Lola Sheldon-Galloway (R-Great Falls), was signed in May by\u2063 Republican Gov. Greg Gianforte. The judge \u200cnoted in his order that there&#8217;s no process for these clinics to secure a license before Oct. 1.<\/p>\n<p>\u201cBefore licenses \u2062can be issued, the \u2064 [Montana Health] Department must first promulgate rules,&#8221; Judge\u2064 Abbott wrote, adding: &#8220;The department, however, has neither adopted nor even publicly proposed temporary or final rules to implement H.B. \u2064937, nor has it \u2063otherwise given \u2062providers guidance on how \u200cthey can\u200d avoid violations of Section 2(1) in \u2063the interim.<\/p>\n<p>\u201cWhile there may or may not prove to be a compelling state interest in licensing abortion clinics, a question for\u2063 another day, there is no compelling interest in imposing a mandatory licensure regime while issuing no licenses. Nor can the\u2063 court avoid the constitutional problems with Section 2(1) as \u200bwritten by engrafting onto it\u200c an\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-blocks-law-requiring-abortion-clinics-be-licensed\/\" title=\"Montana rejects law mandating abortion clinic licensing.\">implied impossibility defense<\/a>,\u2063 because that would require the court to \u2018insert what has been omitted,'&#8221; he\u200c added.<\/p>\n<div class=\"my-5\">\n<p>Montana abortion providers\u200d had \u200dsued the state (<a href=\"https:\/\/www.theepochtimes.com\/assets\/uploads\/2023\/09\/28\/id5500053-montana-lawsuit-from-abortion-providers.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) at the start of the\u200c month over the legislation. They argued\u2062 that the law\u2063 is unconstitutional in part because there&#8217;d \u2064been no guidelines from the \u2063state health department on \u2062how to obtain a \u2062license, thereby making \u200dcompliance by\u2063 Oct. 1 &#8220;impossible.&#8221;<\/p>\n<\/p><\/div>\n<p>&#8220;HB 937 is\u200d also vague\u2062 as to whether \u200bPlaintiffs\u200b must become licensed as \u201cabortion clinics\u201d or whether they may continue to provide \u200bthat care under the\u200c laws to which they\u2062 and similar clinics\u200c are currently subject,&#8221; \u200cthe filing read.<\/p>\n<p>The\u200b abortion providers also noted that abortions are already regulated in the state. &#8220;Plaintiffs have been, and will continue to be, subject to generally applicable \u2063State, \u2064federal, and\u2063 professional oversight and regulation,&#8221; they wrote. &#8220;As mainstream medical \u200bauthorities have repeatedly concluded, there is no valid reason to target abortion\u2063 care for additional regulation.&#8221;<\/p>\n<p>The ACLU of Montana, the Center for Reproductive Rights, and law firm Dechert, LLP, filed the lawsuit on\u200c behalf of All\u2062 Families Healthcare, Blue Mountain\u200b Clinic, and Helen Weems, APRN-FNP.<\/p>\n<p>The lawsuit names the defendants as the state of Montana, the Department of Public Health and Human Services (DPHHS), and Charlie Brereton, its director.<\/p>\n<\/blockquote>\n<p> <\/p>\n<h2> \u200b What \u200bis the main concern raised by \u2062opponents\u2063 of the\u2062 licensing requirement for abortion clinics in Montana?<\/h2>\n<p><span>  \u200dE absence of licenses.\u201d<\/p>\n<h3>Controversial Law<\/h3>\n<p>The law\u2063 requiring abortion clinics to be licensed has been met with significant controversy since its introduction in Montana. Proponents\u2062 argue\u2062 that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-judge-temporarily-blocks-law-requiring-abortion-clinics-to-be-licensed\/\" title=\"Montana judge halts law mandating abortion clinic licensing temporarily.\">licensing ensures proper oversight<\/a> and regulation\u200c of clinics, ultimately safeguarding the health and well-being of patients. Meanwhile, opponents\u2062 claim that such requirements are unnecessary and place undue\u2063 burden on providers, potentially limiting\u200c access to abortion services.<\/p>\n<p>Planned Parenthood \u2063of Montana, along with several other abortion providers, filed a lawsuit challenging the law, arguing that it creates unreasonable obstacles and violates patients&#8217; constitutional right to \u200daccess \u2064abortion. They\u200b sought a temporary restraining order \u2062to halt the implementation of the licensing requirement until the case could be fully heard.<\/p>\n<h3>Judge&#8217;s Decision<\/h3>\n<p>In his order granting the temporary restraining order, Judge Christopher Abbott acknowledged that Montana\u2063 has yet to establish a process for licensing abortion clinics.
