That study was not\u200d at issue in Tuesday\u2019s decision.<\/p>\n<p>Moline, who has \u200dtestified for plaintiffs in more than 200 talc cancer cases,\u00a0has argued\u00a0that the lawsuit is an effort to \u201cintimidate\u201d \u200dscientific experts and prevent them \u200cfrom testifying against the company.<\/p>\n<p>J&#038;J faces more than\u2062 38,000 lawsuits alleging that its talc products, including Johnson\u2019s baby powder, can contain asbestos, and caused cancers including ovarian cancer and mesothelioma, a type of cancer linked to \u2063asbestos exposure.<\/p>\n<p>The claims have a mixed \u200crecord of success, with major plaintiff wins including a $2.1 billion judgment\u200d awarded to 22 women with ovarian cancer. That verdict was upheld by an \u2064appeals court, and the U.S.\u200d Supreme Court declined to review it.<\/p>\n<p>J&#038;J has recently won reversals of some cases that went against it, including of\u2063 a $117 million verdict in\u2063 the\u2062 same New Jersey appeals court and a $120 million verdict\u200d in New York.<\/p>\n<p>The company\u2019s latest win comes after it\u00a0failed for a second time\u00a0in July \u2064to move tens of thousands of claims over talc into bankruptcy court, where it hoped to resolve them through a proposed $8.9 billion settlement. \u2062It is appealing that ruling.<\/p>\n<p>Trials had mostly been on hold while J&#038;J petitioned the bankruptcy court, but\u2063 will now be able to resume.
