The judge \u2064also revoked the business licenses of President Trump and\u2064 his adult sons Eric Trump and Donald Trump\u2064 Jr., and he ordered the \u2064dissolution of Trump Organizations and its\u2064 various companies, although the details of that still have to be \u2062hashed out\u200d in court.<\/p>\n<p>The appeals court had agreed \u2062to an emergency\u200b ruling\u2063 when President Trump \u200csought to delay the trial. The former president sued Justice Engoron on \u2064Sept. 14, claiming that the judge had ignored a June ruling from an appeals court that President Trump claimed should render the \u200ccase beyond the statute of limitations.<\/p>\n<\/div>\n<\/blockquote>\n<h2>Related Stories<\/h2>\n<ul>\n<li>\n<h3>Trump Fraud Case Witness List Includes Trump and \u2063Children, Business Associates<\/h3>\n<p>9\/28\/2023<\/p>\n<\/li>\n<li>\n<h3>Trump Lawyers Ask for More Time in Jack Smith&#8217;s Jan. 6 Case<\/h3>\n<p>9\/28\/2023<\/p>\n<\/li>\n<\/ul>\n<blockquote>\n<p>In its Sept. 28 decision, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-blocks-big-tech-attempt-to-regulate-online-speech\/\" title=\"Appeals Court Blocks Big Tech Attempt to Regulate Online Speech\">appeals court lifted<\/a> an order to pause the case proceedings as well as the motion\u2063 to\u200c delay.<\/p>\n<\/blockquote>\n<div class=\"my-5\">\n<p>President Trump&#8217;s legal team has indicated that they will appeal Justice Engoron&#8217;s decision.<\/p>\n<h2>Partial Ruling<\/h2>\n<p>Ms. James\u2062 is seeking $250 million in\u2062 damages and has brought seven\u200c claims against President Trump in her civil\u2063 case.<\/p>\n<\/div>\n<p>Last month, she asked Justice\u2062 Engoron for a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-issues-lengthy-statement-after-new-york-fraud-ruling\/\" title=\"Trump responds to New York fraud ruling with a lengthy statement.\">pre-trial summary judgment<\/a>, or decision, on one of the seven claims\u2014that President Trump had inflated his net\u2064 worth by up to $2.2 billion,\u2064 defrauding lenders and \u2063insurers.<\/p>\n<p>Justice Engoron \u2064found\u2064 President\u2062 Trump liable for fraud on Sept. 26,\u200c going \u200dfurther than what Ms. James sought in penalties when he unexpectedly ordered the dissolution of the \u2063Trump Organization. He \u200bgave both\u2063 sides 10 days to \u200bnominate an independent reviewer to\u2063 manage \u200dthe dissolution of the businesses. The independent &#8220;receiver&#8221; would function \u200bmuch like an executor.<\/p>\n<p>The decision was &#8220;fundamentally flawed at \u2063every level,&#8221; said Alina Habba, a legal spokesperson for President Trump.<\/p>\n<p>&#8220;It\u200c is important to remember that the Trump Organization is an American success story,&#8221; she said. &#8220;The fact that this court summarily found\u2064 that there is no \u200bquestion of fact, finding \u2062in \u2064part that Mar-a-Lago is worth approximately $20 million, and issued a decision of this magnitude is an affront to our legal system.&#8221;<\/p>\n<p>During the trial, Trump\u200d attorney Christopher Kise asked the judge whether his order meant that buildings owned by LLCs\u200b under the Trump Organization would be\u2064 sold off. This would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-rules-on-trumps-motion-in-new-york-fraud-case\/\" title=\"Court rules on Trump's motion in NY fraud case.\">include \u200dhigh-profile properties<\/a> such as Trump \u2063Tower and \u206340 Wall\u200c Street, as well as a family estate in suburban Westchester County.<\/p>\n<p>\u201cIs it the court\u2019s position that\u200c those assets are now going to be sold or just going to be managed under the \u200bdirection of the (receiver)?\u201d Mr. Kise \u2062asked. \u200bHe noted that some of the properties owned by LLCs under the Trump Organization have nothing to do with the case, such as the private homes of President Trump&#8217;s sons, who \u2062are defendants in the case.<\/p>\n<p>The judge consulted with his clerk\u2063 before answering that he was\u200c &#8220;not prepared to issue\u2062 a ruling right\u200d now.&#8221;<\/p>\n<div class=\"my-5\">\n<p>During the trial beginning on Oct. 2, Justice Engoron, and not a jury, will determine the fate of President Trump&#8217;s businesses in New York. The judge will also rule on the\u2063 six \u200cother claims that Ms. \u200dJames&#8217;s office has\u200c brought forth and determine \u200bhow\u2063 much President Trump will have \u200cto \u2062pay in penalties.<\/p>\n<h2>Appeal Arguments<\/h2>\n<p>President Trump&#8217;s latest appeal had to do with the \u200bstatute of \u200climitations.<\/p>\n<\/div>\n<p>The June\u2063 appeals \u2064court ruling had said that several allegations in Ms. James&#8217;s claim fell outside the six-year statute of \u2062limitations, \u2064and said that she couldn&#8217;t pursue the claims\u2063 before July 2014 and February 2016. After this decision, Ivanka\u2062 Trump was\u200d removed\u2063 from the case as a defendant, because\u2062 she argued that she had \u200cleft the Trump Organization in 2016.<\/p>\n<p>Ms. James had argued against the appeals court decision, claiming that later financial statements in\u200b question \u200creflected those earlier claims.<\/p>\n<p>In Justice Engoron&#8217;s summary judgment on Sept. 26, he dismissed President Trump&#8217;s\u200c motion to dismiss the case based on this argument to\u200b be &#8220;pure\u200d sophistry,&#8221; siding with Ms. James in stating that the\u2063 financial statements \u2063are what the case looks at.<\/p>\n<p>He further dismissed, at length, a repeated defense that President\u200d Trump has made, referencing the Disclaimers on\u2064 all of the \u2062financial statements \u2062submitted to the banks and \u200dinsurers that Ms. James says he defrauded. The Disclaimer notes methods used to arrive at the valuations and notes that financial institutions using different methods may come out with different numbers.<\/p>\n<p>Justice\u2063 Engoron wrote that the statements in no way protect President \u200bTrump from liability \u2064for incorrect valuations, as he has claimed.<\/p>\n<div class=\"my-5\">\n<p>Ms. James is relying on\u2063 the Martin Act, \u2064an \u2062anti-fraud law \u200bthat\u2064 doesn&#8217;t require the prosecutor to show that President \u2063Trump intended to commit fraud, or that \u200ddamage was done to the lenders and insurers. It&#8217;s considered \u200can overly broad &#8220;blue sky&#8221; law, which a\u2064 Wall Street Journal <a href=\"https:\/\/www.wsj.com\/articles\/the-worst-law-in-america-1522014930\" target=\"_blank\" rel=\"noopener\">editorial<\/a> board opinion dubbed &#8220;the worst \u200claw in America.&#8221;<\/p>\n<\/div>\n<p>Under \u200cthis act, \u2062Justice\u200c Engoron noted that &#8220;disgorgement of profits&#8221; is\u200c an available remedy, hence his order of the \u2062dissolution \u200cof the Trump Organization.<\/p>\n<\/div>\n<p> <\/p>\n<h2> What are the key\u200c arguments of\u200d President Trump&#8217;s legal team \u200con appeal and\u2064 why do they \u200boppose the appointment of an independent \u2062receiver<\/h2>\n<p><span>  P>President Trump argued\u200c that\u2062 the \u200bclaims made by Ms.\u200c James\u2063 should be dismissed \u2062as\u200d they exceeded \u200bthe six-year statute of\u200c limitations\u2062 for fraud.
