Returns\u200d to Supreme Court as Biden Administration Seeks Control<\/h2>\n<p>The ongoing legal battle over &#8220;ghost\u2062 guns&#8221; has returned to the U.S. Supreme Court, \u2064where the Biden administration aims to regain authority over these &#8220;untraceable firearms,&#8221; wrote Mr. Prelogar in her \u200b <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/23A302.html\" target=\"_blank\" rel=\"noopener\">petition<\/a>.<\/p>\n<p>&#8220;The \u2062Court&#8217;s answer should be the same as it was two months ago,\u201d she added, having argued that without the \u2063Supreme Court&#8217;s relief, \u201cuntraceable ghost guns will remain\u200b widely available.\u201d<\/p>\n<p>The prior Aug. \u200b28 high court order in question was an administrative stay issued by Justice Samuel\u2064 Alito that allowed the \u200benforcement of an ATF rule designed to regulate &#8220;ghost guns&#8221; by defining them as firearms.<\/p>\n<p>\u201cGhost guns\u201d is a pejorative term for partially completed frames \u2062and kits that can be purchased and assembled into functional firearms.\u2064 The Biden administration wants to impose a rule that makers of these \u200b\u201cghost\u2062 guns\u201d must obtain licenses, mark their products with serial numbers, maintain transaction records, and conduct background checks.<\/p>\n<p>This rule was first \u2063blocked nationwide by Judge Reed O&#8217;Connor of the Northern District of Texas, an appointee of former President George W. Bush, on July 5. This ruling was then challenged in the Supreme Court, where Justice \u2064Alito intervened, issuing a temporary administrative stay.<\/p>\n<div class=\"post-figure\">\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Demonstrators gather for a Second Amendment rally at the Washington State Capitol in Olympia, Wash., on March 20, 2021. (David Ryder\/Getty Images)<\/figcaption><\/figure>\n<\/div>\n<h2>&#8216;Biden Admin Is Now in the Worst Place They Could\u200b Be&#8217;<\/h2>\n<p>Following the high court&#8217;s stay, two \u2062of the plaintiffs, a pair of \u200bfirearm frame and receiver makers,\u2062 returned to the Texas\u200d district court, asking\u2062 it to enjoin \u2062the ATF from \u200benforcing the rule specifically against them pending appeal.<\/p>\n<p>Judge O&#8217;Connor\u200c granted this\u2062 extraordinary\u2063 relief on Sept.\u2064 14. Furthermore, the Fifth Circuit \u2063Court of Appeals subsequently partially\u200c upheld the district court&#8217;s ruling.<\/p>\n<p>&#8220;[C]ourts should be able to review \u200cATF\u2019s 98-page rule, and the decades of precedent it attempts to change, without the\u200c Government putting people in jail or shutting down businesses,&#8221; \u2064the Firth \u2064Circuit Court \u2063of Appeals <a href=\"https:\/\/ddlegio.com\/wp-content\/uploads\/2023\/10\/Fifth-Circuit-Order.pdf\" target=\"_blank\" rel=\"noopener\">ruling stated<\/a>.<\/p>\n<p>This ruling effectively \u2064allowed the two plaintiff \u200bcompanies, Defense Distributed and 80 Percent Arms, to\u2063 hold a monopoly as the only businesses allowed\u2063 to sell firearm frames and kits to make &#8220;ghost guns&#8221; while appeals proceedings play out\u2014a fact\u200c they touted in gloating statements following the ruling.<\/p>\n<div class=\"post-figure\">\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>&#8220;Ghost guns&#8221; seized \u200cin <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soros-backed-u-s-attorney-resigning-after-doj-ig-accuses-her-of-election-interference-lying-to-feds-reports\/\" title=\"US attorney, supported by Soros, resigns after DOJ IG accuses her of election interference and lying to federal authorities.\">federal law enforcement actions<\/a> are displayed at the Bureau of Alcohol, Tobacco, \u200dFirearms, and Explosives (ATF) field office in Glendale, Calif., on April 18, 2022. Robyn Beck\/AFP via Getty Images)<\/figcaption><\/figure>\n<\/div>\n<div class=\"my-5\">\n<h2>&#8216;Biden Admin Is Now in the Worst Place They Could Be&#8217;<\/h2>\n<\/div>\n<p>In an Oct. 2 <a href=\"https:\/\/www.80percentarms.com\/ATF-RULE-FAQ\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>, 80 Percent Arms said they remain unwaveringly dedicated to &#8220;champion[ing] the right of every <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">law-abiding citizen<\/a> to privately craft \u2063firearms.&#8221;<\/p>\n<p>In appealing the district court&#8217;s \u2063decision, Ms. Prelogar told the justices in her filing that Judge O&#8217;Connor\u2064 relied on the same facts that had been considered by the Supreme Court, \u200b\u201cyet reached diametrically opposing conclusions.\u201d<\/p>\n<p>\u201cThe district court insisted that the government is unlikely to succeed in reversing the \u200ccourt\u2019s\u200c vacatur, that barring the government from enforcing the Rule would impose no irreparable harm, and that\u200b the balance of the\u2063 equities favors respondents,\u201d\u2063 she \u2062wrote in her filing.<\/p>\n<p>\u201cThe Fifth Circuit then relied on substantially similar reasoning to deny the government\u2019s motion to vacate the injunction, dismissing the argument \u200dthat the injunction violates principles of vertical stare decisis,\u201d \u2063Ms. Prelogar continued.<\/p>\n<p>The solicitor general acknowledged that the district court&#8217;s \u2063injunction \u201cis narrower\u201d than the prior July 5 ruling. However, she argued that it\u200d should be vacated because it \u201cimposes \u200cessentially the same harms on the government and public&#8221; because the two companies continue to sell \u200btheir products online &#8220;without background checks.&#8221;<\/p>\n<div class=\"post-figure\">\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>President Joe\u2063 Biden holds up a ghost gun kit during an event in the Rose Garden of the White House in Washington on April 11, 2022.\u2063 (Drew Angerer\/Getty Images)<\/figcaption><\/figure>\n<\/div>\n<p>The ATF&#8217;s updated rules, which went into effect in August 2022, redefined terms like\u200c &#8220;firearm,&#8221; &#8220;frame,&#8221; and \u2063&#8221;receiver&#8221; under the Gun Control Act of 1968 to address the proliferation of \u201cghost guns\u201d assembled from kits.<\/p>\n<p>The government argues that having no requirements for background checks, serial numbers, and other factors makes them attractive to criminals. On April 11, 2022, President Joe Biden vowed to crack down\u2063 on &#8220;ghost guns.&#8221;<\/p>\n<div class=\"my-5\">\n<h2>&#8216;Biden Admin Is Now in the Worst Place They Could Be&#8217;<\/h2>\n<\/div>\n<p>&#8220;These guns\u2062 are weapons of choice for\u2064 many criminals,&#8221; he <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/04\/11\/press-briefing-by-press-secretary-jen-psaki-april-11-2022\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in the Rose Garden at the White \u2062House on April 11, 2022.\u00a0&#8220;We&#8217;re going\u200c to do everything we \u200ccan to deprive them of that choice and,\u2064 when we find them, put them in jail\u2063 for a long, long time.&#8221;<\/p>\n<p> <\/p>\n<h2> \u2064What are the arguments for and\u200d against regulating &#8220;ghost guns&#8221; in relation to public safety and Second Amendment rights?<\/h2>\n<p><span>  \u200cUle will not harm the public interest, \u200band that\u200b enforcing the\u2064 rule pending appeal is equitable,\u201d\u2062 the petition stated.<\/p>\n<p>Ms. Prelogar argued that the lower court&#8217;s decision \u2062undermined the Supreme Court&#8217;s \u2063authority and created confusion\u2064 and inconsistency in the enforcement\u2063 of \u200bfederal regulations.<\/p>\n<p>If the Supreme Court agrees to hear the case, it could have significant implications for the regulation of &#8220;ghost guns&#8221; and the\u2062 Biden administration&#8217;s efforts\u200c to control their proliferation.<\/p>\n<p>Proponents \u200cof\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-returns-to-supreme-court-in-ongoing-ghost-gun-battle\/\" title=\"Biden Administration renews 'Ghost Gun' fight at Supreme Court.\">stricter gun control measures argue<\/a> \u200bthat &#8220;ghost guns&#8221; pose a significant\u2063 threat\u200c to public safety, as they can be\u200c obtained without a background check and lack traceability.<\/p>\n<p>Opponents, on the other hand, assert that regulating\u2064 &#8220;ghost guns&#8221; infringes on \u200dSecond \u2063Amendment \u2064rights, as individuals\u2063 have the right to privately assemble\u2063 firearms \u2063for personal\u2062 use.<\/p>\n<p>The outcome\u200b of this legal battle will \u200dlikely have far-reaching consequences for both gun control advocates and Second Amendment proponents.
