Mar\u00eda Elena Durazo (D-Los Angeles), would \u2062also mandate 12 months \u2063of occupancy \u200cfor owners or a family \u2064member, if occupying the \u2064rental was the \u200bcause for the tenant eviction.<\/p>\n<p>Under the new law, property\u200b owners would have to move in within 90 days of evicting a tenant, who cannot\u200c be over 60, disabled, or \u2064terminally ill. The bill sunsets in 2030.<\/p>\n<p>According to the recent analysis,\u200b since the current \u2062law became effective some\u2062 property owners have\u200d used loopholes \u200bto evict tenants with the intent of a substantial renovation or\u200c demolition, or to move in a family member or themselves, but have then turned around and re-rented the property at \u2064a much \u2063higher price instead.<\/p>\n<h2>What SB 567 Could Mean for\u2064 California Property Owners<\/h2>\n<p>\u201cUnfortunately, unscrupulous landlords sometimes claim such \u2063a move-in as a basis for eviction, but neither they nor\u2062 a family member actually move into the unit,\u201d according\u2063 to\u200b the analysis.<\/p>\n<p>SB \u200c567 addresses such issues by requiring a written eviction\u2063 notice, name \u2064of the family member moving in, and the right for tenants to request\u2062 proof the\u2064 intended \u200boccupant is an owner or related to \u200cthe owner.<\/p>\n<p>For those seeking \u2063to evict \u2063tenants over a substantial remodel\u2062 or demolition, such must require a vacancy of at least 30 days and owners must prove the work can\u2063 only be accomplished \u200bsafely if the unit is unoccupied. A\u200c written notice explaining the work\u2062 to \u200bbe done, a timeline, and permits for the renovations are also required, according to \u200dthe bill\u2062 text.<\/p>\n<p>Multiple cities statewide are considering local ordinances to tighten up \u2064the state\u2019s current tenant protections such as Burbank, Chula Vista, and San Diego,\u200d according to \u200ba Sept.\u200d 14 Assembly Floor analysis.<\/p>\n<p>In the same analysis, lawmakers referenced one example of\u200c such \u201cabuses of power\u201d from last year\u200c when an owner in Encinitas evicted\u2062 several \u2062tenants based on a substantial remodel, including new paint and flooring, but later \u2063re-rented the units \u200bfor 50 percent more without completing the repairs.<\/p>\n<p>\u201cJurisdictions across the state are seeing \u2063significant\u200d abuse of \u200dthe substantial remodel provision,\u201d\u2064 they \u200dwrote.<\/p>\n<p>Those in support of the bill argue \u2062that the state\u2019s\u2062 current law has\u2062 failed\u200b to prevent unjust evictions.<\/p>\n<h2>What \u2062SB 567 Could Mean \u200dfor California Property Owners<\/h2>\n<p>But \u200csome opposed to the\u2062 bill,\u2062 like property\u2062 owners, say they are being pushed out of the \u200drental housing market from \u200coverregulation, especially coming on the heels of eviction \u2062moratoriums during the \u2064COVID pandemic.<\/p>\n<p>\u201cMany of \u2063our members are just reeling from the past three years or \u2062so of not being able to increase their rent, not being able\u2064 to collect rent in the LA area \u2026 Owners\u2062 have been struggling, liquidating their retirement savings, basically they\u2019ve\u2062 had no rights \u200dfor three years under all these COVID regulations,\u201d Daniel Yukelson, executive director\u200c of The Apartment\u2064 Association of Greater Los Angeles told The Epoch Times.<\/p>\n<p>With about 10,000 members, Mr. Yukelson said regulations in\u2063 California have led to around 100 members monthly leaving the rental\u2062 industry, since the onset of such due\u200d to COVID.<\/p>\n<p>\u201cThere&#8217;s\u2064 just \u200bregulations like this that are basically pushing people out \u200cof business. I see \u2063it in our membership all the time. We&#8217;re losing numbers \u2062all the time. \u200cOur membership is a leaky bucket,\u201d he said.<\/p>\n<p>If the new bill \u200dis signed \u2062into law, exiting the rental housing business could also\u2063 now prove difficult with\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/defense-attorney-reveals-kyle-rittenhouses-next-moves-career-goal\/\" title=\"Defense Attorney Reveals Kyle Rittenhouse\u2019s Next Moves, Career Goal\">potential civil lawsuits<\/a> from failing \u2062to meet the bill\u2019s\u2063 eviction requirements,\u2064 which Mr. Yukelson said\u200c could further push away\u200b those interested in\u2064 the\u2063 industry.<\/p>\n<p>\u201cIf an owner wants to exit the rental housing business,\u2062 under SB\u200d 567, they&#8217;re opened up to all kinds of lawsuits from their former \u2062tenants. If they make one mistake or \u200bdon&#8217;t do something \u2063right, they&#8217;re subject to multiple lawsuits,\u201d he said.<\/p>\n<p>According to the same Senate analysis of the bill, owners who violate the provisions of the new law could be sued by tenants for damages up to three times the actual damages incurred by\u2062 the eviction, as \u200dwell as for punitive damages, and attorney\u2019s fees.<\/p>\n<p>One of the unintended consequences of the bill, according to Chip \u200cAhlswede, vice president\u200b of\u2063 external affairs for the Apartment Association of Orange County, is the 12-month occupancy requirement for\u200b an \u2063owner or their family moving in.<\/p>\n<p>\u201cThere\u2019s so many different reasons why somebody comes into a unit \u2026 a kid going to college \u2026 someone getting sick or needing palliative\u2064 care \u2026 we\u2019re \u2063right here next to Hollywood where [Hollywood] shoots happen for six months at \u200ba time on location,\u201d he told \u200bThe Epoch \u200dTimes.<\/p>\n<p>In such situations, unexpected things happen, he said,\u200d such as\u2063 a child in college transferring schools, or the death \u200bof a sick family \u2064member, before the required 12-month period.<\/p>\n<p>\u201cIt seems like it was a\u2064 quick simple \u2063answer to a \u200bcomplex problem,\u201d he said of the bill, \u2062which Gov. Gavin Newsom has until Oct. 14 to sign into law or veto.<\/p>\n<p>Others\u200d also\u200d say the current law hasn\u2019t had enough time to show\u2064 its effectiveness, with the\u2063 current one rushed.<\/p>\n<p>\u201cAB \u20641482 hasn\u2019t had \u2064sufficient time to do what it was intended\u200c to do. \u2064It went into \u2064effect in early\u200b 2020,\u200b right as the pandemic hit, and obviously \u200bwe had lots\u2063 of eviction \u2063moratoriums\u200c and other \u200dthings in \u2062place,\u201d said Molly \u2062Kirkland,\u2062 director of\u200c public affairs for the Southern California Rental Housing Association\u2014representing landlords and property managers in San Diego, Imperial, and southern Riverside\u2062 counties.<\/p>\n<p>She additionally said the added regulations could push out independent\u200c owners.<\/p>\n<p>\u201cWe still have quite a \u200bfew property owners who are owed well over $10,000 in COVID \u2062era rent\u200d \u2026 when you keep adding more and\u2063 more regulation, on top of what\u2019s already in \u2062place, \u200cit becomes difficult \u200cfor\u200c owners and managers\u2062 to operate rental\u200b housing and our fear is that\u2019s just going to push independent \u2063owners out of the marketplace,\u201d she\u200b told\u200d The Epoch Times.<\/p>\n<p>In a letter \u2063to the governor sent earlier this month, other apartment associations representing landlords \u200dand property managers\u200c all over \u2063the state \u2062asked for a veto of the bill.<\/p>\n<p>\u201cSB 567\u2019s impacts will badly\u2062 hurt independent, small \u201cmom-and-pop\u201d property owners \u200cwho may\u2064 need assistance making\u200c ends meet and require to be\u200b housed themselves within their \u200crental property,\u201d\u200c said apartment and rental\u200c housing \u2062associations\u200d of Southern\u200d California, Orange County, the \u200cEast Bay, North\u2062 Valley, Santa Barbara, Los \u2063Angeles, Northern California, and others.<\/p>\n<p>According to\u200b the same letter, California has the lowest eviction rate amongst the country\u2019s 10 largest states, and restrictions under the new bill are unreasonable and may also lead to tired and outdated rental stock.<\/p>\n<p>\u201cOwners of rental properties are in the housing business, not the eviction business. Evictions are costly and time consuming, and always are a last \u200dresort for housing providers. SB 567 poses major barriers for\u200b housing providers seeking to remodel and enhance their properties \u200dfor residents. With rising labor and materials costs, and with the added\u2063 mandates, property owners will be forced to \u2064hold off or forgo\u200b improvements altogether,\u201d\u200b the\u2062 letter \u200dreads.<\/p>\n<p> <\/p>\n<h2> How do proponents of SB 567 argue \u2063that\u200b it will protect vulnerable tenants from\u2063 unfair evictions and prevent deceptive eviction practices?<\/h2>\n<p><span>  Ista, and Oakland. These local ordinances aim\u200d to further restrict \u201cno-fault\u201d evictions \u200cand provide \u200cmore \u200bsecurity for tenants \u200cfacing eviction. <\/p>\n<p>Supporters of SB 567 argue that it is necessary to close the existing loopholes in the law and protect vulnerable tenants from unfair evictions. They believe \u200cthat requiring proof from landlords for \u201cno-fault\u201d evictions will prevent landlords from \u200cusing this \u2064as a means to raise rents or \u200cevict tenants \u2063without proper justification. By mandating a 12-month occupancy period for owners or family members, the bill aims to prevent \u200ddeceptive eviction\u2062 practices where\u200b landlords claim to move in but do not actually do \u2064so.<\/p>\n<p>Opponents of \u200dthe bill argue that it puts undue burden \u200con property owners and restricts their ability to manage their properties.\u2064 They claim that the bill infringes\u2063 on property rights and may discourage investment in rental housing. They \u2062also argue that the additional requirements for eviction notices and proof of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-bill-tightens-restrictions-against-evictions-for-property-owners\/\" title=\"California Bill Strengthens Eviction Restrictions for Property Owners\">ownership create unnecessary bureaucracy<\/a> and \u200bcould lead to \u200ddelays in the \u2063eviction process.<\/p>\n<p>Whether SB 567 becomes law or \u2064not, the debate surrounding tenant evictions in California highlights the ongoing need to\u2062 balance\u200d the rights of\u200b landlords and \u200cthe protections of tenants. With\u200b the\u200d high cost \u2062of housing \u200band the\u2064 increasing vulnerability of renters, finding a fair and equitable solution is crucial.
