With numerous <a href=\"https:\/\/freebeacon.com\/democrats\/starbucks-hired-eric-holder-to-conduct-a-civil-rights-audit-the-policies-he-blessed-got-the-coffee-maker-sued\/\">companies<\/a> and <a href=\"https:\/\/freebeacon.com\/courts\/meet-the-top-flight-law-firms-running-illegal-diversity-programs\/\">law firms<\/a> \u2062facing lawsuits over \u200dtheir\u2062 diversity programs, it appears that race-conscious decision-making\u2063 has permeated\u200d routine employment \u200bdecisions.<\/p>\n<p>&#8220;These numbers are extraordinarily stark,&#8221; said\u200b Dan Morenoff, the executive director of the\u2063 American Civil Rights \u200dProject, which handles\u200c reverse discrimination cases. &#8220;It\u2019s very hard\u200c to imagine this could be\u200b legally defensible.&#8221;<\/p>\n<p>Morenoff added\u200c that &#8220;disparate \u200bimpact,&#8221; or\u200c disparities in\u2063 outcomes, can \u200cbe a basis for liability even \u2063without proof of intentional \u2064discrimination.
