Ron \u200dDeSantis<\/a> in May,\u200b allows for the death penalty to be imposed when the victim \u2063in a sexual \u2064assault case \u2063is under the age of 12,\u2062 according to <a href=\"https:\/\/www.news4jax.com\/news\/local\/2023\/10\/01\/death-penalty-for-child-rape-goes-into-effect-in-florida\/\" target=\"_blank\" rel=\"noopener\">WJXT-TV<\/a> in Jacksonville.<\/p>\n<p>DeSantis, who is now a Republican\u200d presidential candidate, expressed his intention to challenge \u200bthe \u200b2008 Supreme \u2064Court ruling that banned\u200c executions for child rape when the victim\u200d survives.<\/p>\n<blockquote>\n<p>\u201cWe think that decision was wrong,\u201d he said, according to\u2062 <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2023\/05\/01\/desantis-allows-death-penalty-child-rape-defies-supreme-court\/70171868007\/#:~:text=Florida%20Gov.,press%20conference%20in%20Brevard%20County.\" target=\"_blank\" rel=\"noopener\">USA Today<\/a>.<\/p>\n<\/blockquote>\n<p>Since 2008, the composition of the Supreme Court has changed, and recent rulings on various issues have indicated \u200da conservative majority\u2062 that could potentially shift existing\u200c precedents.<\/p>\n<blockquote>\n<p>\u201cThis bill \u200dsets up a procedure to be able\u2063 to\u2064 challenge that precedent and to be able to say that, in Florida, we think that the worst of the worst crimes deserve the worst of the \u200cworst punishment,\u201d the governor stated, according to <a href=\"https:\/\/apnews.com\/article\/death-penalty-child-rape-desantis-florida-9b03e9cd5a96f68967c3e06a299ff2a7\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a>.<\/p>\n<\/blockquote>\n<p>If \u200bthis law is applied \u2064in\u2063 a child rape case, it can be appealed to the U.S. Supreme Court through the Florida Supreme Court.<\/p>\n<p>The law\u200b grants judges \u200bthe discretion to \u200cimpose \u2063the \u200cdeath penalty if at least eight members\u2062 of a jury vote in favor of it, as \u200breported by the South Florida <a href=\"https:\/\/www.sun-sentinel.com\/2023\/09\/26\/death-penalty-for-child-rapes-to-take-effect-in-florida\/\" target=\"_blank\" rel=\"noopener\">Sun-Sentinel<\/a>.<\/p>\n<blockquote>\n<p>\u201cThe perpetrators of these crimes are oftentimes serial offenders,\u201d <a href=\"https:\/\/www.westernjournal.com\/desantis-florida-hits-biden-admin-lawsuit-alleges-white-house-intent-driving-country-ground\/\">DeSantis<\/a> emphasized when signing the bill \u2064into law,\u200c according to <a href=\"https:\/\/www.cnn.com\/2023\/05\/01\/politics\/desantis-child-rapists-death-penalty-bill-scotus\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<\/blockquote>\n<p>DeSantis \u200dcelebrated the implementation \u200bof \u200cthe \u200bnew law in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-this-average-american-is-voting-for-donald-trump\/\" title=\"Why This Average American Is Voting for Donald Trump\">social media post<\/a> on Tuesday.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Florida\u2019s \u2063law allowing the death penalty for child rapists is \u200cnow in effect.<\/p>\n<p>The minimum sentence is life in prison\u200b without parole.\u2064 In\u200c Florida, anyone who harms children\u200b in such a horrific way will never walk free.<\/p>\n<p>\u2014 Ron DeSantis (@GovRonDeSantis) <a href=\"https:\/\/twitter.com\/GovRonDeSantis\/status\/1709314869793562973?\">October 3, 2023<\/a><\/p>\n<\/blockquote>\n<p>However, critics argue that\u200b the \u2064Florida law contradicts the 2008 Supreme Court ruling\u200b in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/407\/\" target=\"_blank\" rel=\"noopener\">Kennedy v. Louisiana<\/a> that invalidated a similar law, citing the Eighth Amendment&#8217;s prohibition of \u200d&#8221;cruel and unusual punishments.&#8221;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The Supreme\u200d Court ruled in\u2064 Kennedy v.
