In \u2062total, 3,700 employees will \u2062cost the American taxpayer nearly\u2062 $650 million in the first year, \u2064which is not an\u200b issue as agency coffers are brimming from a recent \u200bcongressionally-mandated\u2063 infusion\u2064 of $60 billion in new \u2063funding. Instead, income is passed on to business owners, who file taxes based on their \u200cindividual tax rates. Pass-through entities help proprietors avoid the issue of double taxation when the income is taxed at the business level,\u2064 and then at the individual level when they receive dividends.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<\/div>\n<p>\u201cThis\u2063 new unit will leverage\u200b Inflation Reduction Act funding to disrupt efforts by certain large partnerships to use pass-throughs to intentionally \u200dshield income to \u2063avoid paying the taxes they owe,\u201d said Mr. Werfel, with operations expected to begin sometime late next year.<\/p>\n<div class=\"my-5\">Though \u2064the IRS claims they \u2064will target pass-through entities in a bid to hold\u2063 the wealthy accountable, the fact \u200bthat \u200csuch entities include small business structures like sole proprietorships and partnerships has raised\u200b concerns about working-class \u2062American businesses being potentially \u2064targeted by the agency.  <\/p>\n<h2>AI Assisting IRS<\/h2>\n<p>  Besides adding on human resources, the agency is undergoing\u2064 \u201ca sea change taking place at the IRS in every aspect of our operations,\u201d claims the commissioner, pointing to the deployment of artificial\u2064 intelligence (AI) in\u200d operations.<\/p><\/div>\n<p>On Sept. 8,\u2063 the IRS announced a \u201csweeping, historic\u201d change\u2063 involving the introduction of AI and enhanced technological prowess in assisting tax agents to \u201cdetect tax cheating, identify emerging compliance threats \u200band improve case selection tools.\u201d All initiatives are assisted by the\u2062 2022 \u2064Inflation Reduction Act (IRA) funding boost.<\/p>\n<p>IRS\u2019 AI initiative is said to focus efforts on complex tax structures \u2064and large partnerships. The agency admitted that audit rates for \u2063high-earning\u2062 categories had seen\u200c \u201csharp drops\u201d\u2064 over the past decade.<\/p>\n<p>\u201cWith the help of AI, the selection of these returns is the result of groundbreaking collaboration among experts in data science and \u200dtax enforcement,\u2064 who have been working\u2062 side-by-side to apply \u200ccutting-edge machine learning technology to identify potential compliance risk in the areas \u200dof partnership tax, general income tax and accounting, and international tax \u200bin\u200d a taxpayer segment that \u2063historically has been subject to limited examination coverage.<\/p>\n<p>\u201cBy the end of the month, the IRS will open \u200cexaminations of 75 of the largest partnerships\u2062 in the \u2062U.S.\u200b that represent a cross\u200c section of\u2063 industries, including hedge funds, real estate investment partnerships, publicly traded partnerships, large law firms and other industries. On average, these \u200dpartnerships each \u2062have more than $10 billion in assets,\u201d said the agency.<\/p>\n<div class=\"my-5\">As part of integrating AI, the IRS announced \u201cexpanded <a href=\"https:\/\/www.irs.gov\/newsroom\/irs-expands-use-of-chatbots-to-help-answer-questions-on-key-notices-expands-on-technology-thats-served-13-million-taxpayers\" target=\"_blank\" rel=\"noopener\">chatbot technology<\/a> to \u200bhelp quickly answer \u200bbasic questions for people receiving notices about possibly underreporting their taxes\u201d on Sept. 26.<\/div>\n<p>The \u2064agency \u200cclaims that since the \u200dbeginning of 2022, chatbot services have \u200cassisted over \u200d13 million taxpayers in\u2062 avoiding wait times by providing tax resolutions.<\/p>\n<div class=\"my-5\">In each development announcement, the agency makes a point of\u200b reiterating\u2063 their stance \u2062that all new initiatives \u2064are focused on countering tax evasion efforts by high-earners.  <\/p>\n<h2>The Actual Targets<\/h2>\n<p>  In \u2062the September \u2063press release regarding AI, the agency notes, \u201cThe IRS will intensify work on taxpayers\u200c with\u200b total positive income\u2064 above $1 \u2063million that\u200b have more than $250,000 in recognized tax \u2062debt.\u201d<\/p><\/div>\n<p>The tax agency said that it plans to have \u2064dozens\u2063 of agents focusing on \u201chigh-end collection\u200c cases\u200b in FY 2024. The IRS is working\u200c to expand this effort, contacting about \u20621,600 taxpayers in this category that owe hundreds of millions of dollars in\u200d taxes.\u201d<\/p>\n<div class=\"my-5\">However, an audit of IRS actions reveals a \u200ddifferent story. The agency \u200cis already under scrutiny for\u200b <a href=\"https:\/\/www.theepochtimes.com\/us\/irs-targets-complex-pass-through-entities-used-by-high-income-earners-5496186\" target=\"_blank\" rel=\"noopener\">targeting low-income\u2062 earners<\/a> in individual filings. A January<a href=\"https:\/\/www.theepochtimes.com\/us\/irs-targeted-more-easy-mark-low-income-families-than-millionaires-says-report-4969669\" target=\"_blank\" rel=\"noopener\"> report<\/a> by \u2062Syracuse University&#8217;s Transactional Records Access Clearinghouse (TRAC) \u200bsaid that the IRS \u2063follows a trend of pursuing more low-income groups\u2063 compared to billionaires and millionaires.<\/div>\n<p>During \u200dfiscal year 2022, \u2064millionaires \u201cdid have the highest odds of \u200cbeing \u200baudited. However, if one ignores the fiction of auditing a millionaire through simply sending \u2064a letter\u200b through the mail, the odds that millionaires received a regular audit by a revenue agent (1.1 percent) was actually less than\u200b the audit rate of the\u2063 targeted lowest-income wage-earners whose audit rate was 1.27 \u200cpercent!\u201d the report said.<\/p>\n<p>The\u200d rate of \u200cincome tax audits \u200bper 1,000 individuals stood\u200d at\u200d 12.7 for the\u200c lowest-income wage earners and 2.3 for everyone\u2064 else. This made low-income wage earners the taxpayer class with, by far, \u200bthe highest audit rates\u2014clocking around five and \u200ca half times more than everyone\u200c else.<\/p>\n<div class=\"my-5\">The report \u2063notes that\u200d low-income wage \u200bearners \u2062have historically been targeted by\u2063 the IRS, not because they account for the \u200bmost underreporting, but because they are seen as \u201ceasy marks in an era when IRS\u200c increasingly relies upon correspondence \u200caudits \u200cyet doesn\u2019t \u200bhave the\u2064 resources\u2064 to assist taxpayers or answer their questions.\u201d  <\/p>\n<h2>Small\u200d Business and Digital Assets<\/h2>\n<p>  Earlier \u2062this \u200cyear, the IRS proposed\u2064 eliminating\u2064 certain <a href=\"https:\/\/www.theepochtimes.com\/article\/irs-moves-to-crack-down-on-tax-shelters-for-small-businesses-5183218\" target=\"_blank\" rel=\"noopener\">tax shelters<\/a>,\u2063 which are used by small businesses.<\/div>\n<p>Known\u200b as &#8220;micro-captive transactions,\u201d these types of \u200cinsurance arrangements allow small businesses to benefit from tax breaks via \u200bcreation of insurance companies\u2014captive insurance companies\u2014to cover potential losses or liabilities.<\/p>\n<p>The agency proposed listing these insurance arrangements as \u200b\u201clisted transactions\u201d or abusive tax transactions.<\/p>\n<p>Even if tax law allows businesses to create &#8220;captive&#8221; insurance companies to protect against\u2063 insurance risks, the \u200cagency claims \u200cthese are \u201cabusive tax shelters.\u201d<\/p>\n<p>Regarding digital asset\u2063 taxation, the IRS plans on increasing scrutiny of digital currency exchanges, crypto\u2063 transfers, trading platforms, and related payment processors.<\/p>\n<div class=\"my-5\">\u201cWe need\u2064 to make\u2063 sure\u200d digital assets are not \u200bused to hide taxable income, \u2063and\u2064 the proposed\u200c regulations are designed \u200cto provide a clearer line of sight into activities by high-income people as well as others using them,\u201d Mr.\u200d Werfel said in \u2064an Aug. 25 <a href=\"https:\/\/www.irs.gov\/newsroom\/treasury-and-irs-issue-proposed-regulations-on-reporting-by-brokers-for-sales-or-exchanges-of-digital-assets-new-steps-designed-to-end-confusion-help-taxpayers-aid-high-income-compliance-work\" target=\"_blank\" rel=\"noopener\">press\u2064 release<\/a>.<\/div>\n<div class=\"my-5\">Businessmen making use of <a href=\"https:\/\/www.irs.gov\/newsroom\/irs-announces-sweeping-effort-to-restore-fairness-to-tax-system-with-inflation-reduction-act-funding-new-compliance-efforts\" target=\"_blank\" rel=\"noopener\">foreign accounts<\/a> will also come under review. For instance, \u200cif a business files five \u200bForms 1099-INT and five Forms W-2, they\u2062 should e-file all their returns electronically for the year, including Forms 8300. If a business \u200cfiles less than 10 \u200cforms, excluding\u2062 Forms 8300, they can opt not to e-file. The $10,000 can \u2063be in a single \u2064transaction or multiple entries.<\/p>\n<p>This initiative is reportedly done to\u200b counter money laundering. Penalties are \u2062applicable in case a business has filed Form 8300\u200d by paper even though they are required to e-file and\u2063 have not secured a waiver or religious exemption.<\/p>\n<p>In case of late returns, businesses should file a late \u200bForm\u2062 8300\u200c in the same way they would a timely one. Penalties would be applicable\u200d for\u2063 late filing as \u200bwell.<\/p>\n<div class=\"my-5\">There\u200d has been\u2062 a \u200bpush by the agency toward electronic filing. In August, the agency announced its \u201cpaperless processing\u200c initiative\u201d that allows individual taxpayers \u2064to submit non-tax documents and correspondence digitally beginning next year.  <\/p>\n<h2>Gig Workers and Delinquent\u2063 Millionaires<\/h2>\n<p>  <a href=\"https:\/\/www.irs.gov\/newsroom\/irs-reminds-gig-workers-self-employed-and-others-of-sept-15-third-quarter-estimated-tax-payment-deadline\" target=\"_blank\" rel=\"noopener\">Gig workers<\/a>, sole proprietors, retirees, partners, \u2064and S corporation shareholders are required by the\u2063 IRS\u2064 to make estimated tax \u200dpayments \u201cif they expect\u2062 to have a tax liability of $1,000 or\u200b more \u200cwhen they file their return.\u201d<\/div>\n<p>Moreover, \u201cTaxpayers who were paid over $600 by \u200dpayment apps and online marketplaces\u200c or received\u200c any amount by payment cards\u2062 could receive a Form 1099-K, Payment Card and Third Party Network Transactions,\u2064 starting January 2024, for payments \u2063received in 2023. This includes anyone with a side hustle, sole proprietors, and \u200canyone \u2062selling goods and services online. It&#8217;s important to remember that taxpayers should report their income, unless \u200bit&#8217;s excluded by law, regardless of whether\u2063 they\u200c receive \u2062a Form 1099-K or any other third-party reporting document.\u201d<\/p>\n<div class=\"my-5\">In August, the agency announced the hiring\u2063 of nearly 700 employees\u2063 to service 42 Taxpayer <a href=\"https:\/\/www.irs.gov\/newsroom\/inflation-reduction-act-1-year-report-card-irs-delivers-dramatically-improved-2023-filing-season-service-modernizes-technology-pursues-high-income-individuals-evading-taxes\" target=\"_blank\" rel=\"noopener\">Assistance Centers<\/a> across the \u2064country.<\/div>\n<p>In the same press release, the agency issued warnings to \u201cdelinquent millionaires\u201d exploiting tax loopholes. \u200c\u201cIRS will\u2063 continue to pursue \u200cmillionaires who do not pay their \u200btaxes as the agency ramps up enforcement capabilities through the Inflation Reduction\u2064 Act.\u201d<\/p>\n<p>The\u2064 examples provided by the agency included\u200d high-income individuals claiming benefits in Puerto Rico who were \u201cattempting\u2064 to avoid U.S. taxation \u200con U.S. source income\u201d without meeting\u200b proper residence\u2063 or criteria \u2064requirements in the U.S. territory.<\/p>\n<p>Besides Puerto Rico, the\u2063 IRS is also targeting offshore funds\u2063 based in Malta, a European country located near Italy.<\/p>\n<div class=\"my-5\">\u201cIRS is working \u200cto identify\u2062 taxpayers who are \u200dimproperly using\u200b Malta-U.S. \u200dTreaty rules to improperly claim exemptions. \u200cInflation Reduction Act resources \u2062will enable\u2064 IRS to detect those who leverage these offshore\u200b schemes.\u201d \u2062  <\/p>\n<h2>Conservation Easements and Public Concerns<\/h2>\n<p>  \u2064 A\u2064 conservation easement preserves a property for future generations through a legal agreement between the \u2062landowner and \u2064a land trust or government agency. The agreement conserves\u2064 the land and limits its use, \u200bwhile offering tax\u200d benefits\u200b to landowners.<\/p><\/div>\n<p>The IRS is now investigating conservation easements, which\u200c have claimed tax benefits, \u2063but broken rules of the agreement\u2062 through property development.<\/p>\n<div class=\"my-5\">The agency claims\u200d that some taxpayers take inappropriately\u200d <a href=\"https:\/\/www.irs.gov\/charities-non-profits\/conservation-easements\" target=\"_blank\" rel=\"noopener\">large deductions<\/a> for easements, and, in \u2062some cases, take deductions when they\u2019re not entitled to it.<\/div>\n<p>They have issued warnings against taxpayers who have developed these properties in a\u2064 manner inconsistent with section\u200d 501(c)(3).<\/p>\n<p>The IRS is commissioned with\u200b extraordinary federal powers to police the finances of the private\u2063 citizen. Without committing to\u2062 similar high levels \u200dof integrity, the\u200d agency can easily commit oversights that \u200chave severe adverse impacts on the lives of the people.<\/p>\n<div class=\"my-5\">The agency has been accused of severe\u200b failings in safeguarding sensitive <a href=\"https:\/\/www.theepochtimes.com\/us\/irs-failing-to-protect-sensitive-taxpayer-information-watchdog-5490433\" target=\"_blank\" rel=\"noopener\">taxpayer information<\/a>. A governmental watchdog revealed in a September report that agents and \u2063contractors received \u200dinadequate training\u2063 while the agency did not make requisite changes according to\u200c the watchdog\u2019s 2010 recommendations.<\/div>\n<div class=\"my-5\">In July, dozens of IRS \u200cagents armed \u200din <a href=\"https:\/\/www.theepochtimes.com\/us\/dozens-of-armed-irs-agents-in-tactical-gear-raid-florida-business-report-5409807\" target=\"_blank\" rel=\"noopener\">tactical gear<\/a> raided\u200c a business\u2063 in \u2064Florida, with witnesses claiming the force removed evidence from\u200d the premises in bags and boxes. \u200cThe show of force received blowback from Republican lawmakers who claimed that \u2064providing the agency with \u2064more funds will result in similar scenarios.<\/div>\n<div class=\"my-5\">A job <a href=\"https:\/\/www.theepochtimes.com\/us\/republican-fears-an-irs-armed-and-ready-to-audit-4659186\" target=\"_blank\" rel=\"noopener\">advertisement<\/a> for IRS agents raised eyebrows and incited thousands of\u2064 comments across social media when it asked\u2062 for people \u201cwilling to use deadly force.\u201d The <a href=\"https:\/\/www.usajobs.gov\/job\/724185000#duties\" target=\"_blank\" rel=\"noopener\">job page<\/a> has\u200d since removed the requirement.<\/div>\n<p>Public concern has been\u200c growing over the militarization of IRS agents. It remains to be seen \u200bwhether IRS agents, new and old, will increase their efforts in investigating potential \u200btax fraud within high-income categories or will resort to harassing the average\u2062 low- and\u2062 mid-income citizen with a \u200dplethora of new regulations\u2064 and \u200dcomplicated tax rules.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The IRS is intensifying its efforts to target businesses and individuals, aiming to hold them accountable.
