(Lucas Jackson\/Reuters)<\/figcaption><\/figure>\n<\/div>\n<p><strong>&#8220;In sum, the trial court erred when it admitted Webber&#8217;s and Moline&#8217;s \u2064testimony about cleavage fragments and Longo&#8217;s extrapolation testimony,&#8221; the ruling said.<\/strong><\/p>\n<p><strong>&#8220;These errors, taken \u200bsingularly or collectively, were harmful and\u2063 require\u2064 the reversal of the jury\u2062 verdict.&#8221;<\/strong><\/p>\n<p>The \u2064judges also found the trial \u2064court failed to fulfill its \u200d&#8221;gatekeeping role&#8221;\u2062 of assessing whether the plaintiffs&#8217; experts \u2062based their testimony on sound science.<\/p>\n<p>Chris Placitella, a\u200d New\u200c Jersey attorney who helped represent Mr. Barden, \u200dMr. Etheridge, \u2063Ms. McNeill-George,\u200b and Mr. Ronning told CBS in a statement his clients are \u2062disappointed \u2064in the \u200dappeals court&#8217;s decision.<\/p>\n<p>&#8220;Everyone involved knew that no matter what the\u2063 result this case would eventually be presented\u200c to the New Jersey Supreme Court,&#8221; he \u200bsaid.<\/p>\n<p>&#8220;We look forward to the opportunity to do so.&#8221;<\/p>\n<p>Johnson &#038; Johnson has maintained its products\u2063 are safe and the lawsuits have no \u200bmerit.<\/p>\n<p>In an Aug. 11, 2022 statement announcing the discontinuation of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-tosses-223-8-million-verdict-against-jj-in-talc-cancer-case\/\" title=\"J&#038;J's 3.8 million talc cancer verdict overturned by court.\">talc powder products<\/a> in\u2062 question, the \u200dpharma company reiterated its stance.<\/p>\n<div class=\"my-5\">\n<p>&#8220;We stand firmly behind the decades of independent scientific analysis by medical experts around\u200c the world that confirms talc-based Johnson&#8217;s Baby Powder is safe, does not contain asbestos,\u200d and does not cause cancer,&#8221; the company said.<\/p>\n<\/div>\n<h2>Mountain\u2063 of Lawsuits Against \u2062Pharmaceutical\u200d Company<\/h2>\n<p>Johnson &#038; Johnson has faced <a href=\"https:\/\/www.theepochtimes.com\/article\/jj-must-pay-18-8-million-to-california-cancer-patient-in-baby-powder-suit-5408196\" target=\"_blank\" rel=\"noopener\">thousands of\u2064 lawsuits<\/a> \u200cover allegations\u200d its talc products can contain asbestos and cause cancer.<\/p>\n<p>The pharmaceutical firm attempted to stave off the \u2063flood of litigation with\u200c an April 4 proposal of a $8.9 billion settlement, payable over 25 years, to resolve all the current and future talc claims.<\/p>\n<p>The proposal and\u200c the \u2062Chapter 11 filing of\u2063 Johnson &#038; Johnson&#8217;s subsidiary LTL Management were eventually rejected by\u200b federal judge Michael B.
