The injunction prevents the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) from enforcing its stabilizing brace rule against the two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-texas-lawsuit-could-freeze-bidens-attempt-to-turn-pistol-brace-owners-into-felons-with-new-injunction-request\/\" title=\"Exclusive: Texas Lawsuit Could Freeze Biden\u2019s Attempt To Turn Pistol Brace Owners Into Felons, With New Injunction Request\">pistol brace owners<\/a>, \u2062William T. Garland argued \u2063that the ATF&#8217;s new stabilizing brace criteria were arbitrary and ran contrary to\u2062 previous guidance the agency had\u2062 given about such stabilizing braces.<\/p>\n<p>The plaintiffs further argued that the new rule ran afoul\u200c of Congress&#8217;s legislative role, and came\u2064 as a\u2064 result \u2063of\u2063 President Joe \u200bBiden&#8217;s push for new gun regulations. The plaintiffs \u200cargued that the \u2063ATF&#8217;s new stabilizing brace rule amounted\u200b to legislation \u2064by an executive branch agency,\u2064 in \u200bviolation of\u2062 the Administrative Procedures Act (APA).<\/p>\n<p>In\u2063 granting the injunction, Judge \u2063O&#8217;Connor\u200d assessed\u200d that the plaintiffs have \u2063a substantial likelihood to succeed on the merits \u2062of their\u2064 lawsuit, and that the plaintiffs face irreparable harm without such an injunction.<\/p>\n<p>&#8220;The ATF\u2019s \u2063own regulatory analysis concludes that the Final\u2062 Rule has effectively \u200dreclassified 99% of all pistols with \u2063stabilizing braces\u2062 to NFA rifles. Through seminal \u200cFinal Rule adjudications, the ATF has already reclassified a whole\u2063 host\u200c of specific weapons \u200bplatforms and commercially available braced firearms to NFA rifles,&#8221; Judge O&#8217;Connor\u200b wrote. &#8220;Upon \u200breview of this \u2062record in conjunction with Plaintiffs\u2019 declarations,\u200c there is no doubt\u2063 that the Final \u2064Rule will subject both FPC \u200dmembers to criminal liability for currently possessing each of \u2062their\u200b braced pistols.&#8221;<\/p>\n<p>Judge O&#8217;Connor also determined that the ATF&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-blocks-atf-from-enforcing-pistol-brace-rule-against-certain-gun-rights-activists-manufacturer\/\" title=\"Federal court stops ATF from enforcing pistol brace rule on gun rights activists, manufacturer.\">stabilizing brace rule runs afoul<\/a> of the\u2063 U.S. Supreme Court&#8217;s \u2064ruling in D.C. v. Heller, which found that the Second Amendment covers \u200ban\u2064 individual right to\u2062 bear\u2062 arms and covers arms \u200dthat are in &#8220;common use.&#8221;<\/p>\n<p>&#8220;The \u200cCourt finds that the braced\u2063 pistols subject to enforcement \u2064of the Final Rule are \u2064in\u200c common use \u2063today,&#8221; Judge O&#8217;Connor wrote.<\/p>\n<p>Mock v.\u200d Garland is one of three federal cases in\u2064 which judges have granted \u200bpreliminary injunctions to stop the\u2062 ATF&#8217;s enforcement of its stabilizing\u2064 brace rule. In\u2063 May, another \u2064judge \u2063from Texas&#8217;\u200c Northern federal court district <a href=\"https:\/\/www.theepochtimes.com\/us\/second-federal-judge-temporarily-blocks-atf-pistol-brace-rule-ahead-of-registration-deadline-5294580\" target=\"_blank\" rel=\"noopener\">granted an injunction<\/a> \u200bin Second Amendment \u200dFoundation (SAF), et al v. ATF, \u2064et \u2064al. A judge in Texas&#8217; Southern\u2063 federal court district also granted an <a href=\"https:\/\/i.ntd.com\/assets\/uploads\/2023\/10\/id945951-Tipton-Order.pdf\" target=\"_blank\" rel=\"noopener\">injunction<\/a> in May, in a case brought\u200d by\u200b the state of Texas, Gun Owners of America, Gun Owners Foundation and a private citizen named\u2064 Brady\u2062 Brown.<\/p>\n<p>Each injunction bars \u2062the ATF from enforcing its stabilizing brace rule\u2063 against the specified plaintiffs in \u2062each\u2063 of the three\u2064 cases.<\/p>\n<p>NTD News reached out to a Department of Justice lawyer\u2062 representing the defendants in Mock v. Garland. \u2063She\u200b did \u200dnot respond by the time this article was published.<\/p>\n<p><em>From <a href=\"https:\/\/www.ntd.com\/federal-court-blocks-atf-from-enforcing-pistol-brace-rule-against-certain-gun-rights-activists-manufacturer_945919.html\" target=\"_blank\" rel=\"noopener\">NTD News<\/a><\/em><\/p>\n<p> <\/p>\n<h2> How does the plaintiffs&#8217; argument \u200cabout the separation of powers in the United States government relate to the ATF&#8217;s rule and its implementation process?<\/h2>\n<p><span>  The record, the Court finds that the ATF appears to have made its decision based on\u2063 political considerations, rather than on any \u200breasoned analysis of the \u2062facts and the law.&#8221;<\/p>\n<p>The preliminary injunction prevents the ATF from enforcing its \u200dstabilizing brace rule against the plaintiffs and other individuals affected by the rule. It also extends to pistol-brace manufacturer Maxim Defense Industries LLC and its customers who would otherwise be subject to the ATF&#8217;s \u2062enforcement \u2062actions.<\/p>\n<p>The issue at the heart of this case is the classification of &#8220;braced pistols&#8221; under the National Firearms Act. The ATF&#8217;s stabilizing brace rule introduced a scoring sheet to determine whether a braced pistol should be reclassified as a short-barreled rifle, \u200bsubjecting\u2064 it to more stringent regulations. The plaintiffs argue that \u2062this rule \u2064is arbitrary and\u2064 inconsistent with the ATF&#8217;s previous guidance on stabilizing braces.<\/p>\n<p>The plaintiffs&#8217;\u200b complaint also raises concerns about the separation of powers in \u2062the United States government. They argue that the ATF&#8217;s rule amounts\u2064 to legislation\u200d by an executive\u200b branch agency, which violates the Administrative Procedures Act. They contend that\u2064 the rule was implemented as a result of President Joe Biden&#8217;s push \u2062for new gun regulations, rather \u2063than a proper legislative process in Congress.<\/p>\n<p>Judge\u2064 O&#8217;Connor&#8217;s decision to grant the preliminary injunction is based on his assessment that the \u2063plaintiffs \u200dhave a strong likelihood of success in their lawsuit and would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-governors-effort-to-end-unemployment-benefits-blocked-by-judge\/\" title=\"Maryland Governor\u2019s Effort To End Unemployment Benefits Blocked By Judge\">suffer irreparable harm<\/a> without the injunction.
