Special Counsel Jack Smith charged the 2024\u200b Republican frontrunner \u2062with conspiracy to defraud the United States, conspiracy against\u2063 rights, obstruction of \u200dan \u200bofficial proceeding, and conspiracy to obstruct a proceeding, all for raising electoral objections similar to those Democrats have <a href=\"https:\/\/thefederalist.com\/2022\/06\/13\/second-j6-hearing-criminalizes-republicans-for-election-objections-after-democrats-made-them-for-decades\/\" target=\"_blank\" rel=\"noreferrer noopener\">made<\/a> for decades.<\/p>\n<p>Trump <a href=\"https:\/\/thefederalist.com\/2023\/08\/03\/trump-pleads-not-guilty-in-latest-witch-hunt-charges-over-jan-6\/\" target=\"_blank\" rel=\"noreferrer noopener\">pled<\/a> \u201cnot guilty\u201d to the charges days later and followed the plea with a motion to move the politically charged trial outside of the nation\u2019s capital. A new <a href=\"https:\/\/thefederalist.com\/2023\/09\/06\/new-poll-shows-trump-wont-get-a-fair-jury-trial-from-d-c-residents-whove-already-decided-hes-guilty\/\" target=\"_blank\" rel=\"noreferrer noopener\">poll<\/a> out earlier this month shows\u200c Trump made the latter request for good reason. Besides the \u200dfact that the district <a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/11\/03\/us\/elections\/results-district-of-columbia-president.html\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> for President Joe Biden over Trump in 2020 by a \u2062whopping 92 to 5 percent, an Emerson College survey found\u2062 a \u2062majority of D.C. \u200cresidents, 64 percent, \u2064had already made up their minds \u2062to vote in favor of convicting Trump\u2063 if they were selected for his jury. Only\u2062 8 percent said they\u2062 would find Trump innocent, and another 28 percent were \u200dunsure.<\/p>\n<p>An examination of Judge Chutkan\u2019s recent record only raises more \u200cdoubt \u2062over Trump\u2019s prospects of receiving a fair \u200dtrial,\u2063 even\u200d <em>if<\/em> \u2062the jury \u2063pool \u200cwere \u200cpicked from the 28 percent of residents who at least professed to have an open mind.<\/p>\n<p><strong>[READ:\u200d[READ:<a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">Judge\u2062 Tanya Chutkan\u2019s \u2064Record\u200b Should Disqualify \u200dHer From Presiding Over Trump\u2019s J6 \u2062Trial<\/a>]<\/strong><\/p>\n<p><a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a> to\u2064 the Associated Press\u2062 in\u200d August, the Obama-appointed \u200djudge\u2062 has\u2062 built a reputation as \u201ca\u200b tough punisher of Capitol rioters.\u201d Chutkan presided over more than three dozen cases of those charged with crimes related to the\u2064 Capitol chaos on Jan. 6, 2021.<\/p>\n<p>\u201cOther judges typically have handed down sentences that are more lenient \u200cthan those requested by prosecutors,\u201d reported the \u200cAP. \u201cChutkan, however, has matched or exceeded prosecutors\u2019 recommendations in \u200c19 of her\u2062 38 \u200bsentences. In four\u2064 of those cases, prosecutors weren\u2019t seeking any jail time at all.\u201d<\/p>\n<p>Through her rulings in the cases of riot\u200b defendants, Chutkan blasted comparisons between \u2064the Capitol\u2064 violence and the explosion of \u2063Democrat-led\u2064 violence and unrest that \u2063defined \u200bthe summer of 2020. The fiery riots, she\u200b <a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>, were\u2064 actually \u201cthe actions of people protesting, \u2064mostly\u2062 peacefully,\u2062 for civil rights.\u201d \u200dNever mind the <a href=\"https:\/\/v2-9mdnszte.thefederalist.com\/2020\/09\/16\/george-floyd-riot-damage-could-cost-insurance-companies-upwards-of-2-billion\/\" target=\"_blank\" rel=\"noreferrer noopener\">$2 \u200dbillion<\/a> worth of damage, making the outbreak\u200d of leftist violence one of the most destructive in American history. The carnage\u2064 from the \u2062summer of rage cost <a href=\"https:\/\/thefederalist.com\/2021\/02\/26\/estimates-george-floyd-riots-to-cost-66-times-more-than-capitol-damage\/#:~:text=Estimates%3A%20George%20Floyd%20Riots%20To%20Cost%2066%20Times%20More%20Than%20Capitol%20Damage&#038;text=The%20Capitol%20architect%20told%20lawmakers,cost%20an%20estimated%20%242%20billion.\" target=\"_blank\" rel=\"noreferrer noopener\">66\u200b times<\/a> more \u200cthan the estimated damage done to \u2063the Capitol on Jan.\u200c 6.<\/p>\n<p>Parroting the \u200dDemocrat\u200d talking point that Republicans, along with election integrity, pose a \u2063\u201cthreat to\u200d democracy,\u201d Chutkan declared\u2063 comparisons\u2062 between the two episodes \u201cignore[] a very \u2062real danger that the Jan. 6 riot posed to the foundation of our democracy.\u201d<\/p>\n<p>Furthermore, when Trump complained the\u200c federal charges against him were instruments of \u2063election \u2062interference by\u200b the Department of Justice, \u200cChutkan\u2063 <a href=\"https:\/\/thefederalist.com\/2023\/08\/11\/left-wing-judge-on-trumps-claim-political-prosecution-is-election-interference-so-be-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">shrugged<\/a> \u2064 it \u200doff, saying \u201cthat\u2019s how it has to be.\u201d<\/p>\n<p>\u201cWhat \u200dthe \u2062defendant is currently\u2063 doing \u2014 the fact that he\u2019s running a \u200cpolitical campaign has\u200d to yield\u2064 to the \u200dorderly\u200d administration of justice,\u201d Chutkan said. \u201cIf\u200d that means he can\u2019t say exactly what\u200d he \u200dwants to say\u2064 about witnesses in this case, that\u2019s how it\u200b has to be.\u201d<\/p>\n<p>In her <a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2023cr0257-61\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> Wednesday, Chutkan dismissed the obvious prejudice\u2063 revealed in her prior comments, declaring that her \u2062statements \u201ccertainly do not\u200b manifest a \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-only-12-democrats-condemn-ilhan-omar-for-comparing-u-s-israel-to-terrorists\/\" title=\"BREAKING: Only 12 Democrats Condemn Ilhan Omar For Comparing U.S., Israel To Terrorists\">deep-seated prejudice<\/a> that would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" title=\"Judge Chutkan won't step aside in Trump's J6 case; she's determined to prove her narrative.\">make\u200b fair judgment impossible<\/a>.\u201d<\/p>\n<hr>\n<p>Tristan Justice is\u200c the\u200c western correspondent for The \u2062Federalist and the author \u2062of\u200c Social Justice Redux, a \u2062conservative newsletter on culture,\u2063 health, and wellness.
