Given a chance to bring the power of the legal\u200b system \u2064against a white man \u2014 a\u200c Marine Corps veteran with an\u2062 honorable discharge who felt\u200c an \u200cobligation to <a href=\"https:\/\/www.westernjournal.com\/marine-vet-daniel-penny-reveals-stepped-fellow-subway-passengers-threatened\/\" target=\"_blank\" rel=\"noopener\">protect the powerless<\/a> \u2014 he operated <a href=\"https:\/\/www.westernjournal.com\/ap-alvin-bragg-announces-charges-marine-involved-fatal-subway-clash-jordan-neely\/\" target=\"_blank\" rel=\"noopener\">true to form<\/a>.<\/p>\n<p>The brief filed by \u2063Penny\u2019s\u200d defense\u2064 attorneys is \u2063seeking dismissal of the case on grounds that testimony by medical examiner Cynthia Harris\u200c might have misled grand jurors as to the cause\u2064 of Neely\u2019s death.<\/p>\n<p>There\u2019s no real dispute that\u2064 Penny\u2019s chokehold resulted in\u2064 Neely\u2019s\u2062 death, but the fact \u2063that Neely died an hour\u2063 after \u200bthe ride ended, according to the brief, tends\u200d to show\u200d that Penny never intended to end\u200c the man\u2019s life.<\/p>\n<p>More to the point, the grand jury testimony showed that people who \u200dwere\u2062 there, locked in\u2064 a rocking subway \u200dcar \u200dwith\u200c a madman raging in their faces, \u2063were damn glad Penny was on the scene.<\/p>\n<p>It\u2019s practically a legal axiom that even a half-witted prosecutor can \u201c<a href=\"https:\/\/abovethelaw.com\/2016\/02\/criminally-yours-indicting-a-ham-sandwich\/\" target=\"_blank\" rel=\"noopener\">indict \u2063a ham sandwich<\/a>,\u201d but as the legal brief notes,\u200b the New York\u200d Supreme\u200c Court \u200chas declared that \u201cthe prosecutor is \u200bcharged with duty not only to secure indictments, but also to see \u200dthat justice is done.\u201d<\/p>\n<p>American common \u2064sense agrees. \u200dNo one is saying Jordan Neely deserved to die.
