Gavin Newsom.<\/p>\n<p>The law, which will take effect on Jan. 1, 2025, aims to \u200dcrack down on social media sites\u200c that facilitate the commercial sexual exploitation of children. State Assembly Bill\u2062 1394 requires these platforms to allow minors featured in such posts to delete them. This means\u2062 that minors could potentially seek damages from platforms\u200d that do not \u2062remove sexually explicit content involving\u200b them.<\/p>\n<p>To avoid legal action, platforms can conduct bi-annual audits \u200bto\u200d identify \u200band\u2062 address\u2062 any system vulnerabilities that allow the propagation of such content.<\/p>\n<p>Bill sponsors expressed their approval following Gov. Newsom&#8217;s signature. They hope that this legislation\u200d will serve as a catalyst \u200bfor change nationwide.<\/p>\n<p>However, opposition\u200d to\u200b the bill, including the California Chamber of Commerce and the Civil Justice Association \u2063of California, argues that\u200c it could inadvertently \u2063restrict the \u200cfree speech of minors \u2064by prohibiting them from using certain features, such as \u2064chat rooms, \u200don these platforms.<\/p>\n<p>The opposing groups stated, \u200c&#8221;[P]latforms \u2063could choose to disable\u2063 features that could\u200c be misused by perpetrators to traffic children, such as direct messaging, chat forums, or other communicative features. They could \u2062also prohibit anyone \u2064under the age of 18 from using their platforms. In either \u200binstance,\u2063 more lawful speech is impacted and burdened than intended, thus creating a chilling effect on providing and hosting lawful content and speech\u2063 on social media platforms.&#8221;<\/p>\n<p>According to these groups, the disadvantages of the\u200d new law\u200d outweigh\u2063 the benefits. They believe that it\u200b will result in\u2064 the removal of more lawful speech and fewer online spaces for teens \u200cto\u2062 communicate and \u2062share ideas.<\/p>\n<p> <\/p>\n<h2> What technology \u2062solutions can be implemented to effectively detect and\u200b prevent the upload and dissemination of explicit content involving minors?<\/h2>\n<p><span>  Audits to\u200d ensure\u200b they are \u2062in compliance with the law. \u200bThese audits must be conducted by an independent third-party\u2063 and \u2062must\u2062 include a review of the platform&#8217;s \u200cpolicies \u2062and procedures for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-california-law-targets-child-sexual-exploitation-online\/\" title=\"California's new law tackles online child sexual exploitation.\">handling \u2064explicit \u2062content involving minors<\/a>.<\/p>\n<p>Additionally, the law\u200d requires platforms to implement \u2062technology \u2063solutions that can detect\u200b and \u2062prevent the\u200d upload \u2063and dissemination of explicit\u2062 content involving minors. By imposing hefty fines on tech \u200dcompanies that fail to \u2063remove explicit \u200dcontent \u2064of minors, the state is sending a \u2064clear message \u2062that this type of\u200d content will not be tolerated.<\/p>\n<p>However, some critics argue that the law puts an excessive burden on tech companies and may\u200b unintentionally limit freedom of speech.\u200d They worry that platforms may over-censor content in order\u2064 to avoid fines, even if \u200dthe content is not \u2062explicit or harmful.
