs, including trade\u2064 unions, contend that the ban is illegal because it conflicts with existing federal laws. Rodriguez, has been filed in the U.S. District Court \u200dfor the Northern District of New \u200cYork.<\/p>\n<div class=\"my-5\">\n<p>The New York Department of State\u200b stated that it is &#8220;reviewing this matter and\u2064 cannot comment \u200con\u2063 pending litigation.&#8221;<\/p>\n<h2>&#8216;They Can\u2064 Go Electric&#8217;<\/h2>\n<p>In May, New \u2064York <a href=\"https:\/\/www.theepochtimes.com\/article\/new-york-becomes-first-state-to-ban-gas-stoves-5238859\" target=\"_blank\" rel=\"noopener\">became the first state<\/a> in the country to ban natural gas \u2062appliances and infrastructure. This ban was included in the state budget and will be effective in most new buildings starting in 2026.<\/p>\n<\/div>\n<p>The ban\u200b prohibits the installation of fossil fuel \u2063equipment in new buildings under seven stories by 2026,\u200d and by 2029 in\u2063 taller\u200d buildings. It mandates the use of\u200c all-electric heating\u200c and cooking systems.<\/p>\n<p>There\u2062 are exemptions for certain establishments such\u2062 as hospitals, manufacturing facilities,\u2063 and restaurants. Existing buildings \u2062are also not\u200b subject to the ban.<\/p>\n<p>&#8220;Everybody who has a gas stove\u2014enjoy it. Keep your gas stove,&#8221; said New York Gov. \u200cKathy Hochul. &#8220;But new buildings that \u2063are going up, they can go electric, \u2063they can do heat pumps.&#8221;<\/p>\n<div class=\"post-figure\" style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>New York Gov. Experts Say It\u2019ll Backfire.\">gas stove ban<\/a>.<\/p>\n<div class=\"my-5\">\n<p>&#8220;New Yorkers are \u200dstruggling to heat their homes and\u200d put gas in their cars,&#8221; he \u200bwrote\u2064 on X. &#8220;Instead of approving new\u200b pipeline applications and \u2064reversing the state\u2019s ban\u2064 on\u2064 the safe \u2062extraction of natural\u2062 gas, Kathy Hochul and her allies\u200d are tripling \u2063down \u200con kicking this state off the cliff.&#8221;<\/p>\n<\/div>\n<p>Climate \u2064lobbyists initially pushed for the New York state gas stove ban to take effect in 2025. However, a compromise was reached,\u200c resulting in a one-year delay in implementation.<\/p>\n<div class=\"my-5\">\n<p>Now, the plaintiffs \u2062in\u2062 the lawsuit are seeking a court ruling to invalidate the ban\u2063 and prevent its enforcement.<\/p>\n<h2>Challenging the Ban<\/h2>\n<p>The industry\u2062 groups involved in the lawsuit argue that the ban is preempted by \u200ca\u2064 federal\u200d law called the Energy\u2062 Policy and Conservation \u2063Act (EPCA), which regulates\u200d energy use.<\/p>\n<p>\u201cEPCA reflects Congress\u2019s decision that the\u2063 nation\u2019s energy policy \u200dcannot be dictated by \u2062state and\u200c local governments,\u201d states their complaint. \u201cSuch a patchwork \u2064approach would be the antithesis of a national energy policy.\u201d<\/p>\n<p>Earlier this year, a three-judge \u2062panel at\u2062 the U.S. Court\u200d of \u2062Appeals for the Ninth \u2063Circuit in California\u2062 ruled against \u200ba\u2064 similar ban on gas infrastructure in \u200bBerkeley, California. They determined that the ban violated the EPCA\u200c and was therefore illegal.<\/p>\n<p>&#8220;A mandate banning gas\u200b now is not reasonable or affordable, when New York&#8217;s \u2062grid is already overburdened,&#8221; stated Sarah Jorgensen,\u200d counsel for the plaintiffs.\u200b &#8220;And regardless, New York must comply with the law.&#8221;<\/p>\n<p>However, it \u200dremains uncertain whether the California precedent will hold, as the city has\u2062 requested a \u200drehearing of the case\u200c with a larger 11-judge panel.<\/p>\n<p>The Biden administration, which has prioritized combating climate change, has filed an amicus brief \u200csupporting the city&#8217;s \u200dposition. They argue that gas \u2063appliance bans \u2062are not preempted by the EPCA.<\/p>\n<p>Numerous Democrat-controlled cities and local governments have implemented similar policies to New York&#8217;s gas\u200c stove\u200b ban, turning the\u2063 issue into a contentious topic in the ongoing culture wars.<\/p>\n<div class=\"my-5\">\n<p>A growing number of scientists worldwide have expressed opposition to climate change \u2064alarmism.
