It\u2019s clear\u200b to me he\u2019s <a href=\"https:\/\/news.yahoo.com\/why-jack-phillips-matters-183432960.html\" target=\"_blank\" rel=\"noreferrer noopener\">going<\/a> \u200d to be \u200d <a href=\"https:\/\/www.nationalreview.com\/2021\/03\/the-never-ending-persecution-of-jack-phillips\/\" target=\"_blank\" rel=\"noreferrer noopener\">badgered<\/a> into the grave by <a href=\"https:\/\/www.nationalreview.com\/2021\/06\/the-crusade-to-destroy-jack-phillips-continues\/\">authoritarians<\/a> intent on punishing him for <a href=\"https:\/\/thefederalist.com\/2022\/10\/06\/the-never-ending-persecution-of-jack-phillips\/\" target=\"_blank\" rel=\"noreferrer noopener\">thought crimes<\/a>. From the first time his name appeared\u200c in the news\u2064 until this day, the media have misled the \u2064public about him, about the case, and \u2062about the \u2063law.<\/p>\n<p>The latest chapter in Phillips\u2019 \u2062Kafkaesque saga involves a transgendered lawyer named Autumn \u200dScardina, who demanded \u2063Phillips create a pink cake with blue \u2064frosting to\u200b help celebrate a \u201cgender transition.\u201d As expected, Phillips, who\u2019d already\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/authoritarian-thugs-continue-their-persecution-of-jack-phillips\/\" title=\"Authoritarian thugs persist in persecuting Jack Phillips.\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ghislaine-maxwell-convicted-in-epstein-sex-abuse-case\/\" title=\"Ghislaine Maxwell Convicted in Epstein Sex Abuse Case\">spent years fighting<\/a> \u2064government coercion<\/a>, refused to participate.<\/p>\n<blockquote>\n<p>The Colorado Civil \u2063Rights Commission agreed that Scardina had been discriminated against as \u200c\u201ca transgendered person.\u201d\u2063 Then, the dishonorable A.\u200c Bruce Jones of the Second\u2064 Judicial District upheld the \u2063commission\u2019s flagrant attack on free \u200bexpression.\u2064 Now, the Colorado Supreme Court has <a href=\"https:\/\/www.nbcnews.com\/nbc-out\/out-politics-and-policy\/colorado-high-court-hear-case-christian-baker-refused-make-trans-theme-rcna118815?cid=sm_npd_nn_tw_ma&#038;taid=651d9a5674209d0001cd9596&#038;utm_campaign=trueanthem&#038;utm_medium=social&#038;utm_source=twitter\" target=\"_blank\" rel=\"noreferrer noopener\">agreed<\/a> to take up\u2064 the case.<\/p>\n<\/blockquote>\n<p>The entire case is built on ludicrous contortions of logic and law. The Colorado Court of Appeals, for instance, ruled in favor of \u200bScardina, contending that the colors pink and blue aren\u2019t really speech because, in and of themselves, they aren\u2019t expressive of anything. \u2064The message, says the court, is \u201cgenerated \u200bby the\u200d observer.\u201d<\/p>\n<p><em>Yes.<\/em> Because \u2063Phillips isn\u2019t a complete idiot, he understands that context matters. The color white has no \u2062inherent meaning,\u200b either. If \u200ca known Klansman asks a tailor to fit him for some white sheets, it\u2062 definitely does.<\/p>\n<p>Then \u2063again, if you believe Scardina just happened to approach the most famous Christian\u200d baker in \u2063the country to create a \u201ctransition\u201d cake <em>the day <\/em>after the Supreme\u2064 Court\u2019s <em>Masterpiece <\/em>ruling\u200b was\u2063 dropped<em> <\/em>in 2017<em>, <\/em>you\u2019re certainly an idiot.\u200c The entire Scardina episode, including the configuration of the cake \u2014\u200c using colors but no words \u2014 was calibrated to set Phillips up.<\/p>\n<blockquote>\n<p>In the initial complaint to the Civil Rights Commission, Scardina <a href=\"https:\/\/adflegal.org\/sites\/default\/files\/2020-09\/Scardina%20v.%20Masterpiece%20Cakeshop%20-%20Motion%20to%20dismiss.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> to be \u201cstunned\u201d by \u200cPhillip\u2019s rejection. It should be noted, because it isn\u2019t in any of today\u2019s media coverage, \u2063that Phillips\u2019s lawyers had very good reason to suspect Scardina,\u200d whose name appeared on a caller ID, first requested \u201can image of Satan smoking marijuana.\u201d Later, an email was sent \u200bto the shop requesting \u201ca three-tiered white cake\u201d with a \u201clarge figure of \u2062Satan, licking a [nine-inch] black Dildo \u2026 that can be turned on before we \u200bunveil\u200b the cake.\u201d<\/p>\n<\/blockquote>\n<p>Then again, Scardina admitted it was a \u200dsetup. As \u2063Associated Press <a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/jack-phillips-masterpiece-cakeshop-lakewood-transgender\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> last\u2064 year, according to the activist\u2019s lawyer, \u201cShe\u200b [sic] called Phillips\u2019 Masterpiece Cakeshop to \u200dplace the\u2064 order after hearing about the court\u2019s announcement because she [sic] wanted to find out if he really \u200cmeant it \u2026 It was more of\u200c calling someone\u2019s\u200c bluff.\u201d<\/p>\n<p>There was no bluff to call. Phillips isn\u2019t \u2062going to create\u200c cakes to celebrate gay weddings or gender transitions\u200d or the grand openings of strip clubs or bawdy \u2063bachelor parties or for a \u2018happy divorce!\u2019 or any other event that undermines his faith. And even if he \u200dwas the\u200c biggest hypocrite in all of Christendom \u2014 which he most certainly \u200disn\u2019t \u2014 it wouldn\u2019t change anything. Americans don\u2019t have to justify their free \u2064expression to anyone.<\/p>\n<p>Scardina \u200cclaims the\u2062 lawsuit was intended to \u201cchallenge the veracity\u201d of Phillips\u2019 claim\u200d that he \u2063would serve \u200d\u201cLGBTQ\u201d customers.\u2063 This is the central\u2064 lie of the \u2062case. Phillips never once refused \u200cto sell a gay couple or a \u2063transgender person or anyone else anything in his store. But Phillips isn\u2019t Autumn Scardina\u2019s servant, and\u200d the government has no right to compel him \u200bto endorse\u200d or participate in any\u200b lifestyle.<\/p>\n<blockquote>\n<p>Speaking of which, the media keeps contending \u200cthat Phillips is looking for a <a href=\"https:\/\/www.google.com\/search?q=%22carve+out%22+discrimination+law+phillips&#038;sca_esv=570966760&#038;rlz=1C5CHFA_enUS913US913&#038;sxsrf=AM9HkKnrl6A5JE0WnDJCyNbGZAFPn6--oA%3A1696517350660&#038;ei=5sweZYblJ_yr5NoPgfeUiAM&#038;ved=0ahUKEwiG8KnQk9-BAxX8FVkFHYE7BTEQ4dUDCBA&#038;uact=5&#038;oq=%22carve+out%22+discrimination+law+phillips&#038;gs_lp=Egxnd3Mtd2l6LXNlcnAiJyJjYXJ2ZSBvdXQiIGRpc2NyaW1pbmF0aW9uIGxhdyBwaGlsbGlwczIHECEYoAEYCjIHECEYoAEYCjIHECEYoAEYCkjeDlCPBFjuDXAAeAKQAQCYAZEBoAHpBqoBAzUuM7gBA8gBAPgBAcICBBAAGEfCAgUQIRigAcICCBAhGBYYHhgdwgIFECEYqwLiAwQYACBBiAYBkAYI&#038;sclient=gws-wiz-serp#ip=1\" target=\"_blank\" rel=\"noreferrer noopener\">religious<\/a> \u200d\u201ccarve\u2062 out\u201d in anti-discrimination law \u2014 or something along those lines. <em>No such thing exists<\/em>. It is unclear if the people who write those words are unfamiliar with the First Amendment \u200dor \u2062just instinctively dismiss it, but religious liberty and free expression are\u2062 explicitly\u2063 protected by law.\u200d Anything that infringes on those\u2063 rights\u200d is the \u201ccarve out,\u201d not the other\u2063 way around. If \u201canti-discrimination\u201d laws \u2064dictate that the government can compel Americans to express ideas they disagree \u2062with, as Colorado does,\u2064 then <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fairfax-county-schools-accused-of-defying-youngkin-transgender-student-policies\/\" title=\"Fairfax County schools accused of defying Youngkin's transgender student policies.\">anti-discrimination\u2063 laws<\/a> need to be overturned, \u2064 <em>tout de \u2063suite.<\/em><\/p>\n<\/blockquote>\n<p>At this \u200cpoint, the best-case scenario is for Phillips\u2019 case to reach SCOTUS, so the court\u2064 can either repair the \u2063 <em>Masterpiece<\/em> decision \u2014 which basically provided \u2062the state\u200d and activists with a guidebook on bullying\u200b people of faith \u2064(basically, don\u2019t show public animosity while doing it) \u2014 or \u200bshelve the\u2063 First \u200dAmendment.<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n<p> <\/p>\n<h2> What controversial demand did transgender\u200d lawyer Autumn Scardina make to Jack \u200dPhillips, and how did he \u200brespond?<\/h2>\n<p><span>  Article-content<\/p>\n<h2>Jack\u2064 Phillips:\u2062 A Victim of \u2064Persecution<\/h2>\n<p>The case against \u2062Jack Phillips, a Denver-area baker, has been \u200dongoing for over a decade.
